Professional Review for A Motion for Innocence

Shaun Webb is an excellent writer who captivates our attention. His writing style pulls us into his story and has us turning the pages faster and faster. There is a major lesson to be learned through this particular story. Are any of us immune to the justice system? Do we really own our own personal freedom or can our freedom be taken away, in the blink of an eye, and our lives turned upside down just because someone else desires attention or isn’t getting what they want? Aren’t we all supposed to be innocent until proven guilty, beyond a shadow of a doubt, or are the words of a liar more potent to the justice system then our own personal words of truth? The main characters of this story, names changed to protect the innocent and guilty alike, are people just like you and me; every day people who are living in your own neighborhood. Who can you trust? Who can’t you trust? The fact that the beginning of this story took place on holy ground, a safe place, at a local private school, a place most of us would trust makes this story even more captivating. Are we safe anywhere? Shaun did an excellent job in writing this important story about how someone can be tried as a sex-offender, judged as a sex-offender, treated as a sex-offender and even when eventually, after much pain and suffering is found to be innocent and still has to live his life in question. Our laws need to be changed to protect the innocent! We must not assume, right off the bat, that if someone is proclaimed as a sex-offender that he really is. Good Job Shaun Webb! You did an excellent job telling this story. This is a topic that most Authors would shy away from, but you were brave enough to bring this important story to our attention. I highly recommend this book to anyone who desires to know the truth and desires to help change our outdated ways of viewing these types of situations. I can only wonder about how many innocent people are sitting in our prisons today, doing hard time, for a crime they have not committed.

Family can sue prosecutors over faulty sex-abuse case


 


Note: By the way, don’t even begin to give Deborah Tyner any special kudos for her representation of the Wendrows in this case.  She sent plenty of innocent people to jail over bogus sex charges and was fired for her work “transgressions”.  She is nothing more than a hypocrite.


Detroit Free Press:


A U.S. Court of Appeals ruling on Wednesday allows a West Bloomfield couple’s lawsuit to proceed to trial over claims that their constitutional rights were violated after the father was accused of raping their autistic daughter, leading to a prosecution that a judge later described as a “runaway train.”


The appeals court said governmental immunity doesn’t shield Oakland County prosecutors, Walled Lake Consolidated Schools officials and staffers from the Michigan Department of Human Services from liability for their actions in the case.


The case, involving Julian and Thal Wendrow, drew nationwide attention because the rape claims were made using a controversial method known as facilitated communication. Their daughter, then14, has severe autism and cannot speak. Through facilitated communication, known as FC, the girl would type messages on a keyboard with a facilitator holding her arm and guiding her movements.


Some of the messages typed allegations that Julian Wendrow had repeatedly raped his daughter since age 6 and that her mother was aware but didn’t stop the attacks.




Julian and Thal Wendrow, who say they’ve been waiting more than five years to redeem their reputations, welcomed the appeals court decision.


“It’s been a long haul,” Thal Wendrow said. “All we ever wanted was to get to a place where we could tell our story … a jury trial where we can be fully vindicated.”


Oakland County Corporation Counsel Keith Lerminiaux said county officials were disappointed by the ruling, which reinstated claims against former prosecutors Deborah Carley and Andrea Dean. Walled Lake Schools officials and the Michigan Attorney General’s Office didn’t respond to requests for comment.


“The court’s opinion simply states that their conduct needs to be further reviewed by the district court,” Lerminiaux said. “The court did not make any determination of wrongdoing on their part. We continue to believe that the actions of the prosecutors in this case were appropriate, and for that reason, we will continue to vigorously defend the claims made against them.”


Documents have shown the investigation into the rape allegations was flawed nearly from the start.


Walled Lake Central High School facilitator Cindi Scarsella helped the Wendrows’ daughter type messages in November 2007 that said her father had sexually abused her and her mother turned a blind eye.


Critics of facilitated communication say the facilitator is the true author of the messages. The messages typed using that method included a number of factual errors, such as a passage describing nonexistent relatives and an incorrect name of the family dog. School officials alerted police and state protective services officials. Both parents were arrested, and the girl and her brother, who has a milder form of autism known as Asperger’s syndrome, were removed from the family home.


Thal Wendrow was jailed for six days before being released on an electronic tether with the condition that she not contact her children. Julian Wendrow spent 80 days in the Oakland County Jail before the case collapsed. The family was separated for 106 days.


But a nurse’s exam of the girl found no evidence of sexual abuse. And the use of facilitated communication caused problems. At a district court hearing, the judge had Scarsella leave the room when the girl was asked questions and then return to help her type answers. The girl was unable to answer a single question correctly when Scarsella couldn’t hear it.


