SAT quashes Sebi order against Mukesh Ambani, Navi Mumbai SEZ
MUMBAI : The Securities Appellate Tribunal has quashed the market regulator’s 2021 order against Reliance Industries Ltd managing director Mukesh Ambani, Navi Mumbai SEZ, and Mumbai SEZ in a case related to alleged manipulative trades in Reliance Petroleum Ltd shares.
In January 2021, the Securities and Exchange Board of India imposed a penalty of Rs25 crore on Reliance Industries and Rs15 crore on Ambani. It had also asked Navi Mumbai SEZ to pay a penalty of Rs20 crore. Ambani along with RIL and other entities challenged the order before SAT.
On Monday, a bench led by Justice Tarun Agarwala held that “Sebi’s 2021 order is quashed. In case the penalty has been deposited with respondents (Sebi) it must be returned to the appellants”.
A detailed order is awaited.
The case pertains to the sale and purchase of RPL shares in the cash and futures segments in November 2007. Subsequently, Reliance decided to sell nearly 5% stake in RPL, a listed subsidiary that was later merged with RIL in 2009.
Sebi adjudicating officer BJ Dilip had held that any manipulation in the volume or price of securities always eroded investor confidence in the market.
“In the instant case, the general investors were not aware that the entity behind the above F&O segment transactions was RIL. The execution of the… fraudulent trades affected the price of the RPL securities in both cash and F&O segments and harmed the interests of other investors,” he said in his order.
Sebi, in its order, had also stated that RIL had engaged in a scheme of manipulative trading in respect of the sale of RIL’s 5% stake in RPL. It had said that RIL, before undertaking sale transactions in the cash segment, had booked large short positions in RPL November futures through 12 agents with whom it had entered into an agreement to circumvent position limits for a commission payment.
Resultantly, RIL fraudulently cornered nearly 93% of open interest in RPL November Futures, when the agents took short positions in the F&O segment on its behalf, Sebi had said in its order. The funding for the margin payments by the agents was provided by Navi Mumbai SEZ and Mumbai SEZ, it had said.
Further, Sebi added that a common person connected with RIL had placed orders in the cash segment on behalf of RIL and in the F&O segment on behalf of the agents.
On the date of the settlement of RPL November Futures—November 29, 2007—RIL sold 19.5 million RPL shares on the NSE cash segment in the last 10 minutes of trading, resulting in a fall in the prices on the cash segment and artificially depressing the settlement price of RPL November Futures, Sebi had said in its order.
This resulted in profits on the huge short positions held by the agents in the RPL November Futures, and the profits were transferred back to RIL by the agents, the regulator had said in its order.

Participants at the United Nations’ COP28 climate talks on Sunday were greeted by a rare sight in the United Arab Emirates — public protests.
From the largest demonstration seen in the UAE since the start of the Israel-Hamas war to environmental issues, activists allowed into the UAE can protest under strict guidelines in the ‘Blue Zone’ of the summit. Human rights researchers from organizations long banned by the country have been let in—though many acknowledge they may not be allowed back in the country.
“One of our major issues with COP28 is the fact that the UAE government is using this to burnish its image internationally and the fact that limited protests are allowed … is a good thing,” said Joey Shea, on her first trip to the UAE as a researcher at Human Rights Watch. “But at the end of the day, it helps to create this very false image that the UAE does have respect for rights when in fact it does not.”
The UAE bans political parties and labor unions, and laws restrict free speech. About 10% of the total population of more than 9.2 million people is Emirati. The rest are expatriates, many of them low-paid labourers seeking to send money back home to their families. Many avoid saying anything about working conditions, human rights and environmental issues as they see their livelihoods at risk. However, the UN and the UAE agreed before COP28 that free expression would be allowed.
On Sunday afternoon, over 100 people gathered as part of a solidarity protests on behalf of the Palestinians, only a short distance from Israel’s pavilion at Dubai’s Expo City. The same number of onlookers and journalists watched as they chanted, read names of the dead and held their fists up to the sky. However, unlike some other COP summits, there haven’t been marches of tens of thousands of people outside the venue.
Babawale Obayanju, an activist with the Global Campaign to Demand Climate Justice from Benin City, Nigeria, taking part in Sunday’s protests, told the AP that it was important to highlight the killing of civilians in the Gaza Strip as “it’s time for the world to take action” on that and the environment. “Every opportunity we have, every arena of this struggle is one that we must embrace,” Obayaju said. “And the COP is in that arena of struggle.”

“In view of heavy rain in Chennai and the water crossing the danger level in Bridge No. 14 between Basin Bridge and Vyasarpady stations, the trains have been regulated as given below. “Two died and one was critically injured in the incident,” they added. Further investigation into the matter is underway.

