Appreciating Undocumented Americans

This week on Independence Day, President Obama greeted new US citizens at the White House, taking the opportunity to speak once more about the need for comprehensive immigration reform, “We have to remain a nation of immigrants. And that’s why (…) we’re lifting the shadow of deportation from deserving young people who were brought to this country as children. It’s why we still need a DREAM Act to keep talented young people who want to contribute to our society and serve our country.”


Immigration is an important issue for Obama, and it will be discussed throughout this election campaign. The question is how it will be discussed.


Just about two weeks ago, on June 22, Obama gave his speech on immigration at the 2012 NALEO conference in Florida. In some parts, Obama clearly and beautifully stated his moral understanding of the issue: undocumented immigrants are in many ways already citizens – they contribute to the American society and economy through hard work, they love the country they live in, they are patriots, they share their lives with other Americans every day, they take on individual and social responsibility. The president offered more than just freedom; he offered appreciation.



Words are not just words. They are acts, meaningful acts, and acts with a moral dimension. The young people freed by President Obama have earned appreciation. They are more than Americans without documents. They are fine Americans already and, through the lives they have been living as Americans, have earned the documentation that other Americans have gotten just by being born, without earning them. It is a moral narrative that tells a truth and needs to be repeated.


It is also a narrative of success — the President’s success in accomplishing the right thing, despite Republican opposition, opposition that is to large part based on prejudice.


Nonetheless, the speech could have been improved, and as it is repeated across the country, it needs to be made better in important places.


The president, in the same speech and in other places, uses language that hides and even contradicts his moral view: the Criminal Frame and the Citizenship Is A Destination metaphor.


First, Obama repeatedly uses the phrase illegal immigrants. It evokes a conceptual frame in which undocumented Americans are understood first and foremost as criminals.


The President evokes this frame in his Florida speech, stating that current immigration policy “denies innocent young people the chance to earn an education or serve in the uniform of the country they love.” Being innocent is the opposite of being guilty. The word cannot be understood outside of the Criminal Frame.


Later in the speech, Obama says about the DREAM act “It’s not amnesty,” again evoking the Criminal Frame. And worse, the President infers that immigrants who are to be granted legal status in fact are criminals. Amnesty, by definition, is given to people proven guilty of crimes. The president’s frame turns children of undocumented immigrants into criminals. It does so because the President negates the idea that the DREAM act means amnesty. Every time you negate an idea, that very idea is evoked and strengthened in people’s minds.


Worse, the Criminal Frame does not just assume one act that happens to be a crime — in many cases a technical crime. A criminal is someone who willfully and typically commits real crimes that constitute harm.


Words matter. They mean things. Conservatives have probably quite carefully chosen their words — illegal, alien, amnesty — to fit the Criminal Frame. Using those words, even to negate them, keeps the Criminal Frame. Drop the words. Substitute others that tell an important truth.


The Criminal Frame hides the fact that most undocumented immigrants are fellow inhabitants who contribute to our society and economy, love the country they live in, and share the hopes, dreams, and fears of their fellow Americans. De facto, they already are citizens in many ways but one. They are undocumented Americans.


Second, the fact that undocumented immigrants already act as citizens in most everyday ways is hidden by the president’s call for a “path to citizenship.” The Path Frame implies the metaphor that Citizenship Is A Destination. The metaphor poses a serious problem: As long as you have not reached your destination — legal status — you are not a citizen. You and citizenship are two separate entities. You can arrive at citizenship. But there is nothing inherent in you or what you do — your contributions to the nation’s society and economy, your devotion to American ideals, and so forth — that makes you a citizen. In the Path To Citizenship metaphor, being a citizen is nothing more than getting legal status. All other aspects of citizenship — being and acting like an American — are hidden.


It is at the end of his Florida speech that Obama clearly states his moral understanding of the issue. With regard to the DREAM act he says, “I’ve met these young people all across the country. They’re studying in our schools. They’re playing with our children, pledging allegiance to our flag, hoping to serve our country. They are Americans in their hearts, in their minds. They are Americans through and through — in every single way but on paper. And all they want is to go to college and give back to the country they love.” This is Obama’s moral narrative, and it is a powerful one. It shines a light on a deep and often hidden truth. The president’s action is one of emancipation and of appreciation for what is best not only for the young people set free, but for our nation.


The president should expand on this. Democrats and progressives should repeat it over and over. They should celebrate the President’s success and humanity. And they should stay away from the words that have framed bigotry, and that not only hide, but contradict, this truth.


This is more important than ever now that the Supreme Court has decided to require immigration checks for those arrested. Not all law enforcement officers, for example many of those working in Arizona for people such as Joe Arpaio, are nice people. Some find reasons to make arrests. For undocumented Americans, this can bring back a climate of fear. Arpaio is looking for ways to overcome the emancipation. The freedom the President has offered can still be challenged in many places in our country if he loses the November election.


That is why it is important to repeat President Obama’s words of appreciation over and over. They impose a frame of truth and freedom, and spreading the Appreciation Frame will be crucial to overcoming lingering bigotry.

What Hath Roberts Wrought?

Democrats all over America are claiming victory in the Chief Justice Roberts’ vote to uphold the constitutionality of the President’s Health Care Law. Conservatives all over America are campaigning all the harder for a president and a congress that will overthrow the law in the future.


Thomas Friedman in his NY Times column praises Roberts to skies for putting the country ahead of ideology. Others have seen Roberts as saving “his court” from the appearance of ideological control.


But Roberts is a conservative, and a very smart, forward-looking one at that. What Roberts accomplished on one issue was to enshrine two conservative ideologies — without the Democrats even noticing while they were cheering. He did this by using the Court’s ability to turn metaphors into law. He accomplished this with two votes.



First he was the swing vote that imposed the idea that Health Care Is A Product and set the stage for a possible general principle: The Interstate Commerce Clause governs the buying and selling of products and the government cannot force anyone to people to buy a product (real or metaphorical). Second, Roberts was the swing vote on the ruling that saved the Affordable Health Care Act by creating a precedent for another metaphorical legal principle: A fee or payment imposed by the government is a tax.


