8 Ohio officers who killed Jayland Walker, a 25-year-old black man, will not be charged

An Ohio grand jury decided on Monday not to indict the eight officers responsible for ending the life of a 25-year-old black man after a traffic stop last year in Akron.

The officers – seven of whom are white – shot Jayland Walker more than 90 times June 27. Authorities say Walker first fired at law enforcement officers from inside his vehicle and then fled on foot. But Walker was unarmed when he was killed. He had been shocked by a Taser and shot or grazed by bullets 46 times.

The officers were put on paid leave after killing Walker.

“Not long ago the grand jury released what is called a non-bill, which means there will be no state criminal action, no level charges. of the state,” Ohio Attorney General Dave Yost said at a press conference Monday. according to ABC News.

Summit County Common Pleas Court Special Grand Jury heard testimony for five days last week and announced its decision not to charge Monday.

“Multiple officers, each making an independent judgment of a threat and acting independently to neutralize that threat, create a dynamic that amplifies the use of force exponentially,” Yost said, according to the New York Times. ‘Having said that, it is essential to remember that Mr Walker had shot the police and he shot first.’

Prior to the grand jury’s announcement, businesses and residents of community were bracing for potential protests in response to the grand jury decision, NBC affiliate WKYC-TV in Cleveland reported.

Dan Horrigan, Mayor of Akron released a statement earlier on Monday, saying leaders were committed to listening to community concerns.

“As we prepare for whatever has to come from the grand jury as it makes decisions in the filming of Jayland Walker, we remain committed to listening to our residents and making room for their voices and concerns while putting everyone’s safety first,” says Horrigan. “Early in this process, I asked our community to be patient with the survey, and now we’re getting closer to some answers. I have overwhelming faith in the Akron community, and I know that we will rely on our partnerships and relationships through the uncertainty of the days ahead.

The Ohio Attorney General’s office declined to provide a statement to HuffPost, relying on a press release.

“This case has taken over a week due to the volume of evidence presented,” Yost said in the press release. “It is important to note that my office’s job in this case was to investigate and present evidence to the grand jury. The grand jury was instructed in the law by the judge overseeing it, not by prosecutors, to avoid any questions about the accuracy of the instruction.

The Attorney General’s office has made the investigation documents available to the public.

Kansas City: Arrest warrant issued for man accused of shooting black teenager in the head | American News

A warrant has been issued for the man accused of shooting a black teenager in the head in Kansas City.

Andrew Lester, 85, is accused of shooting 16-year-old Ralph Yarl, who allegedly went to the wrong house by accident trying to get his younger brothers back last week.

Police said Monday that Lester was initially arrested and his gun seized, then released pending further investigation.

“The vast majority of cases, including violent crimes, involve the release of the suspect, pending further investigation. In this case, the prosecutor asks investigators for more information which would take more than 24 hours to compile,” Police Chief Stacey Graves said.

“We recognize the frustration this can cause throughout the criminal justice process.”

Missouri law allows a person to be detained for up to 24 hours for a criminal investigation. At this point, the person should be released or arrested and formally charged.

Zachary Thompson, an attorney for the victim, said there was a “racial component” to the shooting, but did not elaborate on the possible motives at a press conference, adding that a warrant was issued for Lester’s re-arrest and his current whereabouts were unknown.

Mr Thompson also revealed that Lester had been charged with first degree assault and criminal action with a weapon.

He also said Lester and the 16-year-old didn’t exchange a word before the alleged attack, where the former allegedly used a .32 revolver to shoot Ralph in the head and arm through a glass door.

A GoFundMe page, believed to have been set up by Ralph’s aunt Faith Spoonmore, said the teenager escaped the alleged attack but had to knock on three different houses before someone helped him.

Police earlier said Ralph had a life-threatening injury but was in stable condition.

“I thought he was dead”

Speaking to NBC News, Sky’s US network partner, the man who found Ralph covered in blood said he “thought he was dead”.

“I heard someone shouting, ‘Help, help, I’ve been shot! ‘” James Lynch said, adding that the shouting was out of place in the normally quiet neighborhood.

Mr Lynch added that he heard the screams as he prepared to go to bed, before running towards Ralph jumping over his own fence and checking his pulse when he arrived.

Ralph apparently struggled to answer before he spelled his name.

Another neighbor arrived with towels to help stem the blood flow, and she and Mr. Lynch waited with Ralph until paramedics arrived.

The shooting sparked a protest in Kansas City on Sunday, with hundreds of people gathering outside the house where Ralph was allegedly shot, with chants of “stand up, fight back!”.

Ms Spoonmore went live on Instagram after the protests, where she spoke to a woman who lived near the scene and saw Lester the morning after the alleged attack.

“It was a child that this man tried to murder,” she said.

“He shot him twice. And we not only let him go home hours after the incident, but he was able to wake up the next morning and pretend like nothing had happened.”

The GoFundMe for Ralph has raised over $2 million since its launch, thanks to prestigious donations from actress Julianne Hough, comedian Ellyn Daniels and screenwriter Mara Brock Akil.

Former NBA star Shawn Kemp is charged with 1st-degree assault in a March shooting

Former NBA Seattle SuperSonics star Shawn Kemp was charged with first-degree assault after being arrested in connection with a drive-by shooting in Washington state last month, according to court documents.

