Delhi HC to set the right note on AR Rahman’s song

The Delhi High Court will soon rule on copyright protection for traditional music after the song, Veera Raja Veera, composed by music director A.R. Rahman for a Tamil movie, Ponniyin Selvan 2, was contested by Ustad Faiyaz Wasifuddin Dagar, a renowned classical singer.

Dagar alleged copyright infringement, asserting that Rahman and other producers of the film replicated the original composition, Shiva Stuti, from the 1970s, composed by his father and uncle.

Dagar contended that despite the different lyrics, the musical structure, rhythm (taal), and beat of the song closely resemble the original Shiva Stuti composition.The case is pending before the court.

Until 1992, copyright laws in India provided protection to original works until the author’s demise, plus 50 years, but subsequently, was extended to 60 years through an ordinance in Parliament, specifically to extend the time of reprint for Rabindranath Tagore’s work.

Music creators and legal experts differ in this case, as artists view traditional music as a universal wellspring of inspiration, while legal experts insist that the works should undergo standard legal tests to establish non-infringement. Music composers contend that both Shiva Stuti and Veera Raja Veera are grounded in the Adana Kandalum Ragam (Raag Adana), which is a part of Carnatic classical music. Ragams or Ragas are musical building blocks based on specific notes. Classical music songs are crafted by applying these ragas in various combinations.

“There is a certain amount of application that goes while presenting a song. In this case, unfortunately, the application of two geniuses—Rehman and Dagar Brothers—has almost been the same. You can never copyright a ragam, or even a chord. It is equivalent of copyrighting words or letters,” said music director Vishal Chandrashekar, who scores music for Tamil and Telugu movies.

According to court filings, Dagar came to know about the song in April, when Veera Raja Veera was released on social media and television. He subsequently raised his concerns about infringement with Madras Talkies and Tips Industries, the producers of the film. However, when the producers refuted his allegations, Dagar moved court.

“In this case, the plaintiff (Dagar) claimed that the disputed song Veera Raja Veera of the film PS-2, is similar to Shiva Stuti based on Raag Adana sung by his late father and uncle in the 1970s,” said Smriti Yadav, partner, Khaitan & Co. “The defendants (Rahman and others) have claimed the disputed song is based on folklore music, available in the public domain since many centuries. It remains to been seen how the court treats the contentions of the parties.”

Under copyright laws, there are standard tests to arrive at a conclusion on whether a work infringes the copyright of some other producer, including test of originality, said legal experts. “Copyright protection includes copyright on musical notes and compositions. Test for protection on musical notes or compositions is originality of a composition,” Swati Sharma, head, intellectual property practice at Cyril Amarchand Mangaldas, said. “Copyright in original composition is valid during the life of the author plus 60 years post her death. Therefore, the musical compositions of old masters such as Beethoven (1770–1827) or Mozart (1756- 1791) are now in public domain and often used commercially.”

Bengaluru news: Students, staff evacuated from several schools after bomb threat. Details here

Several Bengaluru schools received bomb threat emails leading to evacuation of students and staff members. Though the exact number of schools that received the threat emails is not known, however, media reports state that over 15 schools in the tech city received bomb threats. 

As soon as parents got to know about the incident, they rushed to schools in panic to get their children back home safely.

“The email claimed that explosives had been planted on school premises. We received a call from the command centre and immediately rushed our teams to schools which are located in different parts of the city. All students and staff have been safely evacuated from the school premises and a thorough search operation is being carried out,” a senior police officer said as quoted by news agency PTI. So far, nothing suspicious has been found yet and prima facie looks like it’s a hoax message. Parents need not panic, our teams are on the ground, he said.

Bengaluru police commissioner has informed that numerous anti-sabotage teams have been sent to scan the school premises. He further added the bomb threat messages sent to several city schools seem to indicate fake calls, however, every effort will be made to identify the sender of the email.