In short, in his votes on one single issue, Roberts single-handedly extended the power of the Court to turn metaphor into law in two conservative directions. Many important laws, especially in the area of environmental protection, use the interstate commerce clause. The Court in this session held that the EPA cannot keep a property owner from developing, and hence destroying, a wetland on their property. Will the general principle that comes out of the latest Supreme Court decisions be seen to be that the Commerce Clause cannot be used to preserve the environment but only to govern commercial transactions? The Endangered Species Act is based on the Commerce Clause. Will the above principle be used to kill the Endangered Species Act?


Given the conservatives’ success in rousing public ire against taxes, will all fees and other government payments be argued to be taxes that should be minimized, eliminated, or not even proposed?


Roberts is no fool. In one stroke, he both protected the Court from charges of ideology and became categorized as a “moderate,” while enshrining two metaphor-based legal principles that can be used to promote and implement conservative policy in the future, with devastating broad effects.


We are as happy as other Democrats that the Affordable Care Act has mostly been declared constitutional. But we caution Democrats throughout the country to keep an eye out for conservative uses of the two metaphors that played the central role in the latest Supreme Court rulings — and for ways to keep them from being extended to impose conservative beliefs and doctrines.

Metaphor and Health Care: On The Power to Make Metaphor Into Law

Perhaps as early as today, the conservative–dominated Roberts Court will choose a metaphor that will affect millions of people and perhaps change the history of our country very much for the worse.


Back in 1978, linguists Michael Reddy and George Lakoff, working independently, demonstrated that metaphor is fundamentally a matter of thought, and that metaphorical language is secondary. Conceptual metaphors shape our understanding and can determine how we reason. Consequently, metaphor is central to law, as Citizens United showed by expanding the common legal metaphor Corporations Are Persons, with vast political consequences.

Today’s likely judgment was prefigured in the 2008 Republican presidential race when Rudolph Giuliani likened health care to a flat screen TV. If you want a flat screen TV, buy one; and if you don’t have the money, go earn it. If you can’t, too bad, you don’t deserve it. The same with health care, he argued, imposing the metaphor that Health Care Is A Product.


This was a sign that conservative strategists were looking for a way to impose this metaphor.

Barack Obama helped them. He bought into that metaphor when he chose the Interstate Commerce clause as the constitutional basis of his health care act. He had an alternative — Medicare for All — since Congress has the duty to provide for the general welfare.



But Obama accepted the Health Care as Product metaphor because he wanted to regulate the insurance industry, and Congress has the power to regulate interstate commerce. In doing so he fell into a conservative trap. The Interstate Commerce clause rests on the metaphor that Health Care Is A Product. That led to Supreme Court justices arguing that the individual mandate is forcing people to buy a product, and that, they hinted, is unconstitutional — at least 5-4 unconstitutional. The argument is that if the government can force you to buy one product, it can force you to buy any product — even broccoli.


There is another metaphor trying to get onstage — that the individual mandate levies a health care tax on all citizens, with exemptions for those with health care. The mandate wasn’t called a tax, but because money is fungible, it is economically equivalent to a tax, and so it could be metaphorically considered a tax.

Where the first metaphor would effectively kill the Affordable Care Act, the second could save it. Since Congress has the power to levy taxes, the second metaphor would clearly be constitutional.


But adopting such a metaphor would open the door to other disasters, since then all fees or fines can be argued to be taxes. Conservatives are already making such arguments.


The Supreme Court is a remarkable institution. By a 5-4 vote, it can decide what metaphors we will live — or die — by. It is time we recognize, and speak regularly of, the Metaphor Power of the Court, the power to make metaphors legally binding. It is an awesome power. This is something the press should be reporting on, legal theorists should be writing about, and all of us should be discussing. Should the Court have such a power? And if so, should there be any limits on it?

Obama vs. Romney: The Framing Matchup, Round One

Framing is (or should be) about moral values, deep truths, and the policies that flow from them.

As of their kickoff speeches in Ohio, Romney and Obama have both chosen economics as their major campaign theme. And thus the question of how they frame the economy will be crucial throughout the campaign. Their two speeches could not be more different.


Where Romney talks morality (conservative style), Obama mainly talks policy. Where Romney reframes Obama, Obama does not reframe Romney. In fact, he reinforces Romney’s frames in the first part of his speech by repeating Romney’s language word for word – without spelling out his own values explicitly.


Where Romney’s framing is moral, simple and straightforward, Obama’s is policy-oriented, filled with numbers, details, and so many proposals that they challenge ordinary understanding.


Where Obama talks mainly about economic fairness, Romney reframes it as economic freedom.

Here’s a discussion of Obama’s speech.



Obama began his kickoff campaign speech in Cleveland stating that he is “in complete agreement” with Romney: “This election is about our economic future. Yes, foreign policy matters. Social issues matter. But more than anything else, this election presents a choice between two fundamentally different visions” regarding economic policy.


Obama’s strategy is to pin the Bush economic disaster on Romney, with good reason, since Romney has essentially the same policies as Bush. Since Obama has not consistently pinned the blame on Bush over the past four years, he comes off as defensive.


Romney’s strategy is to pin the disaster on Obama. He uses the Caretaker Metaphor — Obama has been the national caretaker, so the present condition is his responsibility. Since Obama started out assuming a caretaker’s responsibility, it is difficult for him to escape the frame now. He should have avoided it from the beginning. Pinning the disaster on Bush is possible, but it will take a lot of repetition, not just by the president, but by Democrats in general. Not just a repetition of economic facts, but of the moral differences that led to both the Bush disaster and the Obama attempt to recoup.


