As if I weren't mad enough already

The defense attorney in the Elizabeth Smart kidnapping and rape case enters HIS argument.

Let's start a new list.

being apparently "not that damaged" to anyone's eye does not mean a person has not been raped.

Damn defense attorneys who attack the victim. Damn them all to the hells of our choice.

Linda Walker So, how's this, we let the defense attorney be raped and see how he likes it! It has been proven that psychological effects of trauma (I would classify rape as trauma) some times takes years to appear. So how does this jack___ know how Elizabeth has been affected? It is because of people like this that our safety is at risk every time we leave or some times stay home.

TheLibraryOfSarah Last time I checked attorneys are NOT psychologists. They do not have the education or expertise to comment on how someone reacts to trauma!
I find it disgusting that anyone would attack a victim and belittle they're pain. Everyone experiences pain differently- you can't tell someone what they can and can't feel or how they should react.
So now an attorney can just decide what classifies rape? Diagnosing people based on sight only (an untrained eye who is NOT licensed to even make a psychological diagnosis or comment?!)

I am right with you Tamora, sorry for my rant.

Killian Even if she wasn't "that" affected, does that make his actions any less criminal? No. The fact that she's strong enough to continue on and survive is a testament to Elizabeth's strength, not a lack of criminal action on her captor's part. Not okay in any sense of the word.
Last I checked rape and kidnapping weren't defined by the psychological effect on the victim but by the use of threat or force by the assailant to coerce the victim. Everyone should be enraged by this man's statement.

Your message is great and powerful, that last point you made was something I forgot about and left out! You're right- rape is rape, it has a legal definition that should be kept in mind.

Irene Palfy I think it was in Italy years ago when a judge decided that a woman wasn't raped because she was wearing jeans. And "because you can't tear off jeans of anyone shhe must had helped him." (I am still feeling sick when I am thinking of this.)

Shanna So being a strong capable woman who can cope after the fact and get on with her life, means that at 14 (incidentally at 14 all sex is rape) being forced to have sex while having been kidnapped the rapist gets a free ride?..... That is scary!
