Why I cannot publish Nightingale

On Saturday morning,  received a notice that Riptide Publishing would file legal action against me if I do go ahead with the publication of Nightingale.

Legally, that's their right - they still hold the contract to the book. A contract that contains no clause that forces them to publish the book at all. (The rights don't reverse upon "failure to publish", in other words, if Riptide decides to not publish the book, there's basically nothing I can do.)

Now, the self-publishing of Nightingale wasn't a surprise to Riptide. I informed Riptide of my schedule, even who's doing the proofing, and that everything was above board can be seen in the fact that they gave me the un-watermarked cover image. (For which I was supposed to pay out of my royalties.)

The background to this is that I've wanted to leave the "partnership" for more than a year (for many, many reasons, but the most important is that I want to focus on coaching and I see a conflict of interest between the function of publishing and coaching/advising authors), and another is that I prefer to consider writing a hobby, a minor part of my life - it allows me to write whatever I want, publish it whenever I want, and only do as much "marketing" as I feel comfortable with. And, of course, hire editors I trust and know. Basically move away from wanting to earn money back to being an amateur who writes what he damn well pleases and published under those same terms.

Now, Riptide has sent me an agreement to leave the "partnership" that was so incredibly lopsided (all advantages go to Riptide, none to me that I'm not legally entitled to anyway) that I find it impossible to sign.

And to put on the thumbscrews - which is what it feels like - Riptide is holding my book "Nightingale" hostage - which it has no interest in publishing, didn't edit****, didn't line-edit, didn't proof, and even the cover is 90% based on a draft a friend made for me.

Riptide of course knows that this is my best novel ever, and what the book means to me. It's basically the perfect stick to beat me with.

So, with a heavy heart and tears in my eyes, I have to tell you that Nightingale will not be published. Legally, Riptide owns the book, and according to the contract, they don't even have to publish it. The contract I signed - thinking I was "among friends" - contains no "failure to publish" clause.

At this point, I don't know what will become of the novel.

The only thing I know is that I consider starting, funding, working for and supporting Riptide one of the three biggest mistakes of my life.

Riptide is no longer a work of mine - I distance myself from it as far as I possibly can, and by the grace of the gods I will be allowed eventually to leave the "partnership" without losing control of all my work.

I consider it ironic that a book that's all about freedom and artistic self-respect ends up the hostage of this ... "entity".

As far as I'm concerned, I'm too dazed and hurt and in pain to even think whether I want to write at all. After this blow, I'm half a step away from quitting entirely - I can't even think of writing at the moment, or the future. I'm heart-broken, humiliated and upset.



**** I paid the developmental editor (whom I hired personally because I always planned to self-publish the book) and Riptide so far has paid half of that fee. But Riptide was not involved in the edits or the final shape of it - it didn't change a comma. What Riptide did contribute is a damn fine blurb, and an editing letter upon acceptance that I ignored.

Ije the Devourer of Books That's awful and a shame on Riptide for treating you this way especially since you thought you were working alongside friends. Don't give up though. You could wait it out and keep trying to seek an amicable settlement and if it helps I am quite sure your readers would be happy to write to Riptide asking them to reconsider. Don't give up though. It may take time but you will get through this.

Alison It is sad and unfair what Riptide is doing to you. Please do not stop writing, just know that your eyes are more open to "friends" aka "fry-ends" and you will get over this chapter in your life, turn a few new leaves and everything will be right again in your world. Cheer up and don't give in to the grief.

"Riptide of course knows that this is my best novel ever" - no. The next one you write will be. You get better with each book. Cry a tear for your lost love, Nightingale, and move on. You have other great stories inside you - get going on them, and keep them in your control.

Wendy Oh Aleks, I am so, so sorry! That is absolutely horrible. I can't believe they would be so petty and awful to you after everything you've done for them.

Take deep breaths, and some time to recover from the shock. I agree with Finn that while it may be your best one _yet_ it's not your best one ever, because ever isn't here yet. I don't blame you at all for not wanting to write for a while, or not at all, because I don't think I would either. But I think sooner or later another story will bubble up like a happy little raccoon and start begging you to be fed. It just needs some time. Some chocolate. A drink or three.

Just know that your friends are here for you, and support you whatever you decide to do. I still think that Nightingale will escape its cage somehow, someday.