Perhaps the most important omission from the Obama speech was any overt mention of The Public — everything that our citizenry as a whole provides to all, e.g., roads, bridges, infrastructure, education, protection, a health system, and systems for communication, energy development and supply, and so on. The Private — private life and private enterprise — depends on The Public. There is no economic freedom without all of this. So-called “free enterprise” is not free. A free market economy depends on a strong Public. This is a deep truth, easy to recognize. It undercuts Romney’s central pitch, that is it private enterprise alone that has made our country great, and that as much as possible of The Public should be eliminated.


Romney calls free enterprise “one of the greatest forces of good this world has ever known.” In reality, America free enterprise has always required The Public.


Romney attacks The Public, speaking of “the heavy hand of government” and “the invisible boot of government.” The contrast is with the putative “invisible hand” of the market — which leads to the good of all if everyone follows their self-interest and the market’s natural force is not interfered with. Romney’s “invisible boot” evokes the image of a storm trooper’s boot on your neck. The government is the storm trooper, your enemy. You are weak and in an impossible position. You can’t move — a metaphor for being held back and not being able to freely engage in the economy. Romney uses the frame consistently: “The federal establishment,” he says,” has never seemed so hostile.” The Public is an “establishment” — an undemocratic institution — which is the enemy of the people. It is implicit in this frame that the government is not the people.


Romney’s assumption here is that democracy is based on the “liberty” to seek one’s self interest with minimal regard to the interests or well being of others. People who are good at this will succeed, and they deserve to. People who are not good at this will fail, and they should. In Romney’s speech, ”The Freedom to Dream,” he used the word “freedom” 29 times. This is what he means.


Although Obama intends to argue against this understanding, he unintentionally feeds it. He does so in three ways: First, by accepting and reinforcing many of Romney’s central frames (often by negating them); second, by moving to the right in his own argumentation; and third, by not spelling out his own moral principles explicitly right from the start.


First, here are three examples of Obama repeating Romney’s frames (in bold):

“Governor Romney and his allies in Congress believe deeply in the theory that the best way to grow the economy is from the top down.”


“They maintain that if we eliminate most regulations, if we cut taxes by trillions of dollars, if we strip down government to national security and a few other basic functions, the power of businesses to create jobs and prosperity will be unleashed and that will automatically benefit us all.”


Republicans “believe that if you simply take away regulations and cut taxes by trillions of dollars, the market will solve all of our problems on its own.”


Though Obama’s statements are supposed to be taken sarcastically, they actually are positive, straightforward, easy to understand versions of Romney’s positions and beliefs.


Second, Obama argues for his willingness to compromise by giving examples of his “bipartisanship,” where he did just what conservatives wanted and had argued for as the right thing to do: cutting taxes and eliminating regulations. Here is Obama:


“Understand, despite what you hear from my opponent, this has never been a vision about how government creates jobs or has the answers to all our problems. Over the last three years, I’ve cut taxes for the typical working family by $3,600. I’ve cut taxes for small businesses 18 times. I have approved fewer regulations in the first three years of my presidency than my Republican predecessor did in his.”


Conservatives talk endlessly about “cutting spending.” The president uses the same frame: “I’ve signed a law that cuts spending and reduces our deficit by $2 trillion.


Language is important here, as well as policy. “Spending” is a conservative term; it suggests a needless draining of financial resources, a waste of money. But most of that money was “invested” in our people or used to maintain our infrastructure — not just “spent”. Though a tax reduction for working families may very well have been a good idea, the term “cutting taxes” is a conservative term, suggesting that taxes in general are bad and should be “cut.”


There is of course a deeper problem here. Anyone this me-too-conservatism might appeal to would most likely vote for a real conservative over Obama.


Third, in his speech, the president gives a long list of perfectly reasonable policies: ending oil subsidies, investing in education, hiring more teachers and pay them better, not deporting young immigrants, investing in clean energy, encouraging energy innovation, supporting R&D tax credits, rebuilding crumbling infrastructure, reforming the tax code, eliminating tax breaks for businesses that ship jobs overseas, strengthening Medicare and Medicaid, and so on.


No such list is going to be remembered by most of those who heard it. Moreover, what is said first matters; it sets the moral frame. In his speech, Obama first repeats the Romney frames, opposes them to numbers and policy lists, and only at the end talks about his own moral vision.


What could Obama have done better?


Frame everything from his own moral perspective, including Romney’s positions and assumptions. Avoid the Romney language. Start with his own moral position, which he stated beautifully in his 2008 campaign but has since dropped: That democracy is based on empathy (citizens caring about fellow citizens), responsibility both for oneself and others, and an ethic of excellence (doing one’s best not just for oneself, but for one’s family, community, and country).


What else?


Repeat the truth that The Private depends on The Public. It is The Public that provides economic freedom. Give a vision of responsible, progressive business. Talk freedom — as well as fairness. Point out that the hoarding of wealth by the 1 percent kills opportunity, as Joseph Stieglitz has discussed at length. Speak of an “Economy for All — not just rich bankers, managers, and job killers like private equity firms.” Yes, Romney and those like him are job killers. Say it. Point out that during the economic recovery of 2010, 93 percent of the additional income went to the richest 1 percent of taxpayers. Stop using “top” to mean rich. “Top” suggests high morality, merit, and ability. “Bottom” signifies the opposite.


We are now in a situation where conservatives have framed almost every issue. The least Democrats can do is to refuse to repeat their language and so help them.

Economics and Morality: Paul Krugman’s Framing

In his June 11, 2012 op-ed in the New York Times, Paul Krugman goes beyond economic analysis to bring up the morality and the conceptual framing that determines economic policy. He speaks of “the people the economy is supposed to serve” — “the unemployed,” and “workers”– and “the mentality that sees economic pain as somehow redeeming.”


Krugman is right to bring these matters up. Markets are not provided by nature. They are constructed — by laws, rules, and institutions. All of these have moral bases of one sort or another. Hence, all markets are moral, according to someone’s sense of morality. The only question is, Whose morality? In contemporary America, it is conservative versus progressive morality that governs forms of economic policy. The systems of morality behind economic policies need to be discussed.


