Gorcyca must pay 1 million
Pay up Gorcyca!! You ruined many lives, and cost many people their dignity and self-esteem. I don’t feel one ounce of sorrow for your self/inflicted wounds. Eat it and like it.
Oakland Co. tells ex-prosecutor: We won���t cover costs

Former Oakland County Prosecutor David Gorcyca is personally liable for a $1-million judgment against him earlier this month in a defamation lawsuit filed by a couple he unsuccessfully prosecuted.
Oakland County paid lawyers more than $660,000 to defend Gorcyca and two of his former assistants charged with defamation and violating the constitutional rights of the Wendrow family of West Bloomfield in a 2007 rape prosecution that was ultimately dropped for lack of evidence.
The county informed Gorcyca in a letter obtained by the Free Press this week that it wouldn���t cover any judgment against him.
���As you are also aware, the basis of the lawsuit against you is defamation for statements that you allegedly made after you left Oakland County employment,��� Oakland County���s risk manager, Julie Secontine, wrote to Gorcyca in the May 2012 letter. ���As such, should the plaintiff in this matter receive any favorable judgment, Oakland County is not legally obligated to indemnify you or pay any damages rendered for your alleged actions.���
Gorcyca did not respond this week to a request for comment from the Free Press nor did Steven Potter, who defended Gorcyca and the county in the case.
Gorcyca was prosecutor in 2007 when he charged Julian Wendrow of West Bloomfield with raping his severely autistic daughter and charged Wendrow���s wife, Thal, with child abuse for failing to prevent the attacks.
The girl���s disability prevents her from speaking or writing and the allegations of rape were made through a controversial method known as facilitated communication, in which a teacher���s aide holds the girl���s arm over a keyboard to help her type responses to questions. Critics insist that the aide is the author of the typed messages, either consciously or subconsciously.
The criminal case against the Wendrows collapsed after the method was tested in court by asking the girl questions out of earshot of her facilitator. She couldn���t answer a single question correctly.
Gorcyca eventually dropped the charges but not until Julian Wendrow had served 80 days in jail and the family had been separated for months. Gorcyca left office in December 2008 after deciding not to seek re-election.
Jury awards against prosecutors are rare because governmental immunity shields most of their actions, said Peter Henning, a former federal prosecutor who teaches law at Wayne State University.
���The tradition goes back to medieval England that prosecutors have absolute immunity from defamation for things they say in a courtroom,��� Henning said. ���But once you get out of that prosecutorial position, then it���s the ordinary rules of defamation. You no longer get any protection when you���re not prosecutor.���
The jury concluded that comments Gorcyca made about the case ��� stating or implying that the Wendrows were guilty of abusing their children ��� after leaving office were defamatory and awarded $250,000 to each of the four members of the Wendrow family of West Bloomfield.
The other $2 million of the judgment was issued against Gorcyca���s former chief deputy prosecutor, Deborah Carley. Jurors concluded that Carley violated the civil rights of then 13-year-old Ian Wendrow, when she sought to shore up a faltering rape case against his father.
The $3 million awarded to the Wendrows at the trial brings to $6.75 million the total paid out in the case. West Bloomfield police, Walled Lake Consolidated Schools and the Michigan Department of Human Services paid $3.75 million to settle claims brought against them in the case.
Oakland County corporation counsel Keith Lerminiaux said Oakland County is planning to file post-trial motions in the court in Ann Arbor and may appeal after those are decided.
���While we respect the jury���s decision, we do not believe that the verdicts were consistent with the evidence or applicable law,��� Lerminiaux told the Free Press in an e-mail Tuesday.

Gorcyca should pay!

“According to Gordon, the legal fees for the former prosecutors, which amounted to more than $600,000 before this trial, have been covered by Oakland County. She did not know whether the judgment against Gorcyca will be paid by the county’s insurance policy since he was no longer a county employee when he made the disparaging statements.
At press time, Potter and Gorcyca had not responded to phone messages and emails requesting comments”
No verification if this is true but The Oakland Press is questioning if Oakland County insurance will cover Gorcyca’s jury judgment of $1,000,000. The jury gave a detailed explanation as to what Gorcyca did to warrant the judgment. Gorcyca defamed the Wendrow family to the media after he had left office. Why should the County pay?
Gorcyca’s bad karma bit him. The original federal complaint was somewhat vague on what damage had been done to the Wendrows. Certainly Gorcyca had no inclination, or anyone on the Court legal team had any inclination that the jury would focus 1/3 of the judgment on the comments Gorcyca had made after the charges had been dropped by his office.
I’m guessing Gorcyca’s arrogance and defiant manner on the witness stand heightened the jury’s attention to his transgressions against the Wendrows, especially since he had no remorse. The jury picked the worse thing he did and then set a price of which the family was entitled.
The jury was pretty conservative in it’s judgment. Andrea Dean missed the bullet almost completely. The County isn’t going to consider appealing. Gorcyca is entirely at the Oakland Court’s mercy if they are going to slip the million dollar settlement onto the insurance carrier claim. If the Oakland Press has already questioned who pays the million, they know Brian Dickerson will surely be asking questions.
This story is far from over. Could Gorcyca face licensing action, if not federal criminal charges? I don’t know, but we’ll see.

The following is a short description from one of my loyal readers.
On November 6, 2014 a jury awarded the Julian Wendrow family $4,000,000 award after they filed a federal lawsuit charging the Oakland County’s Prosecutors office with gross misconduct and violation of their civil rights. The jury heard testimony from David Gorcyca, Deborah Carley and Andrea Dean.The Prosecutors refused to apologize to the family or show any remorse to the Wendrows even at the trial.
How does it taste Gorcyca, Carly and Dean? Eat that for a while.
