No, I didn't! I'll have to check it out.

Reads with Scotch Actually they can't "require" you to do that fooz. You can volunteer, but even then there are certain legal "Hoops" they need to jump through. Waivers that would need to be signed.
9-3 is a 6hr shift what is the duration of the others? If you work more then 12 hours in a 24 hour period, and start work in less then 12 hours before your next shift, not only are they pushing the law to the breaking point but they also are required to pay double time, not just time and a half, unless you have signed a wavier capitulating your labor rights.

Tom Foolery (tomfoolery) That's also pretty standard in retail and food service, Nick. North and South Carolina are right to work states, and if you bitch too much about stuff like that you find yourself out of a job. How stuff plays out in places like New York, i dunno...

message 11: by Tom (new)

Tom Foolery (tomfoolery) Huh. And here i thought the average working stiff in New York had a bit more going for him. Sure, they're wrong for pushing so hard. Yeah, maybe it is illegal. You don't wanna do it? Cause i can find a couple dozen people off the street who WILL do it, and in this economy i can probably pay 'em less than i pay you, too. You sure you wanna raise a stink?
So you raise a stink, get fired, have to find a lawyer but the only ones who'll take the case either want huge up front fees or to take it on a class action basis, and five years later you get $1500 as part of the settlement, but don't get your job back...

I used to work at a coffee shop where we were supposed to take our lunch on site in case it got busy and then they could interrupt our lunch to make us come work. Screw that! The managers told us that when we were hired and everybody followed it. They bitched about it, and complained about how it was against the law, but they still complied. I didn't. I left almost every time. The manager never said anything to me. They just banked on people complying, but knew they couldn't really say anything because it's against the law.

Reads with Scotch Not to be offensive or anything but you are going the ACLU route... it may be effective if you have millions of dollars laying around to throw away, but for the working stiff type I suggest contacting DOL. http://www.dol.gov/ The website it's self isn't very helpful, but there is a contact phone number@ the bottom that will get you in contact with a local office where you can talk to an individual. You don't even need a lawyer there are folks on the government titty that go around and slap the shit out of employers all the time. I have had a few come to me before. never been found guilty of anything.

Point being if you are being abused by an employer then say something. Don't wait for the problem to grown until we need a united taco folders union. It would be the end of the 59 cent taco that's for sure. Now if you do cry foul and contact the DOL and your "boss" backs down but fires you, well THEN you go get a labor lawyer and sue. Just filing the paper work should be enough, they will settle out of court to save face, probably with some type of gag order to the affect of: Here is your fucking money, if you talk we take it back.

Reads with Scotch P.S. most workplaces have a poster from DOL with a report abuse number on it. They are there for a reason, use them.

The Crimson Fucker (tcf123) | -6 comments Dude... don't EVER AND I MEAN EVER EVER mess with a gutierrez' money! EVER! I have an accent not mental retardation! I do pay roll here I know my rights... and I'm getting me a nice present nex week =) with the extra money... still thank you for the support y'all!

Reads with Scotch Ok so you know you don't have to, but you want the double time. And that is fine. Just making sure you knew you were not obligated to do it.

Tom Foolery (tomfoolery) Ok, who is this person that just advocated going to the government for help in labor disputes against management, and what has he done with Nick?

Reads with Scotch I am all about people getting a fair shake from the companies they work for. I am against Unions and attempts to write "new" laws that are not needed. The existing laws are more then adequate if people would just use them... I will trust companies to make a buck wherever they can, and I should be able to trust people to look out for their own interest as well. Too often I hear the same drivel about getting fired for speaking up. If you were ever fired for speaking up and didn't walk away owning that company then you did something wrong. The reason why I have been investigate twice is because I encourage my minions to use the DOL whenever they feel abused/misused in any way. So far it has not amounted to anything. But my minions made two complaints and I was visited twice by a government representative. They are out there and they have a very good track record for making employers follow the law without all this legal bumbo-jumbo.