Most Democrats, consciously or mostly unconsciously, use a moral view deriving from an idealized notion of nurturant parenting, a morality based on caring about their fellow citizens, and acting responsibly both for themselves and others with what President Obama has called “an ethic of excellence” — doing one’s best not just for oneself, but for one’s family, community, and country, and for the world. Government on this view has two moral missions: to protect and empower everyone equally.



The means is The Public, which provides infrastructure, public education, and regulations to maximize health, protection and justice, a sustainable environment, systems for information and transportation, and so forth. The Public is necessary for The Private, especially private enterprise, which relies on all of the above. The liberal market economy maximizes overall freedom by serving public needs: providing needed products at reasonable prices for reasonable profits, paying workers fairly and treating them well, and serving the communities to which they belong. In short, “the people the economy is supposed to serve” are ordinary citizens. This has been the basis of American democracy from the beginning.


Conservatives hold a different moral perspective, based on an idealized notion of a strict father family. In this model, the father is The Decider, who is in charge, knows right from wrong, and teaches children morality by punishing them painfully when they do wrong, so that they can become disciplined enough to do right and thrive in the market. If they are not well-off, they are not sufficiently disciplined and so cannot be moral: they deserve their poverty. Applied to conservative politics, this yields a moral hierarchy with the wealthy, morally disciplined citizens deservedly on the top.


Democracy is seen as providing liberty, the freedom to seek one’s self interest with minimal responsibility for the interests or well-being of others. It is laissez-faire liberty. Responsibility is personal, not social. People should be able to be their own strict fathers, Deciders on their own — the ideal of conservative populists, who are voting their morality not their economic interests. Those who are needy are assumed to be weak and undisciplined and therefore morally lacking. The most moral people are the rich. The slogan, “Let the market decide,” sees the market itself as The Decider, the ultimate authority, where there should be no government power over it to regulate, tax, protect workers, and to impose fines in tort cases. Those with no money are undisciplined, not moral, and so should be punished. The poor can earn redemption only by suffering and thus, supposedly, getting an incentive to do better.


If you believe all of this, and if you see the world only from this perspective, then you cannot possibly perceive the deep economic truth that The Public is necessary for The Private, for a decent private life and private enterprise. The denial of this truth, and the desire to eliminate The Public altogether, can unfortunately come naturally and honestly via this moral perspective.


When Krugman speaks of those who have “the mentality that sees economic pain as somehow redeeming,” he is speaking of those who have ordinary conservative morality, the more than forty percent who voted for John McCain and who now support Mitt Romney — and Angela Merkel’s call for “austerity” in Germany. It is conservative moral thought that gives the word “austerity” a positive moral connotation.


Just as the authority of a strict father must always be maintained, so the highest value in this conservative moral system is the preservation, extension, and ultimate victory of the conservative moral system itself. Preaching about the deficit is only a means to an end — eliminating funding for The Public and bringing us closer to permanent conservative domination. From this perspective, the Paul Ryan budget makes sense — cut funding for The Public (the antithesis of conservative morality) and reward the rich (who are the best people from a conservative moral perspective). Economic truth is irrelevant here.


Historically, American democracy is premised on the moral principle that citizens care about each other and that a robust Public is the way to act on that care. Who is the market economy for? All of us. Equally. But with the sway of conservative morality, we are moving toward a 1 percent economy – for the bankers, the wealthy investors, and the super rich like the six members of the family that owns Walmart and has accumulated more wealth than the bottom 30 percent of Americans. Six people!


What is wrong with a 1 percent economy? As Joseph Stiglitz has pointed out in The Price of Inequality, the 1 percent economy eliminates opportunity for over a hundred million Americans. From the Land of Opportunity, we are in danger of becoming the Land of Opportunism.


If there is hope in our present situation, it lies with people who are morally complex, who are progressive on some issues and conservative on others — often called “moderates,” “independents,” and “swing voters.” They have both moral systems in their brains: when one is turned on, the other is turned off. The one that is turned on more often gets strongest. Quoting conservative language, even to argue against it, just strengthens conservatism in the brain of people who are morally complex. It is vital that they hear the progressive values of the traditional American moral system, the truth that The Public is necessary for The Private, the truth that our freedom depends on a robust Public, and that the economy is for all of us.

The Wisconsin Blues

In taking over the framing of just about every major issue, conservatives have hidden major truths. Democrats need to speak those truths from their own moral perspective. To show how, we have just published The Little Blue Book: The Essential Guide for Thinking and Talking Democratic. Here is how the book applies to the Wisconsin Recall:


The Wisconsin recall vote should be put in a larger context. What happened in Wisconsin started well before Scott Walker became governor and will continue as long as progressives let it continue. The general issues transcend unions, teachers, pensions, deficits, and even wealthy conservatives and Citizens United.

Where progressives argued policy — the right to collective bargaining and the importance of public education — conservatives argued morality from their perspective, and many working people who shared their moral views voted with them and against their own interests. Why? Because morality is central to identity, and hence trumps policy.


Progressive morality fits a nurturant family: parents are equal, the values are empathy, responsibility for oneself and others, and cooperation. That is taught to children. Parents protect and empower their children, and listen to them. Authority comes through an ethic of excellence and living by what you say, rather than by enforcing rules.



Correspondingly in politics, democracy begins with citizens caring about one another and acting responsibly both for oneself and others. The mechanism by which this is achieved is The Public, through which the government provides resources that make private life and private enterprise possible: roads, bridges and sewers, public education, a justice system, clean water and air, pure food, systems for information, energy and transportation, and protection both for and from the corporate world. No one makes it on his or her own. Private life and private enterprise are not possible without The Public. Freedom does not exist without The Public.

Conservative morality fits the family of the strict father, who is the ultimate authority, defines right and wrong, and rules through punishment. Self-discipline to follow rules and avoid punishment makes one moral, which makes it a matter of individual responsibility alone. You are responsible for yourself and not anyone else, and no one else is responsible for you.