In a tweet, the Police commissioner wrote, “Some schools in the city were sent ‘bomb threat’ calls via email early today. Our bomb detection team is rushing to investigate this. From the checks so far, these appear to be false calls. However, all steps will be taken to trace the person who sent the email.”

As per the India Today report, schools including Napel, Vidyashilpa in Basaveshwar Nagar and one opposite to Deputy CM’s residence were among the schools that were sent bomb threat emails.

Deputy Karnataka CM DK Shivakumar visited a school in Bengaluru after several schools received threatening e-mails. 

“I was a bit dismayed after seeing the news on TV, as some schools I know and the one near my house were also mentioned. So I went out to check. The police have shown me the mail. Prima facie, it appears to be fake (hoax). I spoke to the police… But we should be cautious. Parents are a bit worried, no need to worry. Police are looking into it,” he said.

The deputy CM also appealed to parents not to worry and said their children would be safe. “Some mischief mongers might have done this, in 24 hours we will nab them. Cyber crime police are active, they are doing their job… We should also be cautious and should not neglect,” he added.

Later in a tweet on on X, he shared an update saying, “In the wake of receiving bomb threats through e-mails to some schools in Bangalore, Sadashiva Nagar NEV School has been visited and inspected. In this case, the police officials have informed about the incident and instructed to conduct a proper investigation.”

Karnataka Home Minister Dr G Parameshwara said, “At present, we have received information about 15 schools where threatening e-mails have been received, last year also such threats were received. We cannot take any risk, we are inspecting the schools and are taking all precautionary measures in schools. We will take strict action against those who are making threatening calls. We are looking into all aspects…”

Pakistan beats India by 10 votes to secure Vice Chair post at UNESCO

Pakistan, on November 24, beat India in an election at the United Nations Educational, Scientific and Cultural Organization (UNESCO) executive board for the position of vice chair last week.

“Pakistan has been elected, with overwhelming support, as Vice Chair of UNESCO Executive Board (term 2023-25) from the Asia Pacific Group at the ExB Session. Grateful to all members for their trust and support. Is deeply committed to cooperative multilateralism and looks forward to working together with all members to promote our common objectives and to defend shared values and UNESCO principles,” said Pakistan’s foreign ministry in a post on social media platform X.

Islamabad’s candidate received 38 votes, while India’s received 18, according to various Pakistani media reports.

Indian diplomats at the UN are facing a major setback after Pakistan was elected vice chair of UNESCO’s Executive Board in 2023-2025, according to a report by the Indian Express.

The Ministry of External Affairs and Human Resource Development, the ministry responsible for managing Unesco in the Indian government and appointing the Indian representative in Paris were reviewing factors and the ramifications of the defeat, according to a source shared by Indian Express.

India’s representative at UNESCO, Vishal Sharma, a political appointee, was questioned about the rationale for India’s dismal performance. Unesco’s executive board held its 218th session last Friday in Paris, during which elections were conducted, the report further added.

With 58 member states and a four-year term, the UN Executive Board administers the body and appoints its director-general. Along with the 194-member General Conference and the Secretariat, it is one of UNESCO’s three constitutional organs.

What is the role of Vice-Chairpersons?

There are six Vice-Chairpersons from each electoral group. In the absence of the Chairperson during a session, their functions are exercised in turn by the Vice-Chairpersons.

Generally, a Chairperson is responsible for directing the discussions, ensuring the observance of Rules of Procedure and accords to the right to speak, among other responsibilities.

Anduril unveils Roadrunner, “a fighter jet weapon that lands like a Falcon 9”

Leading defense tech startup Anduril has developed a new product designed to take-on the proliferation of low-cost, high-powered aerial threats.

The product is called Roadrunner, a modular, twin-jet powered autonomous vertical take-off and landing (VTOL) air vehicle that’s designed for low costs. Anduril has also developed a variant called Roadrunner-Munition, or Roadrunner-M, a “high-explosive interceptor,” meaning it can carry a warhead and also defensively destroy aerial threats.