In order to prevent any loss of life or property, the district administration restricted the movement of all persons on the coastal areas near the sea-shore has been prohibited from 7 p.m. on December 3 until 6 p.m. on December 5.
A circular issued by the District Magistrate of Puducherry stated, “The movements of all persons on the coastal areas close to the sea shore of Puducherry, shall be prohibited from 19:00 hours on 3/12/2023 to 6:00 hours on 5/12/2023”
“Any person violating this order shall be liable to be punished with imprisonment for a term which may extend to six months, or with fine or both”, the official notice stated.

Book extract: How to stay relevant in the new world of work
As the nature of work is evolving, so are the career archetypes. Career 1.0 and Career 2.0 are giving way to Career 3.0. Career 1.0 can be described as a tunnel with three stages: learn, earn and retire. Career 2.0 is like a fork in the road, with side gigs carried out after office hours in stealth mode. Once the side hustle starts generating funds, it leaves open the possibility of becoming the main career path.
To visualize Career 3.0, think of it as a pizza in which each slice is a skill. The skill can be based on your deep domain knowledge, your emotional intelligence, creative thinking etc. The key to success in Career 3.0 is to develop a range of skills and keep creating combinations of the skills that are valued in the marketplace. Another way to think of the pizza is look at those slices as the percentage of time spent on each distinct activity.
Authors Ravin Jesuthasan and John W. Boudreau describe the coming few years as a time when organizations will have to rethink the operating system around work and workers. Automation and AI will augment the work of the employees. In their book Work Without Jobs, they describe a future where workers will advance their careers through their skills and capabilities—not through seniority.
By 2025, eighty-five million jobs may be displaced by a shift in the division of labour between humans and machines. At the same time, ninety-seven million new roles will emerge that need humans, machines, and algorithms to work in tandem.
Some skills are common to everyone in the workplace. We stop mentioning them in our CVs. They get labelled as commodity skills. Commodity skills are those which many people possess but they do not get monetized. Some of us may recall that people used to list ‘proficiency in Word, Excel and PowerPoint’ on their CVs. Today, it is not a differentiator in the marketplace. Mentioning these skills on your CV does not get you noticed by any recruiter because these are now commoditized. Not having this skill is a disadvantage but having the skill is not a differentiator in the job market.
Six Skills for Career 3.0 that everyone needs to build—even if you are employedSkill No. 1: The ability to build expertise—depth and breadthCal Newport, author of the book So Good They Can’t Ignore You, says that becoming a grandmaster at your work requires years of practice and development of your skills. The greatest experts rarely achieve success solely on the strength of their talent or intelligence. Musicians, doctors and even writers must practise a long time before they can succeed. In the case of doctors, they learn the theory, then observe experienced doctors as they diagnose patients, check the diagnostic tests and discuss the findings with other peers across disciplines. Variations of this process take place in other disciplines.
Expertise is built through repetition and focus. Indian classical musicians practise the nuances of music by singing just a few notes for hours or even days and weeks until their guru gives them a nod of approval.
A musician friend told me that she first learnt Raga Malhar that is said to bring rains and is traditionally played before or during the monsoons. The day she started her lessons, it was raining, and the guru said that he would teach her the Raga Malhar because she would find it easy to remember the association. Over the next two years, she learned many variations of Raga Malhar like Gaud Malhar, Ramadasi Malhar, Miyan ki Malhar, Megh Malhar, Dhulia Malhar and Sawani Malhar. With each variation, she built her expertise so she could learn many other ragas. To the untrained listener, they all sound the same. It takes a lot of skill to differentiate between them.
Here are ten ways to build your expertise:1. Break it down. Break the project down into small, achievable steps and set specific goals that you can work towards, one step at a time. It is easier to master one single line of a song than the entire opera. The key strategy is deliberate practice, which involves setting specific, measurable and challenging goals, and then focusing on practising the skills needed to achieve those goals with feedback and reflection.
2. Create an email account for learning. Look for opportunities to learn from a variety of sources, including books, articles, lectures, courses, and practical experience. Create a new email account and use it to sign up on YouTube, Twitter, Spotify etc. The algorithms will push out content on that topic. You can then consume multiple perspectives of the same topic.
3. Practise regularly. The more you practise, the better you will become. Find ways to apply what you are learning in real-world situations, whether through internships, projects, or just working on personal projects.
4. Collaborate with others. Work with others who have expertise in different areas, as this can help you learn from their perspectives and experiences. For example, if you are a computer scientist, consider collaborating with a psychologist on a project that combines your respective areas of expertise.
5. Seek out mentors. Find people who are experts in your field and ask them for guidance and advice. They can provide valuable insights and help you avoid pitfalls along the way.
6. Attend conferences and workshops. Conferences and workshops can be great opportunities to learn from experts in your field, network with others, and stay up to date on the latest research and developments.
7. Leverage video and audio. Make a habit of reading papers, articles and blogs in your field to stay up to date on the latest research and developments. Listening to podcasts and watching videos made by experts can help build powerful learning habits.
8. Seek feedback. Ask an expert to give you feedback on what you need to do to get better. Track your progress. Reflect on your mistakes and think about what you can learn from them. Tracking the timing of each lap is a great way to know how much you are improving.
9. Take on challenges. Seek out challenges and stretch yourself to learn new things. This can help you grow and develop your expertise.
10. Teach others. When you teach, you receive feedback and questions from your students that can challenge your own understanding. This can help you to identify areas where you may have gaps in your knowledge. Plugging those gaps will keep deepening your expertise.