In conservative politics, democracy is seen as providing the maximal liberty to seek one’s self-interest without being responsible for the interests of others. The best people are those who are disciplined enough to be successful. Lack of success implies lack of discipline and character, which means you deserve your poverty. From this perspective, The Public is immoral, taking away incentives for greater discipline and personal success, and even standing in the way of maximizing private success. The truth that The Private depends upon The Public is hidden from this perspective. The Public is to be minimized or eliminated. To conservatives, it’s a moral issue.

These conservative ideas at the moral level have been pushed since Ronald Reagan via an extensive communication system of think tanks, framing specialists, training institutes, booking agencies and media, funded by wealthy conservatives. Wealthy progressives have not funded progressive communication in the same way to bring progressive moral values into everyday public discourse. The result is that conservatives have managed to get their moral frames to dominate public discourse on virtually every issue.


In Wisconsin, much if not most progressive messaging fed conservative morality centered around individual, not social, responsibility. Unions were presented as serving self-interest — the self-interests of working people. Pensions were not presented as delayed earnings for work already done, but as “benefits” given for free as a result of union bargaining power. “Bargaining” means trying to get the best deal for your own self-interest. “Collective” denies individual responsibility. The right wing use of “union thugs” suggests gangs and the underworld — an immoral use of force. Strikes, to conservatives, are a form of blackmail. Strikebreaking, like the strict father’s requirement to punish rebellious children, is seen as a moral necessity. The successful corporate managers, being successful, are seen as moral. And since many working men have a strict father morality both at home an in their working life, they can be led to support conservative moral positions, even against their own financial interests.


What about K-12 teachers? They are mostly women, and nurturers. They accepted delayed earnings as pensions, taking less pay as salary — provided their positions were secure, that is, they had tenure. In both their nurturance and their centrality to The Public, they constitute a threat to the dominance of conservative morality. Conservatives don’t want nurturers teaching their children to be loyal to the “nanny state.”

The truth that The Public is necessary for the Private was not repeated over and over, but it needed to be at the center of the Wisconsin debate. Unions needed to be seen as serving The Public, because they promote better wages, working conditions, and pensions generally, not just for their members. The central role of teachers as working hard to maintain The Public, and hence The Private, also needed to be at the center of the debate. These can only be possible if the general basis of the need for The Public is focused on every day.

Scott Walker was just carrying out general conservative moral policies, taking the next step along a well-worn path.


What progressives need to do is clear. To people who have mixed values — partly progressive, partly conservative — talk progressive values in progressive language, thus strengthening progressive moral views in their brains. Never move to the right thinking you’ll get more cooperation that way.


Start telling deep truths out loud all day every day: Democracy is about citizens caring about each other. The Public is necessary for The Private. Pensions are delayed earnings for work already done; eliminating them is theft. Unions protect workers from corporate exploitation — low salaries, no job security, managerial threats, and inhumane working conditions. Public schools are essential to opportunity, and not just financially: they provide the opportunity to make the most of students’ skills and interests. They are also essential to democracy, since democracy requires an educated citizenry at large, as well as trained professionals in every community. Without education of the public, there can be no freedom.


At issue is the future of progressive morality, democracy, freedom, and every aspect of the Public — and hence the viability of private life and private enterprise in America on a mass scale. The conservative goal is to impose rule by conservative morality on the entire country, and beyond. Eliminating unions and public education are just steps along the way. Only progressive moral force can stop them.

Words That Don’t Work

Progressives had some fun last week with Frank Luntz, who told the Republican Governors’ Association that he was scared to death of the Occupy movement and recommended language to combat what the movement had achieved. But the progressive critics mostly just laughed, said his language wouldn’t work, and assumed that if Luntz was scared, everything was hunky-dory. Just keep on saying the words Luntz doesn’t like: capitalism, tax the rich, etc.


It’s a trap.


When Luntz says he is “scared to death,” he means that the Republicans who hire him are scared to death and he can profit from that fear by offering them new language. Luntz is clever. Yes, Republicans are scared. But there needs to be a serious discussion of both Luntz’s remarks and the progressive non-response.


What has been learned from the brain and cognitive sciences is that words are defined by fixed frames we use in thinking, frames come in hierarchical systems, and political frames are defined in moral terms, where “morality” is very different for conservatives and progressives. What lies behind the Occupy movement is a moral view of democracy: Democracy is about citizens caring about each other and acting responsibly both socially and personally. This requires a robust public empowering and protecting everyone equally. Both private success and personal freedom depend on such a public. Every critique and proposal of the Occupy movement fits this moral view, which happens to be the progressive moral view.



What the Occupy movement can’t stand is the opposite “moral” view, that democracy provides the freedom to seek one’s self-interest and ignore what is good for other Americans and others in the world. That view lies behind the Wall Street ethic of the Greedy Market, as opposed to a Market for All, a market that should maximize the well-being of most Americans. This view leads to a hierarchical view of society, where success is always deserved and lack of success is moral failure. The rich are the moral, and they not only deserve their wealth, they also deserve the power it brings. This is the view that Luntz is defending.


Referring to the rich as “hardworking taxpayers” ignores the fact that a great percentage of the rich do not get their wealth from making things, but rather from investments in other people’s labor, and that most of the 1% are managers, not people who make things or directly provide services. The hardworking taxpayers are the 99%. That is not the frame that Luntz wants activated.


But Luntz is not just addressing his remarks to Republicans. He is also looking to take Democrats for suckers. How? By choosing his frames carefully, and getting Democrats to do the opposite of what he tells Republicans. There is a basic truth about framing. If you accept the other guy’s frame, you lose.


Take “capitalism.” It arises these days in socialist discourse, and is seen as the opposite of socialism. To attack “capitalism” in this frame is to accept “socialism.” Conservatives are trying to cast progressives, who mostly have businesses or work for businesses or are looking for good business jobs, as socialists. If you take the Luntz bait, you will be sucked into sounding like a socialist. Whatever one thinks of socialism, most Americans falsely identify it with communism, and will reject it out of hand.


