Church secures a win against ‘petty tools of government’

A church in Bryan, Ohio recently notched a win that religious liberty advocates believe will set a new precedent after the city attempted to shut down the church using fire codes.

Last Friday, Ohio’s Sixth District Court of Appeals reversed an injunction against the church, called Dad’s Place, and its pastor, Chris Avell, from being able to carry out religious ministry to the homeless and providing them with temporary shelter. The legal questions in the case centered around the relationship between religious liberty and municipal codes, with an eye to ensuring religious organizations are not unnecessarily burdened.

Ryan Gardner, senior counsel for First Liberty Institute, told The Daily Signal that the law requires “the least restrictive test possible,” when dealing with religious organizations. “You have to infringe on religious liberty with as light a touch as possible. And that’s the test that the court says applies here, and that’s why it sent the case back down to the trial court to correctly apply that… test.”

Gardner claimed, also referring to sentiments shared by Attorney General Dave Yost, that, in this case, Bryan, Ohio was seeking to use “petty tools of government to shut down a disfavored ministry” in the form of fire codes. The Daily Signal also reached out to Yost’s office for further comment on the case.

A report from WTOL Toledo highlighted how the trial court must reconsider the case based not on the rational basis standard that had been used, but rather the strict scrutiny standard according to the Ohio Constitution Conscience Clause. Also relevant is the Ohio Supreme Court case of Humphrey v. Lane, a 2000 decision to do with grooming policies at the Ohio Department of Rehabilitation and Correction, which violated the practices of a Native American officer.

The First Liberty Institute press release cited the opinion and its instructions for the lower court. “Because the trial court erred in failing to address [Dad’s Place’s] arguments under the Ohio Conscience Clause we must remand the case to the trial court for further proceedings. On remand, the trial court is directed to consider [Dad’s Place’s] claim under the Ohio Constitution and to reconsider [Dad’s Place’s] free exercise claim under the U.S. Constitution using a strict scrutiny analysis,” it read.

A press release from First Liberty detailed how Bryan, Ohio has gone after Dad’s Place and Avell, using “multiple criminal and civil proceedings, including 18 criminal zoning charges, middle-of-the-night fire inspections, and both criminal and civil fire code prosecutions.”

The press release also noted that this is “while city officials demand the church install an expensive fire suppression system, the city does not require any of its motels, most of its apartment complexes, and even a senior living facility to install fire suppression systems in their buildings.”

Fire codes have been so onerous that many buildings have been grandfathered in, Gardner explained to The Daily Signal. These codes are often burdensome for profit organizations, Gardner added, and Dad’s Place would not have been able to comply with the fire code restrictions.

Gardner stressed that “vast discretion” is used to enforce fire codes, which, along with laws such as zoning codes and nuisance laws, are “highly discretionary” and can be used against organizations that may be deemed disfavored compared to others. The court’s holding, therefore, is “monumental for religious ministries” not merely in Ohio but “across the country,” Gardner explained.

Gardner further applied this test to churches being more burdened than secular places during COVID-19 lockdowns, as well as recent U.S. Supreme Court cases. With Fulton v. Philadelphia, the Court in 2021 unanimously found that the City of Philadelphia violated a Catholic foster agency by refusing to renew a contract unless same-sex couples were allowed to be certified as foster parents.

The Daily Signal reached out to the City of Bryan for comment on the case.

Friday’s court win is not the end of the road, however. Pastor Chris Avell’s appeal of a criminal conviction against him is still pending. Nevertheless, Gardner sees such a victory as “a turning point in the case,” and one that means “the turkey is going to taste a little better” given how close the victory came to Thanksgiving.

‘This wasn’t an accident’: School promotes porn as ‘art,’ gets busted

A school has gotten caught promoting online pornography as “art,” and then concealing that agenda from parents.

And officials with the American Center for Law and Justice aren’t letting it slide.

“Our clients, Stephanie Boyanski and Jessy Roberts, were horrified to learn that their seventh-grade children were assigned to visit an unvetted website containing graphic sexual images as part of an art project. The teacher, Ms. Bridgette Gates, displayed these images on a Smart Board in class, acknowledged that ‘some images were inappropriate,’ and then instructed students to ‘ignore them and be mature,'” the ACLJ explained about the dispute that has arisen in Watertown City School District in New York.

There, students in seventh grade were ordered to see pornography “under the guise of an ‘art lesson.'”