Roadrunner is unusual both in appearance and capability: it can take-off, following, and destroying targets; if there is no need to intercept the target, the vehicle can autonomously maneuver back to base for refueling and reuse. As Anduril’s chief strategy officer Chris Brose put it in a recent interview, “We’ve basically built a fighter jet weapon that lands like a Falcon 9.”

The product was built in response to the rise of fast-moving, autonomous aerial weapons that can be produced at a high volume and very low cost, a new kind of threat, Brose said. Unlike other solutions today, and the legacy missile systems that preceded them, the Roadrunner-M can also be reused.

“To my mind, this is the first recoverable weapon that has ever been fielded,” Brose said. “That is a pretty cool thing. The ability to deploy […] recover it and reuse it if you don’t actually employ it in an operation to kill another drone, completely changes how operators can fight with this capability. Today, they have a limited number of interceptors and if they decide to hit go, they are not getting it back.”

There are a handful of other major improvements versus legacy systems, Anduril says: faster launch and take-off time, three times greater warhead payload capacity, ten times effective range, and three times greater maneuverability in G-forces. Like the rest of Anduril’s family of systems, Roadrunner-M can be controlled by Lattice, Andruil’s AI-powered command and control software, or integrated into existing architectures.

The other big benefit is to the operator: when faced with a fast-moving threat, Roadrunner can launch immediately, image it, and then receive a signal whether or not to engage. Because the product is reusable and recoverable, operators can act without the fear that they could lose an expensive asset.

Brose said the company’s been working in lock-step with an unnamed U.S. government partner since it started designing Roadrunner around two years ago.

“[National defense] often rightly gets the stereotype for just being very stodgy, very slow, very unimaginative, very unexciting,” Brose said. “I think as a company Anduril is the antithesis of that and Roadrunner is the embodiment of the kind of excitement that we believe exists in national defense and we’re very eager to try to bring back.”

Finance Commission mandate based on suggestions from states: Finance secretary TV Somanathan

New Delhi: The union government kept the terms of reference of the 16th Finance Commission short and direct, and gave the Constitutional body the complete freedom decide on devolution of funds based on suggestions from states, finance secretary TV Somanathan said on Thursday. Somanathan added that the government held extensive consultations with the states and was sensitive to their suggestions.

Responding to a question on why expenditure reforms at the state level to improve their financial health were not mentioned in the terms of reference, Somanathan explained that some states had urged the union government to not include any additional terms that they feared could impinge on their fiscal autonomy. 

“I am sure that the commission will take into account all relevant considerations and will reach an appropriate conclusion. The central government is very sensitive to cooperative federalism and take states’ views very seriously,” Somanathan said.

He added that the terms of reference released on Thursday were final, although shorter than those of many recent Finance Commissions. One could argue that less is more, and that the terms actually give the commission more leeway to take inputs and recommend an award that is within the Constitutional framework, the finance secretary explained.

In response to another question, he indicated that the appointment of a chairperson and members of the commission was imminent. He added that to his knowledge, there was no legal bar on someone being a member of two different commissions.

On a question about the government’s fiscal deficit, he said nothing has happened so far to change the assumption that the government will end the year with a fiscal deficit of approximately 5.9% of GDP. “We will adhere to fiscal targets,” Somanathan said, adding that the recent extension of the free food-grain programme won’t throw the government off its projected path.

Gurpatwant Pannun assassination: US in direct talks with India on alleged plan to kill Khalistani leader, says Blinken

US Secretary of State Antony Blinken has commented on the indictment of an Indian national, allegedly involved in a plot to assassinate a US-based Khalistani leader Gurpatwant Singh Pannun. Blinken, speaking in Tel Aviv, described the matter as a significant ongoing legal case.

The US Justice Department’s indictment points to a murder-for-hire scheme targeting Pannun, a leader of the Khalistan Movement. Blinken remarked that the US had raised this issue with the Indian government over the past weeks. 

“This is something we take very seriously. A number of us have raised this directly with the Indian Government in the past weeks. The government announced today that it was conducting an investigation, and that’s good and appropriate, and we look forward to seeing the results,” ANI quoted Blinken as saying.

