Virginia's Attorney General is not defending the state's marriage ban because he believes, rightly so, that it is flagrantly unconstitutional. When someone who knows a thing or two about the law makes this choice, he or she is, in fact, defending the constitution from unreasonable attempts to muck it up.
But leave it to the proudly discriminatory Concerned Women For America to frame the AG in a reductive way that makes him seem scary and lawless:

Erik Rush responds to my GLAAD column by equating homosexuality with rape, murder
Conservative activist Erik Rush is none too happy with me for responding to his prediction that activists like CNN's Sally Kohn are going to cause violent uprisings against gay people. So he replied in a typical way: by comparing homosexuality and its tolerant teaching to that which might apply to rape or murder.

Listening to this, my mind can all too easily picture Tim Wildmon standing outside The Red Lobster, arms crossed and lips pursed in a "tsk," mumbling his dismay whenever a local male's walk is too effervescent for his liking:
