So is a tomato, although Congress (although recognizing it botanically as a fruit) declared it commercially to be a vegetable some time in the 1930s or 'round thereabouts, because it is prepared and consumed as a vegetable, as opposed use in desserts or other sweet recipes that more commonly use fruits.