Still, prosecutors pressed ahead, saying the family had advocated for facilitated communication to the point of demanding that the school district use it. FC isn’t widely used because studies have concluded the facilitator is actually typing for the disabled person, and the method has resulted in a number of false sexual abuse allegations.


The two Oakland County prosecutors, Carley and Dean, removed the girl’s brother from his classes during school hours to question him during the investigation. Even though he was considered a suspect in the case, he had no lawyer or guardian present with him.


“It was objectively unreasonable for Dean and Carley to subject (the brother) to an interview of this type without consent,” the court ruled.


The ruling went on to note: “There is evidence to suggest that Dean and Carley were aware of significant issues with the use of FC, as well as (the girl’s) cognitive abilities and that they chose to ignore appropriate protocols and chose not to make any effort to safeguard against the known dangers of FC.”


The ruling also said Rebecca Robydek, a social worker with the state Department of Human Services, isn’t entitled to immunity for removing the children from their home based solely on the girl’s statement made through FC.


Robydek’s actions are especially troubling in this situation given the multiple documented errors in the facilitated statement used as the sole basis for Robydek’s recommendation,” the court ruled.


The ruling criticized Robydek for turning the girl’s 13-year-old brother over to police for questioning without alerting his guardian or a lawyer. During a taped interview, West Bloomfield Police Detective Joseph Brusseau attempted to get the brother to corroborate the rape allegations and repeatedly lied to him, telling the boy that investigators found videos of Julian Wendrow raping the boy’s sister.


No such tapes were ever found. The boy cried at points during the two-hour interrogation, saying he could never trust his father again.


The West Bloomfield Police Department was originally named in the Wendrows’ lawsuit, but in December 2010, the township’s insurance carrier settled the claim for $1.8 million. Township lawyer William Hampton told the Free Press the settlement was “nothing more than a business decision by the insurance carrier,” and the police acknowledged no wrongdoing.


The Wendrows’ lawyer, Deborah Gordon, said she was happy with Wednesday’s ruling, but even a trial can’t replace what the Wendrows have lost.


“You’ll never completely get your name back — there will always be allegations,” Gordon said. “Til the day they die, that will be part of their public face and public records.”


Julian Wendrow agreed, saying that on a recent visit to his native South Africa, the case followed him there through computer record checks.


“I was detained for more than two hours because this stuff is still in the system,” Wendrow said. “It really hurts. It’s very difficult to describe.”

The Grasshopper

At 12:00 P.M., I asked my mom to let go.  I told her we would be okay. 


At 1:45 on Tuesday, July 30, 2013, My mother left us to be with her Savior Jesus Christ in Heaven.  It was a long and hard journey as the cancer attacked her for eight long years.  She was a valiant fighter, undergoing chemotherapy and other radical treatments until March of 2013, when she’d had enough.  The drugs being pumped inside her were no longer effective in her fight.  She decided to let what would be…be.


As I held my mom’s hand until her final breath, I thought about all the wonderful memories, experiences and laughs we had had through the years.  After her departure, I bent beside my mom, told her I loved her, gave her a kiss on the forehead, and said goodbye.  I walked out to my room, crying and wiping my eyes.


As I entered my living area, I saw a grasshopper sitting on the chair that I sit in to watch TV, write or read.  The insect was some two inches long (Very long and big for a grasshopper).  I put my hand down to trap the bug and toss him outside when something wonderful happened…..the grasshopper offered no resistance and gently walked onto the palm of my hand.  I looked at the green insect and brought it close to my face.  I felt something, I don’t know what, but I felt it.  I walked outdoors with the insect and gently allowed it to crawl onto a large tree.  It did so with calm and serenity.


Mind you, I had never seen a grasshopper within my living quarters up to that point.  That I saw it startled me, but the peace that flowed through my body was the best and most relaxed peace I’d ever felt in my life.  I knew it was something more…..


The grasshopper had arrived to let me know that everything was okay.  It wasn’t a simple coincidence, but a real delivery of good news….That my mom had entered Heaven and was doing very well!


I know it sounds contrived and very odd, but I tell it like I see it.  My mom is okay and living in Heaven with the people who had previously passed.


Today, a grasshopper landed on my step-dad’s shoulder.  A coincidence? Maybe?


Things happen for a reason.  I can accept my mom’s departure.  She’s in a place that we as human’s can only imagine.  My mom lives in Heaven with her Lord.  She is peaceful, serene and surrounded by loved ones.  No more pain.  No more guilt.  No more drama.


Enjoy it mom.  I can’t wait to see you again.

Thank You Mom, and I Love You

I love you.  I will always love you.  I had so much to say and thank God I was able to share it with you before you took your final breath.