Luntz would love to get Democrats using the word “tax” in the conservative sense of taking money from the pockets of hardworking folks and wasting it on people who don’t deserve it. Luntz doesn’t want Democrats pointing out how private success depends on public investment — in infrastructure, education, health, transportation, research, economic stability, protections of all sorts, and so on. He doesn’t want progressives talking about “revenue” which is defined in a business frame to mean money needed for any institution to function and flourish. He doesn’t want Democrats talking about the rich paying their fair share for the massive amount they have gotten from prior investments in a robust public. Luntz would love to lure progressives into talking about government “spending” rather than investments in education, health, and infrastructure that will benefit most Americans.


He doesn’t want progressives pointing out that corporations govern our lives far more than any government does — and for their profit, not ours. He doesn’t want any discussion of corporate waste, or military waste, which is huge.


Luntz would love to have Democrats talking about “entrepreneurs,” which evokes a Republican view of the market as a tool for self-interest. His proposal to discuss “job creators” instead hides the fact that the business community has not been hiring despite record profits. He certainly does not want discussion of outsourcing and minimizing pay for work, which leads corporations to eliminate or downgrade jobs and hence keep wages low when profits are high.


Hidden behind his proposal to substitute “careers” for “jobs” is his attempt to appeal to young people just out of college and grad school who expect more — a profession — not just a mere “job.” But of course, corporations are downgrading positions away from professional careers and more toward interchangeable McJobs requiring minimal ability and with minimal pay and benefits.


Luntz is right about not saying “sacrifice.” He is right that most Americans are already hurting more than enough. They want a viable present and a future for themselves and their children and grandchildren. He is right to suggest “talking about how ‘we’re all in this together.’ We either succeed together or we fail together.” But that is the opposite of conservative morality. It is the progressive view of a moral democracy that all of Luntz’s conservative framings contradict. It is an attempt at co-opting the progressive moral system, because the Occupy movement is showing that it is an idea of democracy that makes sense to most Americans. And it is an attempt to take Obama’s strongest moral appeal away from him.


Unfortunately, Luntz is still ahead of most progressives responding to him. Progressives need to learn how framing works. Bashing Luntz, bashing Fox News, bashing the right-wing pundits and leaders using their frames and arguing against their positions just keeps their frames in play.


Progressives have a basic morality, which is largely unspoken. It has to be spoken, over and over, in every corner of our country. Progressives need to be both thinking and talking about their view of a moral democracy, about how a robust public is necessary for private success, about all that the public gives us, about the benefits of health, about a Market for All not a Greed Market, about regulation as protection, about revenue and investment, about corporations that keep wages low when profits are high, about how most of the rich earn a lot of their money without making anything or serving anyone, about how corporations govern your life for their profit not yours, about real food, about corporate and military waste, about the moral and social role of unions, about how global warming causes the increasingly monstrous effects of weather disasters, about how to save and preserve nature.


Progressives have magnificent stories of their own to tell. They need to be telling them nonstop.


Let’s lure the right into using OUR frames in public discourse.

How to Frame Yourself: A Framing Memo for Occupy Wall Street

I was asked weeks ago by some in the Occupy Wall Street movement to make suggestions for how to frame the movement. I have hesitated so far, because I think the movement should be framing itself. It's a general principle: Unless you frame yourself, others will frame you — the media, your enemies, your competitors, your well-meaning friends. I have so far hesitated to offer suggestions. But the movement appears to maturing and entering a critical time when small framing errors could have large negative consequences. So I thought it might be helpful to accept the invitation and start a discussion of how the movement might think about framing itself.


About framing: It's normal. Everybody engages in it all the time. Frames are just structures of thought that we use every day. All words in all languages are defined in terms of frame-circuits in the brain. But, ultimately, framing is about ideas, about how we see the world, which determines how we act.


In politics, frames are part of competing moral systems that are used in political discourse and in charting political action. In short, framing is a moral enterprise: it says what the character of a movement is. All politics is moral. Political figures and movements always make policy recommendations claiming they are the right things to do. No political figure ever says, do what I say because it's wrong! Or because it doesn't matter! Some moral principles or other lie behind every political policy agenda.


Two Moral Framing Systems in Politics


Conservatives have figured out their moral basis and you see it on Wall Street: It includes: The primacy of self-interest. Individual responsibility, but not social responsibility. Hierarchical authority based on wealth or other forms of power. A moral hierarchy of who is "deserving," defined by success. And the highest principle is the primacy of this moral system itself, which goes beyond Wall Street and the economy to other arenas: family life, social life, religion, foreign policy, and especially government. Conservative "democracy" is seen as a system of governance and elections that fits this model.



Though OWS concerns go well beyond financial issues, your target is right: the application of these principles in Wall Street is central, since that is where the money comes from for elections, for media, and for right-wing policy-making institutions of all sorts on all issues.


The alternative view of democracy is progressive: Democracy starts with citizens caring about one another and acting responsibly on that sense of care, taking responsibility both for oneself and for one's family, community, country, people in general, and the planet. The role of government is to protect and empower all citizens equally via The Public: public infrastructure, laws and enforcement, health, education, scientific research, protection, public lands, transportation, resources, art and culture, trade policies, safety nets, and on and on. Nobody makes it one their own. If you got wealthy, you depended on The Public, and you have a responsibility to contribute significantly to The Public so that others can benefit in the future. Moreover, the wealthy depend on those who work, and who deserve a fair return for their contribution to our national life. Corporations exist to make life better for most people. Their reason for existing is as public as it is private.


A disproportionate distribution of wealth robs most citizens of access to the resources controlled by the wealthy. Immense wealth is a thief. It takes resources from the rest of the population — the best places to live, the best food, the best educations, the best health facilities, access to the best in nature and culture, the best professionals, and on and on. Resources are limited, and great wealth greatly limits access to resources for most people.


It appears to me that OWS has a progressive moral vision and view of democracy, and that what it is protesting is the disastrous effects that have come from operating with a conservative moral, economic, and political worldview. I see OWS as primarily a moral movement, seeking economic and political changes to carry out that moral movement — whatever those particular changes might be.