This indictment alleges that an unnamed Indian government employee referred to as CC-1, collaborated with others, including the accused Nikhil Gupta, in this assassination attempt. Gupta, apprehended and now under custody, faces a murder-for-hire charge with a potential ten-year prison sentence. Czech authorities arrested Gupta on June 30 under the bilateral extradition treaty between the US and the Czech Republic.

The alleged assassination plan

The indictment details that earlier in 2023, the Indian government employee allegedly directed a plot from India to assassinate the separatist leader, a US citizen of Indian origin residing in New York City. 

Gupta, under the guidance of CC-1, allegedly contacted someone he believed to be a criminal associate. However, this individual was a confidential source working with the Drug Enforcement Administration (DEA). The source introduced Gupta to a supposed hitman, an undercover DEA officer. The Justice Department claims Gupta offered $100,000 for the assassination.

Major focus on methane reduction at COP28, says John Kerry

Dubai: Nations will come together to advance the global climate response and stem the crisis through strengthened action at the UN Climate Change Conference 2023 or COP28, which starts today, said the United States Special Presidential Envoy for Climate John Kerry. “This year we’ll be adding a very important contribution with respect to methane, which will involve both oil and gas companies as well as countries,” Kerry said at a virtual press briefing on Wednesday.

“We’re going to be working to advance the global response to the climate crisis through strengthened national action to achieve both domestic and Paris Agreement goals, and we’ll be doing that through several efforts that we initiated in Glasgow,” he added.

“We will include all greenhouse gases within the future reduction plans of each country. We have a common approach to the first global stocktake under the Paris Agreement. So, there is cause for more collaboration here in the next few days, and most importantly, without China and the United States aggressively moving forward to reduce emissions, we won’t win this battle. We need to step up and help get the job done at a quicker pace.”

Methane is responsible for 50% of global warming and is more destructive than CO2. Within the first 20 years of its release it is 80 to 100 times more destructive, and later on about 20 times more destructive. “We think it’s the easiest, quickest and cheapest way to start making gains against global warming. There will be a major focus on methane [reduction],” Kerry said.

Other than reducing methane emissions, the US will also work with China on deploying renewable energy to force greater reductions in emissions. “We will continue these discussions in the next few days here in Dubai, and we intend to work hard to see if there’s further collaboration that could advance the cause for all of us. China is one of the largest emitters in the world, and we’re number two. We’re both very conscious of the fact that our citizens want cleaner air and healthier lives… they want us to have a safer world in which energy isn’t weaponized. So, we have reasons to try to work together and continue to make the COP a success here,” he said.

The US will focus on shipping through the Green Shipping Challenge and deforestation through the forest carbon leaders’ partnership, which Kerry will co-chair with the foreign minister from Ghana.

The US is also focusing on strengthening resilience against the effects of the climate crisis through the President’s Emergency Plan for Adaptation and Resilience, the PREPARE program, a multibillion-dollar initiative to help the most vulnerable nations around the world, especially in Africa.

The loss and damage fund is expected to be constructed in a way that serves the needs of the developing world, and the significant measures are being taken to address the needs of Africa, Kerry added.

He said the US will also work to increase support for the all-in global finance mobilization effort, and that finance will have a very prominent role at this COP summit because of changes the US has been able to make at the World Bank and new initiatives to accelerate the transition to clean energy.

Regarding energy transition, Kerry said, “We focus on three things: one, supporting a country’s specific ambition to de-carbonize its energy sector and helping them create new policy environments that can remove market distortions and facilitate more renewable energy investments. Two, the partnership aggregates significant sums of development finance and philanthropic resources to help catalyze private sector finance, which will support those countries’ climate goals. There are trillions of dollars sitting on the sidelines in various parts of the world… and what we need to do is try to create an availability of bankable deals. Hopefully, COP28 will produce a pretty healthy menu of possibilities on the finance front.”

