The EU minister asks about the independence of European prosecutors

The MUE, inter alia, states that the possibility provided for in the draft to provide EP prosecutors with organizational instructions within national structures is contrary to Regulation 2017/1939, which expressly prohibits the provision of any instructions other than those provided for in him.

In response, the Ministry of Justice pointed out that the proposed provision only applies to strictly organizational decisions, such as those to determine premises or allocate equipment. Due to the adopted model of locating branches in buildings currently occupied by other units of the Polish Prosecutor’s Office, it was necessary to grant management rights in this area.

The regulation in question therefore refers to decisions of a technical nature, without interfering in any way in the field of judicial practice and without infringing independence. Additionally, to remove such doubts, the Ministry of Justice clarified the provisions of the project, stating that these are strictly organizational orders.