An altercation broke out in the parking lot of the Tacoma Mall on March 8 that escalated into shots being fired, the Tacoma Police Department said after the incident. “One car fled,” it stated, and one man was arrested at the scene.

In an interview with police, Kemp said he was shot at first when he confronted someone after tracking his stolen cell phone. No one was hurt in the incident.

Kemp was released from jail and not immediately charged, but on Friday the Superior Court of Washington for Pierce County said Kemp, allegedly armed with a .357-caliber revolver, acted with “intent to inflict great bodily harm, intentionally assault another person with a firearm or deadly weapon or by any force or means likely to produce great bodily harm or death.”

A witness reported seeing a person who matched the description of Kemp throw the revolver in the bushes after the incident, which Kemp admitted to, according to Tacoma police.

According to video surveillance seen by a detective, a silver Toyota 4Runner pulled into the mall’s parking lot, but no one got out of the car. Kemp’s Porsche pulled up a few minutes later and Kemp is allegedly seen getting out of his car, retrieving a black backpack from the vehicle and approaching the 4Runner.

Kemp told police a phone was stolen from his car the day of the incident and he initially tracked it to a silver SUV at the Emerald Queen Casino in Fife, Wash. There, he asked the occupants of the SUV if they had items that belonged to him, though their answer is not specified.

Police later confirmed the 4Runner was stolen and the driver was the same in both incidents.

Kemp then tracked the vehicle to Tacoma Mall, where Kemp said he was shot at after approaching the 4Runner and demanding his property back.

“Kemp was adamant in his interview that he had retreated to his vehicle after he was shot at, and then shot back at the 4Runner,” a detective said. “However, the video clearly showed Kemp getting the revolver out of the backpack as soon as he gets out of his Porsche.”

The police department’s findings do not say Kemp fired the initial shot, but that he “was standing in close proximity to where the live .357 magnum round was recovered and it was the same caliber as the revolver Kemp had used.”

It is unclear at what point the driver of the 4Runner exited the vehicle, but detectives said after Kemp became “very animated,” the person attempted to drive away, but the open driver’s side door got lodged against the vehicle next to it.

Kemp then allegedly walked to the front of the 4Runner and fired a shot in its hood and walked back to his car. At several points, Kemp walked between his car and the 4Runner and eventually reached in the trunk for something, but did not remove anything from it, police said.

Police later found an AR-style pistol in the trunk while executing a search warrant of Kemp’s car, but did not find any magazines or ammunition. They also found five .357 caliber cartridges in Kemp’s jacket pocket, one on the ground and two unused ones in the center console of his car, police said.

The driver of the 4Runner eventually dislodged the vehicle’s door, and Kemp, upon noticing, began walking toward the vehicle with his pistol and a verbal argument ensued. He then allegedly fired another shot at the 4Runner, and its driver exited the vehicle with their hands up and faced Kemp. Kemp walked back to his Porsche and both parties left, police said.

Forensic evidence shows the 4Runner had been shot three times. Kemp later contacted police after thinking he would be identified by his license plate, a detective said.

During their search warrant, police said they also found a cell phone on Kemp’s person. Upon searching the phone, police found that Kemp sent a text message saying he had his phone back and another one saying “I’m about to shoot this mf” 13 minutes before he arrived at the mall, police said.

Under Washington state law, the crime of drive-by shooting applies to anyone who fires a gun either directly from a vehicle or from “the immediate area of a motor vehicle that was used to transport the shooter or the firearm, or both, to the scene of the discharge,” creating “a substantial risk of death or serious physical injury.”

Kemp, famously known as “the Reign Man,” was a six-time NBA All-Star during his career, with most of those appearances coming during his eight-season stint with the Seattle SuperSonics. The franchise moved to Oklahoma City roughly a decade after Seattle traded Kemp to the Cleveland Cavaliers.

Residents near Indiana warehouse fire may have asbestos on their property, EPA says

Federal officials are telling people near the site of an Indiana warehouse fire that broke out last week not to touch any debris they find on their property since it may contain asbestos, a known carcinogen.

“It is essential not to remove or disturb any debris believed to be from the fire as these materials may contain asbestos, a substance that releases microscopic fibers when disturbed,” the Environmental Protection Agency said in a fact sheet for local residents posted on Sunday.

The large industrial blaze at a former plastic recycling plant in Richmond, about 70 miles east of Indianapolis, was quickly contained by firefighters but still prompted an evacuation order for nearby homes and businesses. The site is located near the border with Ohio.

Testing of some debris samples from the fire confirmed the presence of asbestos, the EPA said, and the agency was working with professionals in Indiana and Ohio to remove the hazardous material.

The EPA said it began collecting debris at schools, day cares and city parks on Saturday and that it was also working with state and local officials on a plan to collect debris from nearby homes.

People who suspect that debris from the fire ended up on their property are being encouraged to call the Richmond Community Helpline and also register their information with the EPA.

Asbestos was used in some building insulation materials until the 1980s, and some items that burned in the fire contained the microscopic fibers, the agency said.

“Due to the weightless nature of the substance, these materials were lifted into the air as the smoke rose and fell back to the ground as debris.”

Separately, the EPA said it was continuing to monitor and take samples of the air around the clock and confirmed that on Friday it detected the presence of benzene, which is also harmful to humans, in the evacuation zone.

Richmond Mayor Dave Snow said earlier last week that the owner of the former business on the site, My Way Trading, had been ordered to clean up the property but ignored the order.