“This wasn’t an accident. Students viewed this explicit material repeatedly over the course of approximately two weeks, for a graded assignment. No parental notice. No opt-out option. No filtering of graphic content. No alternative assignment,” the legal team explained. “One of the students involved is a survivor of sexual assault. This assignment triggered traumatic memories, and this student is now in counseling as a direct result of the school’s actions.”

The lawyers said they are taking action, beginning with a formal demand letter to the superintendent outlining the district’s constitutional violations and its failure to protect students from exposure to pornographic material.

“We are demanding a formal reprimand in the teacher’s file, a clear policy barring teachers from showing sexually explicit content to children without parental notification, mandatory parental consent and opt-out procedures, and district-funded counseling for students traumatized by the assignment,” the ACLJ explained.

It’s a district with which the ACLJ is familiar, at it earlier refused to provide legally required access to a religious group.

The report noted the parents only found out about the violations by accident, through parents who reviewed an assignment on their students’ school laptops and found the “sexually explicit” material.

The teacher at the time blamed the IT department for not blocking it, but the school then refused to let parents meet with the teacher.

The district then claimed the students had “come across inappropriate content,” but that, the ACLJ said, wasn’t the case.

“That phrasing was deliberately misleading. Students did not ‘come across’ anything. They were assigned to view this graphic content by their teacher.”

When the dispute came before the school board, “The president of the teachers’ union mobilized teachers to attend the meeting in ‘solidarity,’ canceled after-school activities to ensure staff attendance, and distributed ‘Fact Over Fiction’ pins – an unmistakable message aimed at parents. He went so far as to compare concerned parents to vandals of his Little Free Library outside of his home and dismissed them as ‘internet warriors,'” the legal team explained.

But the law is on the side of the parents, the report said. “For over a century, the Supreme Court has affirmed that parents have the fundamental right to direct the upbringing and education of their children.”

Democratic Tennessee congressional candidate Aftyn Behn sobbed and screamed at the top of her lungs as security removed her from Republican Tennessee Gov. Bill Lee’s office in resurfaced footage from April 2019.

Behn and other women with the activist group, Enough is Enough-Tennessee, staged a sit-in inside the state capitol and demanded to speak to Lee about calling for the resignation of the then-Republican state Rep. David Byrd, who was accused of sexual misconduct at the time. The women, including Behn, tried to rush into the governor’s office when the doors were open on April 17, 2019, prompting security to remove her from the premises.

Footage posted by NewsChannel 5 Nashville shows security dragging Behn out of the office as she screamed at the top of her lungs. She then sat on her knees and sobbed on the floor.

State troopers warned that the women would be arrested if they did leave the building, prompting several of them to follow orders. However, Behn and a few others remained in the building and were soon arrested.

A month later, footage showed Behn screaming from the wing of the state house chambers during the 111th General Assembly Meeting and calling on Byrd to resign. Security forcibly escorted her from the area, cited her and later released her from custody that evening.

Behn is currently running against Republican candidate Matt Van Epps, a former commissioner for Lee, to be the next U.S. representative for Tennessee’s 7th district. A special election in the district will be held on Dec. 2 following the resignation of former Republican Tennessee Rep. Mark Green.

Behn has openly insulted her state and the constituents she hopes to represent. She called Tennessee “racist” and also stated that it is a “godforsaken” state in resurfaced footage from 2023. She also stated during a February 2020 appearance on the “Year old GRITS” podcast that she hated everything about Nashville.

Republican senators require abortion restrictions to support Trump’s 2-year Obamacare extension

The White House reportedly plans to unveil a health policy framework including a two-year extension of Affordable Care Act subsidies. While Congress awaits details, Republican senators say they will not support a deal without the Hyde Amendment, which prohibits taxpayers dollars from funding abortions.

“We don’t have any details on this plan, but Sen. Young supports Hyde protections and believes it should apply to any taxpayer funded health care spending,” Leah Selk, press secretary for Sen. Todd Young, R-Ind., told The Daily Signal.

Another Republican senator who asked to remain anonymous told The Daily Signal any deal or legislation would have to at least include Hyde Amendment protections.

President Donald Trump will ask Congress to pass a bill preventing Affordable Care Act subsidies from expiring next month, sources familiar with the matter confirmed to The Daily Signal. The White House has not specified if its framework will include the Hyde Amendment.

“We are committed to upholding Americans’ values, but any official announcements of any specific plans will come from POTUS,” a White House official told The Daily Signal.

While the announcement was first reported to be coming as early as Monday, a White House official told The Daily Signal that there is no health announcement planned for today. MS Now reported that the White House is delaying the healthcare proposal after significant congressional backlash.

Sen. James Lankford, R-Okla., said he will wait to review the bill language before making final decision, but he maintains his commitment to making sure taxpayers don’t fund abortions.

“Sen. Lankford will continue to push for strong Hyde protections, as federal law requires, and as he has always done,” a spokesman told The Daily Signal.

Sen. Marsha Blackburn, R-Tenn., will also not support a health care plan without Hyde, according to a spokesperson.

The pro-life movement is on the same page, with Kelsey Pritchard of Susan B. Anthony Pro-Life America telling The Daily Signal her organization “will continue to oppose any healthcare plan that does not include that safeguard.” She said that is where the majority of senators are going to land as well.

“We’ve seen many pledges of the importance of pro-life policy in the healthcare space,” Pritchard said.

Senate Republicans differ on if they want to extend Obamacare at all. Sen. Cynthia Lummis, R-Wyo., told reporters during the shutdown that to extend the subsidies would be to put more resources into a program that has not yielded results for Americans.

House Freedom Caucus Chairman Andy Harris, R-Md., previously told The Daily Signal “there’s no reason to [extend] it.”

“COVID is over,” he said. “The insurance companies have made billions of dollars off the enhanced tax credits. It’s about time to return to the pre-COVID level of tax credits with the original [Affordable Care Act] tax credits.”

Still, many Senate offices have told pro-life movement leaders that they plan to insist Hyde was included in whatever health care framework the chamber lands on, according to Quena González, senior director of government affairs at Family Research Council.

“I am sure that White House staff are very well aware of the concerns of pro-life Americans,” González added. “President Trump, in his first term, called himself, rightly, the most pro-life president in American history.”

Sen. Bill Cassidy, chair of the Senate Health, Education, Labor and Pensions Committee, told The Daily Signal that “Republicans are very, very, very concerned” about making sure the health care plan doesn’t fund abortion.

Cassidy proposed his own ACA funding bill which would use the current funding for enhanced premium tax credits to fund flexible spending accounts, or FSAs, for Obamacare eligible enrollees.

In order to end the record 43-day shutdown, Senate Majority Leader John Thune, R-S.D., offered Democrats a vote on an ACA funding bill by the end of the second week of December.

Sen. Rick Scott, R-Fla., proposed an alternative to Cassidy’s bill called the “More Affordable Care Act,” which would enable Obamacare customers to use a “Trump Health Freedom Account” that resembles a health savings account. His plan is Hyde-compliant by restricting use of funds on abortion.

But Senate Republicans will struggle to get the necessary 60 votes to pass any legislation that includes Hyde, whether it be the proposal from the White House, Cassidy, or Scott.

“It’s a nonstarter,” Sen. Jeanne Shaheen, D-N.H., told NBC News.

Since Republicans won’t vote for a bill without Hyde and Democrats won’t vote for a bill with it, reconciliation may be the chamber’s only option. Instead of needing 60 votes, a reconciliation bill only needs 50 votes in the Senate.

Republican Study Committee Chair August Pfluger, R-Texas, favors this option, saying it’s the best way to reduce health care costs for Americans.

“Our proposal will put power into patients’ hands by creating healthcare options that protect pre-existing conditions while giving families real alternatives to ObamaCare,” he wrote in the Wall Street Journal. “We’ll expand access to health savings accounts, grant employers more flexibility to help workers find coverage that fits their needs, and remove barriers to affordable generic and biosimilar drugs.”

Last week, White House Deputy Chief of Staff James Blair expressed interest in a bipartisan health plan but said that “if that path is foreclosed, there is the partisan path of reconciliation as well.”

Critics say this could be hard to get done before the end of the year, as it took Republicans months to use reconciliation to pass the “One Big Beautiful Bill” over the summer. Pro-lifers would also have to overcome the Byrd rule, which is meant to restrict the process to budgetary policy only.

Senate Parliamentarian Elizabeth MacDonough—essentially the Senate referee—decides on whether or not provisions in the budget reconciliation process follow Senate rules.

But the pro-life coalition believes with enough preparation, senators can find a way to get Hyde restrictions on Obamacare subsidies through MacDonough. Due to pro-lifers’ hard work coming with language that prohibited Medicaid from funding abortions and transgender procedures in the Big, Beautiful Bill, MacDonough allowed the provision to pass.

“In some sense, the Byrd Bath is real, and there are limits to what you can do on reconciliation,” said Family Research Council’s González. “But on the other hand, political will counts for a lot.”