Kate Middleton can’t trust Prince Harry-Meghan Markle anymore, new book says

Kate Middleton appears to have distanced herself from Meghan Markle, the Duchess of Sussex. This development emerges from Omid Scobie’s recently-published book “Endgame: Inside the Royal Family and the Monarchy’s Fight for Survival.”

The book, drawing on insider sources, reveals that the Princess of Wales was never particularly supportive of Meghan. Her reservations date back to the initial stages of Meghan’s entry into the Royal Family. These feelings have seemingly intensified since Prince Harry and Meghan stepped back from their senior Royal duties and moved to California in 2020.

Kate’s marriage to Prince William in 2011 marked her entry into the Royal Family, where she formed a close bond with Prince Harry. However, this relationship has altered over time, particularly in light of recent events and public interviews given by the Sussexes. 

Sources close to Kate express her fond memories of past times with Harry but also highlight a lack of trust towards the couple now. Kate apparently can’t trust Harry-Meghan anymore, especially after the couple’s interviews, one Royal Family insider told Scobie, as per E! News.

In the wake of Harry and Meghan’s candid interview with Oprah, where they discussed issues of racism within the Royal Family, Prince William publicly stated, “We are very much not a racist family.” He also said that he would speak to Harry about the Oprah interview.

However, William and Kate never addressed these issues directly with Harry and Meghan. This silence has reportedly led to confusion and further strain within the family, the publication added.

Omid Scobie’s ‘Endgame’

Omid Scobie’s “Endgame” is making a lot of noise at the moment. As per reports, the revelations in the book have also shaken up the Royal Family. The book has also revealed how Prince William had concerns about the pace of the Harry-Meghan relationship. William apparently had a problem with “opinionated” Meghan, the book says.

‘Indians are b*stards’: When Henry Kissinger passed racist comments against India, abused Indira Gandhi

Former Secretary of State Henry Kissinger, who died on November 29, at age 100, greatly influenced global affairs under Presidents Richard Nixon and Gerald Ford between 1969 and 1977, garnering both vilification and the Nobel Peace Prize. However, there were many incidents which reflected his hatred towards India.

Kissinger was born May 27, 1923, in Fürth, Germany, and fled Nazi Germany with his family in 1938. As a Harvard University student, Kissinger excelled academically and quickly climbed up the ladder of the US political establishment. During his tenure as National Security Adviser and Secretary of State, he played a prominent role in US foreign policy.

During the Cold War, Pakistan was a vital ally of the United States because of its strategic location and counterbalance to India, which had aligned itself with the Soviet Union. Nixon’s NSA at the time, Henry Kissinger, also wanted to use Pakistan for diplomatic openings to China as part of his broader strategy to combat Soviet influence.

Nixon and Kissinger had a vested interest in supporting Pakistan, an American ally that was covertly helping to bring about their historic opening to China. Throughout Pakistan’s atrocities, their biases and emotions contributed to their excessive support for its murderous dictatorship.

Calling Indians ‘scavengers’

In an NYT article By Gary J. Bass, a professor of politics and international affairs, wrote, that as millions of traumatised Bengali refugees fled the Pakistan army, Kissinger was indignant at the Indians on June 3, 1971. According to Kissinger, the Indians were responsible for the refugee flow by sponsoring the Bengali insurgency covertly. Kissinger then condemned Indians as a whole, his voice oozing with contempt, “They are a scavenging people.”

On Indira Gandhi

According to a taped conversation, Nixon cited a meeting with then-Indian Prime Minister Indira Gandhi the previous day.

“We really slobbered over the old witch,” he told Kissinger, as quoted in a report by The Guardian.

“While she was a b*tch, we got what we wanted too,” Kissinger replied, as quoted in the report. “She will not be able to go home and say that the United States didn’t give her a warm reception and therefore in despair she’s got to go to war.”

“The Indians are b*stards anyway,” he added. “They are the most aggressive goddamn people around,” as quoted in the Guardian report.