IAF aircraft crashes in Telangana today, 2 pilots dead
A Pilatus PC 7 Mk II aircraft met with an accident on Monday morning during a routine training sortie from AFA, Hyderabad, the Indian Air Force said in a tweet on the X platform. “It is with deep regret that the IAF confirms both pilots onboard the aircraft sustained fatal injuries. No damage to any civil life or property has been reported,” IAF said.
The IAF said that a Court of Inquiry has been ordered to ascertain the cause of the accident.
IAF’s aircraft crash incidences seem to have increased in the recent past. In June this year, IAF’s Kiran trainer aircraft crashed in an open field in Karnataka’s Chamrajnagar but the pilot sustained minor injuries.
In May an Indian Air Force MiG-21 fighter aircraft crashed near Hanumangarh in Rajasthan.
In March, an aircraft crashed with two trainee pilots on board, in the Balaghat district of Madhya Pradesh. The crash led to the death of a man.

‘When there is good governance, anti-incumbency becomes irrelevant,’ PM Modi speaks ahead of Winter Session
Ahead of the Winter Session of the Parliament, Prime Minister Narendra Modi spoke on BJP’s victory in the three states in the recently held election. PM Modi said, “The Assembly election results (in Madhya Pradesh, Rajasthan, and Chhattisgarh) are enthusiastic for those who are committed to working for the people”.
Taking a jibe at the opposition, especially the Congress party, PM Modi said if they have an optimistic approach in life, they will also be able to win in the election. He appealed to the Opposition parties not to follow an aggressive approach during Parliament sessions because of the defeat and instead conduct a healthy debate in a bid to take the country forward. “I have been urging for your (Opposition) cooperation in the House. Today, I also speak politically – it is beneficial for you too if you give a message of positivity to the country. It is not right for democracy if your image becomes that of hatred and negativity. Opposition is equally important for democracy, it should be equally capable,” Prime Minister Modi said on Monday.
The Winter Session of the Parliament begins today, a day after results for Assembly elections in four states were declared.
The Ethics Committee, which probed the ‘cash-for-query’ allegations against Trinamool Congress MP Mahua Moitra is scheduled to lay its report in Lok Sabha on the first day of the Winter Session of Parliament today.
This means the opening day itself could witness stormy scenes and a clash between the Treasury and opposition benches.
The listed agenda of Lok Sabha for December 4 mentions that Ethics Committee chairperson Vinod Kumar Sonkar and member of the Committee Aparjita Sarangi will be laying “on the Table the First Report (Hindi and English versions) of the Committee on Ethics”.
The government held an all-party meeting on Saturday for the smooth functioning of the session, which will have 15 sittings between December 4 and December 22.
The government has 21 Bills on its agenda for the session, including the bills to replace the IPC, the Indian Evidence Act and the CrPC.

US Presidential candidate Vivek Ramaswamy says no to Central Bank Digital Currencies, here’s why
US Republican presidential candidate Vivek Ramaswamy, in a recent X post, expressed his strong views on Central Bank Digital Currencies (CBDCs), adding that it opens a clear path to social credit scoring.
“I have a one-word answer to central bank digital currencies: NO. Central bank digital currencies open a clear path to social credit scoring. No surprise that the CCP is leading the way,” Ramaswamy said in his X post.
Furthermore, he added his take on stabilizing the dollar. “January 2025, it would be kibosh in the Fed now programme. While we’re at it, we’re talking about a 90% headcount reduction of the US Fed Reserve. Peg the dollar to command gold, nickel and agricultural commodities. CBDC, we’re done with it. Don’t copy China. We’re different for a reason,” he added.
The presidential candidate has lately been vocal about his plans on stabilising the US Dollar by proposing linking the currency to a diversified basket of commodities, suggesting that Bitcoin might be included in this mix in the “foreseeable future.” Simultaneously, he expressed opposition to the creation of a Central Bank Digital Currency (CBDC) in the United States.
Ramaswamy expressed his intention to reposition the U.S. Federal Reserve, advocating for a substantial reduction of its workforce by 90%. His vision emphasizes a more streamlined mandate, with the primary focus on stabilizing the value of the dollar.
He noted that “it could be reasonable” to include Bitcoin in such a basket once the asset has been broadly accepted and its volatility is more in line with the larger basket of commodities.
The candidate subsequently articulated the perspective that the value of the dollar should be linked to tangible assets, potentially encompassing cryptocurrencies among them.
In a recent podcast, he said that the allure of the dollar as a global reserve currency is heightened when it avoids emulating China’s digital yuan, which empowers the government to penalize dissenters.
Emphasizing his commitment, he stated his intent to terminate the FedNow instant payments program, asserting that it is establishing the foundation for the eventual implementation of a central bank digital currency.