‘Repulsive and sickening’: Teacher of the Year at Christian school released from jail after vicious beating of son goes viral

A Teacher of the Year at an Alabama Christian School is now out of jail after posting bail following her alleged savage beating of her 12-year-old son caught on camera.

44-year-old Nicole Staples was fired from her second-grade teaching position at Cottage Hill Christian Academy after video of the belt beating went viral. She is now charged with willful abuse of a child under 18 and was released from jail Wednesday after posting a $7,500 bond.

“Discipline is supposed to be for corrective action. That went way beyond that,” Mobile County Sheriff Paul Burch told WALA-TV.

“Snatch him up by his hair and yell and curse the way that she did, working for a Christian school, I thought was repulsive. It’s sickening to see somebody do that to their child.”

Burch told NBC 15: “It’s almost like a dual personality. Because by all accounts, I’m told she is a good teacher and well respected. And yet what happens in the home is clearly opposite of that.”

The sheriff’s office issued a statement indicating: “A video recorded by a family member appears to show Randi Nicole Staples instructing her 12-year-old son to lay across the arm of their sofa inside the residence in Grand Bay, Alabama.”

“Staples then allegedly struck her son on his bottom and legs approximately 20 times with a belt, during which the son can be heard pleading for her to stop.”

“You’re not f***ing sorry,” Staples yells while repeatedly striking her boy as he screams in pain with each lash of the belt.

“Because if you were f***ing sorry … you wouldn’t make extra work for everybody in this house because you won’t clean up after yourself. You don’t do what you’re supposed to do.”

The victim’s brother, 24-year-old Jackson Staples who no longer lives at home, told Fox10 he was the one who forwarded the video to Cottage Hill Christian Academy, where his mother was awarded Teacher of the Year this past May.

“I didn’t feel like, you know, she should be working at the school or even doing that to my little brothers,” said Jackson Staples, claiming his mom had “done it to me my whole life.”

The Academy told NBC 15 that it is “committed to providing a safe, nurturing, and Christ-centered environment for all students,” and that, “This commitment guides every action our school takes regarding student welfare and staff conduct.”

“On November 19, 2025, school leadership was made aware of concerns involving the off-campus conduct of an elementary teacher toward her minor child at her personal residence. Although the incident did not occur on school property, the nature of the information required immediate administrative action.”

“Upon learning of the alleged misconduct, the school acted swiftly and decisively, relieving the teacher of her duties and placing her on administrative leave pending a full review,” it continued.

“Following the findings of law enforcement, which determined that the teacher had engaged in improper conduct unrelated to her school responsibilities, an arrest was made and Cottage Hill Christian Academy terminated her employment in accordance with institutional policy.”

George Washington University law professor Jonathan Turley said Monday that former FBI Director James Comey and Democratic Attorney General Letitia James of New York could still face charges despite a judge saying a federal prosecutor was improperly appointed.

James was indicted in October on mortgage fraud charges stemming from her purchase of a house in Virginia, while Comey was indicted in September on obstruction and lying to Congress charges. Turley told “America Reports” co-hosts John Robers and Sandra Smith that the dismissal was not on the merits of the charges, but instead a question about whether interim U.S. Attorney Lindsey Halligan of the Eastern District of Virginia was properly appointed.

“Letitia James might be celebrating a tad too early. The problems here are not with the charges themselves, but essentially with the cop, or in this case the prosecutor,” Turley said. “So the court is not saying that she did – that she was innocent of these charges. The court is simply saying that the person who signed off on the charges didn’t have authority to do that. So the obvious thing here is to get someone who is lawfully in a position to perform this role.”

“Usually after 120 days, the district court appoints someone as the replacement. They are going to have to work this one out,” Turley continued. “It’s rather uncharted territory here to make sure that the next person who signs is going to be beyond these types of questions. They could also appeal. They are already past the original date, but the argument is they do have the right to go back to the grand jury. They may say, we think we have a good argument here, that yes, there’s that 120 days, but we had some rather novel sort of shifts that occurred here that we believe do not trigger that final date and that we had the ability to use Halligan in the way that we did.”

Senior United States District Judge Cameron Currie of the Eastern District of Virginia, a Clinton appointee, ruled that Halligan was not properly named as interim United States attorney because Halligan’s predecessor, Erik Siebert, had used up the 120-day limit for an interim prosecutor when he was named under the statute.

