It's not the red sedan that brings the indictment. A grand jury can indict on a single witness's testimony if they believe that witness, even where there is contrary evidence or remaining questions (where did Ben get the red sedan). The grand jury believed Gwin and that was enough to bring the charge. A search warrant, on the other hand is up to a judge who is usually more skeptical. Kagen had a witness (his wife) who testified that he was home when the car pulled up (at this point, Gwin changed her testimony as to who she saw, but not when she saw it). With that evidence indicating that it couldn't have been Kagen in the red car, there would be insufficient PC. Also, I ran the probable cause for the search warrant past two judges who are friends and they agreed that they would not sign the warrant under that circumstance.(less)