Hollis Shiloh I'm so sorry this is happening to you. Have you talked to any of the authors who were burned in the Silver Publishing issue? I think Mercy Celeste was one. They might have advice?

Also, I believe this lawyer will sometimes offer advice to authors burned by contracts, if contacted privately. I could be wrong, but I read that they will: http://www.thepassivevoice.com/

Tal What they are doing to you is truly inexcusable, but don't give them the power to take away your voice. If you do need to let the book go to move on just remember that what you write in the future outside the confines of such a hostile environment can only be even better. Living well really is the best revenge. Just give yourself some time to heal from this betrayal. :)

Susan, all we can do is not give Riptide any of our $$$. I guess it's a good thing I'm not that invested in the Sidewinder series no matter how much I like Abi. Part & Parcel comes off the TBR list. Other than Abi & Charlie & Ally there is no one there I will miss reading. Plenty of other books in the sea though. ;-)

Aleksandr Voinov Please do not boycott Riptide - that blog entry is an explanation why Nightingale is not going ahead. I had 100+ preorders and didn't want to disappoint/piss off more than a hundred readers with no explanation. It's not a war cry, not a call to boycott. Riptide is legally totally in the right. It also means they call the shots as they hold the contract.

Ameena I am so sorry for this horrible thing happening to you, I am actually crying over this , what the F*** is wrong with these people this is your book your hard work your baby they can't do this to you, I wish they all go to hell, I was so happy to read a new book by you is coming and to hear that you're writing again and then they do this to you, GOD I am so angry and sad for you and I really wish that you win this and get all your rights and don't let those materialistic MOTHERF***ERS put you down because you are so much better than any of them.

Sae That's disheartening for all, and I'm adding my voice to those who'd like to know if there's anything we CAN do to help/ support you.

And I also agree that it might be worth consulting a lawyer, especially since they're being unfair in their negotiations with you (don't give in to them! as much as I'm disappointed at not getting to read Nightingale right now, I'd far rather know that it's because you aren't letting them win). As for Nightingale, even though Riptide has the legal rights, isn't there something that can be held against them? If nothing else, it's extremely bad business practice not notify you earlier that they weren't going to let you publish until the very last minute like this... You kept them apprised of your intentions, after all, and they let you incur expenses, didn't contribute much of anything, and then they pull this stunt.

I agree that boycotting Riptide books isn't the answer because that will mainly punish the authors, and it's not their fault. Maybe the word can go out more prominently to authors to let them know how underhanded Riptide can get, and if they're going to sign, to be ultra ultra careful?

Hollis Shiloh If it would help I'm sure some of us would be willing to participate in a carefully worded petition about this to the publisher. If they realize it's giving them a black eye, making them look heartless, they might care about the financial cost of that.

Nicole I was wondering why my pre-order got returned. Thank you for letting us know. I hope you are able to work all of this out for the best and will, of course, sign a petition or letter or whatever, or do whatever else you decide your loyal readers should do. You are one of my two go-to authors and I buy all of your solo work without even reading summaries or reviews. As many others have said, each work you put out is better than the last and I hope you will eventually feel up to continuing to share your writing with us. I still think Nightengale will be released eventually, but you mustn't be gouged in the process. You are not desperate: you are too talented to be desperate. We respect your hard work and decisions and hopefully Riptide will too, eventually. All the best to you.

SMi As disheartening as the situation is and despite how frustrated and heartsick you feel, I hope that with time you feel excited at the prospect of putting pen to paper and writing again. You are a wonderfully talented author, and I know you have the respect and support of so many of your fans and fellow authors. This could be a troublesome PR issue for Riptide Pub. and affect the rep of the authors who work at the top level positions within the company. If they are smart, they will handle this process with delicacy.

Julissa Well this totally sucks :/ I was really looking forward to read this book.

I feel like not buying any more books from RP, but then again, I don't want to punish other authors I like when they have nothing to do with this... So please if there's anything we can do to help, like signing a petition or something let us know!

I know you feel like you don't want to write anymore but after some time you'll see that writing will be the best medicine to heal your wounds.

I can only say that I am really disappointed in how Riptide has treated you. I don't know anything about the company or business. But for me, you were the one who created Riptide. Correct me if I am wrong.
I think most of us bought from Riptide is because of you.

But it brings to mind something my grandmother used to tell me--"Just because you can, doesn't mean that you should". Shame on them.