“Everything about this indictment seems to be rather rushed into – and improvisational,” Turley said. “When the Comey indictment came down, I noted that it seemed sort of disjunctive. They took out this count and the other two counts did not exactly fit neatly together and you got a sense of how quickly they had to get this through and that, I think, sat badly with this judge.”

The Pentagon is launching an investigation into Arizona Democrat Sen. Mark Kelly after he appeared with other Democrats in a recent video explicitly urging military members to disobey “illegal” orders from the Trump administration, the Department of War announced Monday.

Kelly appeared with five fellow Democrats in the video telling service members their “trust” with the American people is at risk and urging them not to “give up the ship.” Kelly reminded members of the Armed Forces that they “swore an oath” and said they can “refuse illegal orders.” The clear implication was that such orders are being given by President Donald Trump, servicemembers should refuse to obey.

However, Michigan Sen. Elissa Slotkin, who released the video, that she could not name one illegal order that the Trump administration has given to warrant disobedience.

Kelly, who is a retired Navy Captain, remains subject to the Uniform Code of Military Justice and is eligible for recall as a retiree, as noted in the Department of War announcement. That status may not apply to other former military members in the video who are not retirees.

“The Department of War reminds all individuals that military retirees remain subject to the UCMJ for applicable offenses, and federal laws such as 18 U.S.C. § 2387 prohibit actions intended to interfere with the loyalty, morale, or good order and discipline of the armed forces,” the Pentagon stated. “Any violations will be addressed through appropriate legal channels.”

War Secretary Pete Hegseth called the Democrat lawmakers in the video the “seditious six” in an X post Monday while clarifying that Kelly was a retired Navy Commander and thus is still beholden to the Uniform code for Military Justice (UCMJ).

“As was announced, the Department is reviewing his statements and actions, which were addressed directly to all troops while explicitly using his rank and service affiliation—lending the appearance of authority to his words,” Hegseth said in his post. “Kelly’s conduct brings discredit upon the armed forces and will be addressed appropriately.”

‘CLEAR INVASION’: Sheriff addresses Somalians in Minnesota, promises he’s working for them

The Somalian community in Minnesota has been in the headlines recently, with a report showing massive financial support coming from it for terrorists in Africa, and President Donald Trump’s decision to end protected status for the immigrants there.

But now a video has surfaced in which a Minnesota sheriff is trying to reassure the community.

In fact, he’s promising that he, as a Somalian, and other Somali police officers, are there to protect Somalians.

“As Somalian police officers, we work for you (Somalians) day and night, we stand for you and serve you,” he said. “You know, we came to this country as refugees. There were no Somalian police officers, so now that we have been hired, it means we are working for our own people (Somalians). We understand the culture, we understand the language, we understand the way of life.

“That’s why we are different from foreigners or white officers. We help bridge that gap. Know this, every Somalian police officer, whether you’re in the homeland or aboard, works for you (Somalians).”

The sheriff was speaking Somalian during his announcement.

Actually, a recent research project by City-Journal is charging that because of the huge Somalian community that has moved into Minnesota as well as its reliance on public programs, and the ability to channel money back to Somalia, Minnesota state taxpayers now are the biggest single source of funding for the Muslim terror network of al-Shabaab.

The report charges the Minnesota social programs are drowning in fraud, and “Billions in taxpayer dollars have been stolen during the administration of Governor Tim Walz alone. Democratic state officials, overseeing one of the most generous welfare regimes in the country, are asleep at the switch. And the media, duty-bound by progressive pieties, refuse to connect the dots.”

The schemes involve hundreds of millions of dollars.

Because of the reporting, Trump ordered an end to the Temporary Protected Status for Somalis in Minnesota.

Federal officials may designate that status if nationals cannot return safely to their home countries.

“Minnesota, under Governor Waltz, is a hub of fraudulent money laundering activity. I am, as President of the United States, hereby terminating, effective immediately the Temporary Protected Status (TPS program) for Somalis in Minnesota. Somali gangs are terrorizing the people of that great State, and BILLIONS of dollars are missing. Send them back to where they came from. It’s OVER!,” Trump wrote on Truth Social.

In fact, a Somali police officer a few years back was accused of shooting and killing a Minneapolis woman who had called police for help.

Justine Diamond had recently gotten engaged. She called police twice to report what apparently was an attack in her neighborhood, and as she approached the responding police car, Mohamed Mohamed Noor, an officer, shot and killed her. He was convicted of murder but was later sentenced to prison for manslaughter, and he has since been released.