A Moral Focus for Occupy Wall Street


I think it is a good thing that the occupation movement is not making specific policy demands. If it did, the movement would become about those demands. If the demands were not met, the movement would be seen as having failed.


It seems to me that the OWS movement is moral in nature, that occupiers want the country to change its moral focus. It is easy to find useful policies; hundreds have been suggested. It is harder to find a moral focus and stick to it. If the movement is to frame itself, it should be on the basis of its moral focus, not a particular agenda or list of policy demands. If the moral focus of America changes, new people will be elected and the policies will follow. Without a change of moral focus, the conservative worldview that has brought us to the present disastrous and dangerous moment will continue to prevail.


We Love America. We're Here to Fix It


I see OWS as a patriotic movement, based on a deep and abiding love of country — a patriotism that it is not just about the self-interests of individuals, but about what the country is and is to be. Do Americans care about other citizens, or mainly just about themselves? That's what love of America is about. I therefore think it is important to be positive, to be clear about loving America, seeing it in need of fixing, and not just being willing to fix it, but being willing to take to the streets to fix it. A populist movement starts with the people seeing that they are all in the same boat and being ready to come together to fix the leaks.


Publicize the Public


Tell the truth about The Public, that nobody makes it purely on their own without The Public, that is, without public infrastructure, the justice system, health, education, scientific research, protections of all sorts, public lands, transportation, resources, art and culture, trade policies, safety nets, … That is a truth to be told day after day. It is an idea that must take hold in public discourse. It must go beyond what I and others have written about it and beyond what Elizabeth Warren has said in her famous video. The Public is not opposed to The Private. The Public is what makes The Private possible. And it is what makes freedom possible. Wall Street exists only through public support. It has a moral obligation to direct itself to public needs.


All OWS approaches to policy follow from such a moral focus. Here are a handful examples.


Democracy should be about the 99%


Money directs our politics. In a democracy, that must end. We need publicly supported elections, however that is to be arranged.


Strong Wages Make a Strong America


Middle-class wages have not gone up significantly in 30 years, and there is conservative pressure to lower them. But when most people get more money, they spend it and spur the economy, making the economy and the country stronger, as well as making their individual lives better. This truth needs to be central to public economic discourse.


Global Citizenship


America has been a moral beacon to the world. It can function as such only if it sets an example of what a nation should be.


Do we have to spend more on the military that all other nations combined? Do we really need hundreds of military bases abroad?


Nature


We are part of nature. Nature makes us, and all that we love, possible. Yet we are destroying Nature through global warming and other forms of ecological destruction, like fracking and deep-water drilling.


At a global scale, nature is systemic: its effects are neither local nor linear. Global warming is causing the ferocity of the monster storms, tornados, floods, blizzards, heat waves, and fires that have devastated huge areas of our country. The hotter the atmosphere, the more evaporated water and the more energy going into storms, tornados, and blizzards. Global warming cannot be shown to cause any particular storm, but when a storm system forms, global warming will ramp up the power of the storm and the amount of water it carries. In winter, evaporated water from the overly heated Pacific will go into the atmosphere, blow northeast over the arctic, and fall as record snows.


We depend on nature — on clean air, water, food, and a livable climate. And we find beauty and grandeur in nature, and a sense of awe that makes life worth living. A love of country requires a love of nature. And a fair and thriving economy requires the preservation of nature as we have known it.


Summary


OWS is a moral and patriotic movement. It sees Democracy as flowing from citizens caring about one another as well as themselves, and acting with both personal and social responsibility. Democratic governance is about The Public, and the liberty that The Public provides for a thriving Private Sphere. From such a democracy flows fairness, which is incompatible with a hugely disproportionate distribution of wealth. And from the sense of care implicit in such a democracy flows a commitment to the preservation of nature.


From what I have seen of most members of OWS, your individual concerns all flow from one moral focus.


Elections


The Tea Party solidified the power of the conservative worldview via elections. OWS will have no long-term effect unless it too brings its moral focus to the 2012 elections. Insist on supporting candidates that have your overall moral views, no matter what the local issues are.


A Warning


This movement could be destroyed by negativity, by calls for revenge, by chaos, or by having nothing positive to say. Be positive about all things and state the moral basis of all suggestions. Positive and moral in calling for debt relief. Positive and moral in upholding laws, as they apply to finances. Positive and moral in calling for fairness in acquiring needed revenue. Positive and moral in calling for clean elections. To be effective, your movement must be seen by all of the 99% as positive and moral. To get positive press, you must stress the positive and the moral.


Remember: The Tea Party sees itself as stressing only individual responsibility. The Occupation Movement is stressing both individual and social responsibility.


I believe, and I think you believe, that most Americans care about their fellow citizens as well as themselves. Let's find out! Shout your moral and patriotic views out loud, regularly. Put them on your signs. Repeat them to the media. Tweet them. And tell everyone you know to do the same. You have to use your own language with your own framing and you have to repeat it over and over for the ideas to sink in.


Occupy elections: voter registration drives, town hall meetings, talk radio airtime, party organizations, nomination campaigns, election campaigns, and voting booths.


Above all: Frame yourselves before others frame you.

Why Democracy Is Public: The American Dream Beats the Nightmare

Democracy, in the American tradition, has been defined by a simple morality: We Americans care about our fellow citizens, we act on that care and build trust, and we do our best not just for ourselves, our families, and our friends and neighbors, but for our country, for each other, for people we have never seen and never will see.


American Democracy has, over our history, called upon citizens to share an equal responsibility to work together to secure a safe and prosperous future for their families and nation. This is the central work of our democracy and it is a public enterprise. This, the American Dream, is the dream of a functioning democracy.


Public refers to people, acting together to provide what we all depend on: roads and bridges, public buildings and parks, a system of education, a strong economic system, a system of law and order with a fair and effective judiciary, dams, sewers, and a power grid, agencies to monitor disease, weather, food safety, clean air and water, and on and on. That is what we, as a people who care about each other, have given to each other.


