Tracy returns from extended leave only to find that Nolasco has maneuvered her off the Violent Crimes Team A homicide team and moved her to the Cold Case Unit. She recognizes he’s managed to stay within the policy lines by replacing her with Maria Fernandez and she never considers fighting it. Should she have? Did she have a case?

Charlene (charlenethestickler) | 1203 comments No, I don't think she really had much of a case. I also thought she landed in a good job situation with Cold Cases.

Robin (robinmy) | 2450 comments I agree with Charlene. She really didn't have anything to fight with. She couldn't claim discrimination since they replaced her with a woman. They don't have to hold her job for her. They just have to give her a job at the same or better level (pay range) which they did.

Tracy astutely recognized that Nolasco had cleverly figured a way to get her out of the unit in an attempt to diminish her. However, if she had fought it, Nolasco would have been on the hot seat for sidelining a detective with a 100% closure rate. While that might have damage his career, it would have damaged Tracy’s more.

I don’t think on the surface that it was a good move for Tracy given her career goals. It might provide temporary solutions but as it stood, it was a potential career killing move. It’s the difference between a job and a career.

I continue to wonder how brass doesn’t question this fool’s motives. Everyone is aware of his history with Tracy and someone should be calling him out without her having to do so.

Sharon Kallenberger Marzola | 3485 comments I'm afraid I have to disagree. Tracy had a case because there was a history with Nolasco being a chauvinist and treating her unfairly. Management approved Tracy's time off. Tracy was never informed that her job wouldn't be available when she returned. I don't see how giving the job to another woman is within policy. A man on leave received his job back, but Tracy was not.

I agree with Jonetta. I don't see how brass doesn't question Nolesco when he continually treats Tracy differently.

That’s the reason why I thought she’d lose. If they haven’t seen it in 20 years, it’s because they don’t want to.

However! Did you notice there’s a new chief of police? Maybe now…

FYI, those are great points Sharon.

Sharon Kallenberger Marzola | 3485 comments Yes it is another reason I thought Tracy should at least talk to HR.

~Melissa~ | 429 comments Kudos to Tracy for keeping her head at this point. I was literally screaming at my ipad on what a total *sshole Nolasco is as I was listening to this.

It really did appear as he maneuvered her into a corner that she would not be able to fight out of. He replaced her with another female and a minority at that and was giving her another full time position within the department. She didn't want any blowback against the detective that took her position either.

If memory serves - as I haven't gone on leave in years - they don't have to keep your specific position available - just one on the same par.

This is what keeps surprising me. Especially since Foz got his job back after his leave as Sharon said.

Hoping for some shake up with the new Chief ~ time will tell

This made me so angry for Tracy!! The nerve of that guy!! But Tracy recognized it for what it was and made the best of the situation. I have no idea whether or not she could have fought it, but she remained professional and even ended up working a current case anyway.

That’s right, Sandra. Things have a way of coming full circle sometimes.