Election updates: Chouhan dominates in Budhni, Pilot-Gehlot ahead with 50% votes
The Bharatiya Janata Party (BJP) was ahead of rival Congress in three of the four states for which the counting of votes began on Sunday morning. According to the latest trends from the Election Commission of India, the BJP was comfortably ahead of the Congress in Madhya Pradesh and Rajasthan. In Chhattisgarh, where the Congress won a clear majority in the 2018 elections, the saffron party was ahead on more than 50 seats in the 90-seat assembly. In Telangana, the Congress looked set to trounce the Bharat Rashtra Samithi.
In Madhya Pradesh, chief minister Shivraj Singh Chouhan was comfortably leading from the Budhni constituency. The BJP leader received more than three-quarters of the votes as of 11.30 am. In Rajasthan, senior Congress leaders Sachin Pilot and Ashok Gehlot were leading in their respective seats by polling more than 50% votes each. BJP leader and former chief minister Vasundhara Raje was ahead in the Jhalrapatan seat by polling over 60% of the votes.

In Chhattisgarh’s Patan constituency, BJP’s Vijay Baghel and Congress’ Bhupesh Bhagel were neck and neck with 48.7% and 46.5% of the votes as of 11.30 am. In Ambikapur, Congress’ TS Singh Deo was leading with 46% of the total votes. In Telangana, chief minister K. Chandrashekar Rao, who is contesting from two assembly seats, was leading on one seat, Gajwel, and trailing on the other, Kamareddy.

Bhopal Gas Tragedy: MP CM pays tribute to victims on 39th anniversary, says ‘Get nightmares when..’
Bhopal Gas Tragedy anniversary: To observe the 39th anniversary of world’s worst industrial disaster, Madhya Pradesh Chief Minister Shivraj Singh Chouhan paid tribute to the victims of the accident on Sunday.
While paying tribute, MP CM refused to comment on the ongoing election results trend. During the early trend, his party has reached a majority mark in the state as per the Election Commission of India.
“This is not the time to speak on these things (election results),” CM Chouhan said, as the party is set to retain the government in the state.
While recalling the horrifying scene that followed after the leakage of methyl isocyanate (MIC) in Bhopal, MP CM said, “When we remember the accident on the night of 2-3 December, we get nightmares.”
The Bhopal Gas Tragedy is considered as the world’s worst industrial disaster in history. The gas leak in the Union Carbide factory claimed the lives of several thousand people on the intervening night of December 2 and 3, 1984.
The tragedy unfolded in Bhopal, Madhya Pradesh, after the highly dangerous and toxic gas, methyl isocyanate (MIC), escaped from Union Carbide India Limited (UCIL) and resulted in the death of 5,295 human beings, injuries to almost 5,68,292 persons besides loss of livestock.
‘Companies like GAIL, ONGC, IOC continue to do work with Union Carbide,’ says activistRemembering the horrifying incident, people conducted a candle march in Bhopal on Saturday. The women attending the march carried placards seeking compensation, health care, and justice. The candle march started from Sidhi Colony and ended at the memorial for victims close to the factory in Bhopal.
Rachna Dhingra of Bhopal Group for Information and Action demanded strict action against corporations who continued to do business with Union Carbide after the tragedy.
“Gas Authority India Limited (GAIL), ONGC, Indian Oil Corporation, Gujarat Alkalies Chlorides Limited, and others continued to do business with Union Carbide while it was absconding,” alleges Dhingra.
“We want Dow Chemical, which has taken over Union Carbide, to be made part of the case. The waste lying inside the factory should be removed as it is seeping and contaminating underground water. The densely populated colonies near the factory are using contaminated underground water,” Balkrishna Namdev of Bhopal Gas Peedit Nirashrit Pensionbhogi Sangarsh Morcha told PTI.
Decades after the accident when a large chunk of compensation has been already released for the victims by the state government, survivors of the tragedy continue to protest for the prosecution of the main culprit of the accident.