Only a free people can take up the necessary tasks, and only a people who trust and care for one another can get the job done. The American Dream is built upon mutual care and trust.



Our tradition has not just been to share the tasks, but to share the tools as well. We come together to provide a quality education for our children. We come together to protect each others' health and safety. We come together to build a strong, open and honest financial system. We come together to protect the institutions of democracy to guarantee that all who share in these responsibilities have an equal voice in deciding how they will be met.


What this means is that there is no such thing as a "self-made" man or woman or business. No one makes it on their own. No matter how much wealth you amass, you depend on all the things the public has provided — roads, water, law enforcement, fire and disease protection, food safety, government research, and all the rest. The only question is whether you have paid your fair share for all we have given you.


We are now faced with a nontraditional, radical view of "democracy" coming from the Republican party. It says that "democracy" means that nobody should care about anybody else, that "democracy" means only personal responsibility, not responsibility for anyone else, and it means no trust. If America accepts this radical view of "democracy," then all that we have given each other in the past under traditional democracy will be lost: all that we have called public. Public roads and bridges: gone. Public schools: gone. Publicly funded police and firemen: gone. Safe food, air, and water: gone. Public health: gone. Everything that made America America, the crucial things that you and your family and your friends have taken for granted: gone.


The democracy of care, shared responsibility, and trust is the democracy of the American Dream. The "democracy" of no care, no shared responsibility, and no trust has produced the American Nightmare that so many of our citizens are living through.


Nightmare it is, but there is no denying credit to Republicans for their skills at framing. The recent Republican "Contract from America," for instance, begins with a statement of their moral principles. The recommendations are special cases of those principles. It is a strategic initiative. Instead of a laundry list, each recommendation is a special case of a general strategy — to defund our American government.


Furthermore, they understand that about 20 percent of the electorate consists of people who are conservative in some ways and progressive in others. These are biconceptuals, sometimes referred to loosely by political professionals as "independents" or "swing voters." Republicans know their job is to activate the conservative part of the brains of the biconceptuals, and they do that by sticking strictly to conservative moral principles and a clear conservative strategy. They never make the mistake of ignoring biconceptuals.


Progressives too often fail to clearly state the moral principles behind the American tradition. Our arguments often sound like an abstract defense of distant "government" rather than a celebration of our people, our public, and the moral views that have defined our tradition and the real human beings who work every day to carry them out.


There is a distinction between government as the administration of what we, as a public, provide each other, as opposed to government control. The Right wants to focus only upon control, not upon all that our tradition has given us. They do not just hide the vast positives, but they also hide the fact that governmental control, control over our daily lives, is more private than public. Private government for profit runs our lives – the health care we receive, the food we eat, the cars we can drive and the gas to fuel them, the news we get, loans for our homes, and on and on. Public government is for the benefit of all of us. Private (especially corporate) government is for the private profit of top management and stockholders. If you are concerned about your life being controlled for the benefit of others, look to the private sphere.


The institution of government, however, is not the point. We must instead defend the moral principles we seek to advance through our American government — and through ethical business practices, voluntary associations etc. The traditional view of American democracy sees government as embodying these moral goals, to protect and empower everyone equally.


If we are to successfully overcome the Republican demonizing of government and shared responsibility, we must restore faith in the mutual enterprise itself. Rather than simply defend government or government programs, we must positively advance the moral values of American democracy and the Dream, not the Nightmare.


That is why we support a renewed focus on public life, a public life that includes all Americans. We should focus on the public nature of our shared responsibilities.


Public life means meeting our shared responsibilities, caring for one another, and building the mutual trust upon which democracy depends. The recommendations below are special cases of these moral principles. They also represent a special case of a general strategy – to restore public life to American democracy.


1. We must return the public to our political system and end the corrupt influence of selfish interests that have abandoned our shared responsibilities. This means public finance of campaigns, strict enforcement of the highest ethical standards in public life, and protection of the sacred right to vote.


2. Our nation has vast national wealth: a huge continental landmass with wealth in minerals, agricultural land, forests, cities, beautiful places, as well as its public wealth, that is, the creative wealth of its educated citizenry and the collective wealth of all its citizens and corporations. We, the public, can put our nation's vast wealth to use in creating jobs that make the lives of all better: building, educating, curing, and imagining. That is the Dream.


To realize the Dream, we must end the Nightmare.


3. We must turn back the Right's assault on public and higher education and meet our traditional commitment to education. Our children are tomorrow's public. The future of democracy depends upon them.


4. We must rebuild our public infrastructure, a fancy term for the necessities we share: roads, bridges, dams, parks, fair grounds, water mains, sewers, and the power grid; public agencies that monitor disease, weather and food safety. Government that works for all of us can and should create jobs that serve us all by rebuilding our shared necessities.


5. We must come together publicly to mutually ensure the health of all America. Health is not a private matter. It is public one.


6. We must protect the prior earnings of American workers set aside in Social Security or private pensions. They have been earned through hard work and discipline. Taking these earnings away is theft, despite the Right's use of the word "entitlements."


7. A public of unequal voices is not a democratic public. We need a progressive tax system through which all Americans pay their fair share and a business ethics that fairly rewards those whose work creates productivity and profit.


8. We must put the American individual above abstract corporate entities. We must end "corporate personhood," which gives transnational corporations a greater voice than individuals in our public deliberations.


9. We must end the move to "privatize" institutions through which we meet our shared responsibilities. When the public is removed, the private sphere takes over, charging more, and often creating unaccountable monopolies that bilk the public. Privatization of the public typically means that most citizens just pay more, often a lot more.


10. Discrimination of all kinds must be overcome. Public life depends upon recognition of our equal humanity.


This is why Democracy is, and must remain, public. This is why America has traditionally been a beacon to the world. This is the example America has set. We dare not give it up. The alternative is the Nightmare.
