‘Disinfo Board’ on Notice of Criminal Penalties

Last week Alejandro Mayorkas, Secretary of the Department of Homeland Security, announced the formation of a “Disinformation Governance Board” (DGB) that will operate under his agency. The DGB’s missions and policies are unknown, and, given the imprecise nature of a federal entity that “governs” “disinformation,” those missions and policies may never be known.

The question, however, does not center on how the DGB will police “disinformation.” Rather, the question is about constitutionally-protected free speech and the criminal and civil punishments for wrongly depriving someone of speech liberty. The U.S. Supreme Court unmistakably articulated more than a half-century ago exactly what speech is not protected, and it is only that unprotected speech that the DGB would have the power to govern. If those on the DGB exceed that power, under federal law they could be individually criminally liable, and they could be individually civilly liable for monetary damages, as would the United States.

Accordingly, those on the Disinformation Governance Board are hereby put on notice.

Based on the 1969 unanimous U.S. Supreme Court case Brandenburg v. Ohio, the only spoken or written words that are not protected under the First Amendment are those “directed to inciting or producing imminent lawless action and [are] likely to incite or produce such action.” The Court in Brandenburg thereby provided a lucid and relatively easily applied demarcation between protected and unprotected speech.

If The Left Hates Free Speech, It Must Be Good

I’m a free speech absolutist. I’ve heard the same about super-billionaire Elon Musk, the guy many of us hope succeeds in his bid to restore some semblance of free speech and open debate to Twitter. I don’t know what the term ultimately means for Musk inside his heart of hearts (although I can take an optimistic guess based on his statements so far), but I can unequivocally say what it means for me — ANY and ALL legal speech protected by the First Amendment to the U.S. Constitution should be allowed and uncensored on major public platforms.Obviously, this excludes illegal speech like incitement to violence, harassment, direct threats, defamation, child pornography, fraud, and the like. DHS: Worry About ‘Disinfo Board’ Is Due To ‘Misinfo’

It seems the natural state of the left-wing media and Liberal pundits is hysteria. CNN contributor David Zurawik wigged out in a typical post-apocalyptic meltdown over Elon Musk’s purchase of Twitter.
Citing the 1927 Radio Act and the 1934 Communications Act that created the FCC, he noted, “FCC wasn’t great” as reasons why we need to “…control the channels of communication in this country.” More on that incredible segment, with must-see video, later.
This is all rather timely given the recent announcement by the Department of Homeland Security (DHS) of the creation of the Disinformation Governance Board to be overseen by “Disinformation Fellow” (whatever that is) Nina Jankowicz.

Weapons the US has given Ukraine so far

WASHINGTON: Since Russia’s invasion of Ukraine in February, the US Department of Defense has transferred billions of dollars-worth of weapons and equipment to Ukrainian forces, from drones to artillery.
It’s an unprecedented flow of weapons that has shocked outside observers used to the US having to work through a famously slow arms transfer bureaucracy. It has also enabled Ukraine to not only survive the initial Russian push, but actually reclaim territory.
As a result, the Russians appear to have changed their goals, from trying to capture and pacify the whole country to trying to consolidate its control of the Donbas region. Dobbs decision leak an unprecedented breach

For the first time in modern history, a draft decision from the Supreme Court has leaked while a case is still pending. The draft decision in question would overturn Roe v. Wade entirely, and Politico itself, which published the leak, stated that the leaked decision “is bound to intensify the debate over what was already the most controversial case on the docket this term.”
We can safely infer that the leak of a decision for a case still in a highly controversial contest within the court was done specifically to “intensify the debate” outside the court. In other words, someone on the pro-Roe side wants ginned-up outrage outside the court to influence the decision-making inside the court.
Let’s ignore the substance of the alleged decision, written by Justice Samuel Alito. The real controversy is the leak itself, as egregious an attempt to terrorize justices into stealing a court decision as the Jan. 6 riots were an attempt to terrorize congressmen into stealing …

Texas Increases Border Spending By $500M

An additional $495.3 million has been transferred from the state’s general fund to support Texas’ border security efforts through Operation Lone Star.
The funding transfer was approved by Gov. Greg Abbott, Lt. Gov. Dan Patrick, Speaker Dade Phelan, Senate Finance Committee Chair Joan Huffman, and House Appropriations Committee Chair Dr. Greg Bonnen.
It was done in response to requests made by the heads of several state agencies due to a funding lapse between fiscal years 2020–2021 appropriations and fiscal year 2022 appropriations.

The state agencies requesting the funding transfer include the departments of Criminal Justice (TDCJ), Public Safety (DPS), Health and Human Services (HHSC), State Health Services (DSHS), Texas Alcoholic Beverage Commission (TABC), and Juvenile Justice (TJJD).

Nuclear South Korea? Best Option?

Twice in the last week, North Korea has threatened a pre-emptive nuclear strike. We also have growing evidence that Pyongyang will soon test a nuclear weapon for the first time since 2017. North Korean rhetoric is still belligerent, and Pyongyang has clearly indicated that it intends to develop a full-spectrum nuclear program. This is prompting difficult discussions in South Korea. South Korean President-Elect Yoon Seok-yeol has suggested that pre-emptive strikes on North Korean missile sites would be appropriate in a crisis. That would be a huge risk. In 2017, former U.S. President Donald Trump considered this option, and he rejected it. South Korean nuclearization is often criticized as being too risky. Yet even nuclearization would carry less of a risk than airstrikes.
Thinking the unthinkable
The core problem is that North Korea is not going to stop. Its nuclear, missile, and weapons of mass destruction programs have been growing for decades. They will not slow down anytime soon. As the North’s weapons programs mature, the threat they pose to U.S. allies grows. Indeed, North Korean missiles can now reach much of the planet, including the United States and Europe. But countries like Japan and South Korea face the greatest danger.
Ideally, Pyongyang would bargain with Seoul and Washington, brokering some manner of negotiated deal to cap its developments. North Korea probably has enough warheads now to achieve basic deterrence with the U.S. and its allies. If it keeps building and testing, Pyongyang will signal that it has bigger goals for its nukes than mere defense. North Korea has spoken of …

Mayorkas claims new DHS disinformation board will not monitor US citizens

Homeland Security Secretary Alejandro Mayorkas claimed Sunday that his department’s Orwellian “Disinformation Governance Board” will not monitor US citizens — and vouched for the “eminently qualified” agency czar who has been blasted by critics for being too partisan. 

Mayorkas defended Nina Jankowicz amid questions from conservatives over her ability to ferret out disinformation when she doubted the credibility of The Post’s series of reports in October 2020 about Hunter Biden’s laptop — information that has since been confirmed by other newspapers and media outlets. 

Jankowicz was also mocked when a wacky TikTok video surfaced of her singing a rendition of the Mary Poppins tune “Supercalifragilisticexpialidocious” to address the spread of disinformation.

Mayorkas praised Jankowicz on CNN as “eminently qualified” and a “renowned expert in the field of disinformation.”

Asked by host Bret Baier during an appearance on “Fox News Sunday” about Jankowicz’s objectivity, Mayorkas said he had no reservations.