Today, I share with others the wonderful Mother and person that you were.


When life was hard, you were always there for me.  No matter what the circumstance, you stood tall.


When life was fun, you were always there for me.  Your smile and sense of humor was awesome.


The love you gave was unconditional. I couldn’t have asked for a better Mom.  You always had my back.  Now, Mom, I have yours.


Your reward of Heaven has finally arrived.


There are so many things I want to say, so many things I want to express.  The very best thing I can say is thank you.


Thank you for giving birth to me.


Thank you for raising me.


Thank you for keeping me safe.


Thank you for feeding me.


Thank you for keeping a roof over my head.


Thank you for disciplining me when it was necessary.


Thank you for hugging me even when I felt I didn’t deserve it.


Thank you for coming to all my ball games even though you hated sports.


Thank you for taking me to the beach, the movies or wherever we went when you didn’t feel like doing it.


Thank you for standing up for me.


Thank you for defending my honor.


Thank you for talking me through thousands of anxiety and panic attacks.


Thank you for cheering me up when life was hard.


Thank you for teaching me that death is not to be feared. You were very brave up to the end.


Most of all, thank you for being my Mom.


The memories will never die, even though life and reality has taken you away from us. Memories of you will always be with me. These are the treasures that we’re left with after our loved ones are called home by our Lord and Savior. This is truly a blessing, as these thoughts are what helps us move on.


I remember you taking me to grandma’s house every week.


I remember going camping and you tolerated my constant whining, complaining and getting into trouble.


I remember you chasing me around when I was a wee lad because I just wouldn’t sit still.


I remember playing yahtzee until we laughed our butts off. You could never keep the dice on the table!


I remember reading the “Get Fuzzy” comic to you over the phone almost every week.


I remember having angry meltdowns, only to have you calm me.


I remember you singing “Way down upon the Shawnee River” every time we crossed it.


I remember you cleaning up my assorted sores and cuts because I was so clumsy.


I especially remember driving up north to visit you and Rocky at your house on the lake in Prescott and feeling like I was on a vacation.


I remember, Mom, and will never let those wonderful memories escape.


Losing you in this life is very hard.  It’s difficult because we don’t understand why our loved ones are snatched from us.  Today, however, should be a time of celebration; a celebration of your arrival into Heaven.  The day will come when we’ll be together again.  This is not the end, no, but a new beginning; a new adventure for you. You now live in the true glory.


You had no fear mom.  You trusted in your Lord and Savior Jesus Christ.  You knew that the end of life on earth meant the start of a wonderful new eternal life in Heaven.  The family and friends who preceded you in death waited with open arms as you crossed into the eternal afterlife; an afterlife that has no pain, torment, or disappointment.


It won’t be the same without you Mom, but I know it’s only temporary.  When the day comes that we take our final breathes, it will be the day that we will be reunited. I look forward to that day.


I love you mom.  I will always love you.  Rest in peace my dear.

Valigator Chickens Out!!!!!!

As usual, Valigator is bending the facts to satisfy her fear of going on the show with me. She found out my daughter was to also face her and she wanted NO part of it. She knew it’d be tough to explain why she thought it a good idea to follow a 16 yr-old on Twitter and Facebook (among other social sites). Also, lets be accurate about my reasoning. This show wasn’t about my case but about Val’s obsession with me. I was more than willing to go under the lie detector as related to her endless harassment. The show also wanted her to go under the detector. Isn’t it funny how Val only gives half the story? You pussied out Val. You knew you’d get crushed and couldn’t take it. You’d rather hide behind your keyboard drinking your whiskey and harassing the world.

I’m not a bit suprised that she backed out.  She wasn’t going to be the star she so wanted to be.  She wanted everybody to cowtow to her allegations and it just wasn’t going to happen.  Even the producers thought she was bat-shit crazy.  It’s always funny how Val sticks her chest out and threatens everyone, but when it comes down to it, she backs out like the yellow-belly she really is.  Remember, she only tackles alligators AFTER they’re already dead.



I was willing to go face-to-face with her.  I was willing to take the lie detector test, and I was willing to turn my daughter loose on her…a daughter who isn’t on the registry and has NO fear of this woman.



When it came down to it, Val couldn’t take the heat.  This woman is evil and now not just us, but EVERYONE knows it!  Oh well, I tried to put a stop to her nonsense, but she figured it out and didn’t like it.  So we move on…….Go have another 7 and 7 Val.


Oh, and the producers thought it very strange that a near 70 yr-old woman calls herself Valigator.  Very 4th grade.


Here are a few of the allegations I wanted to argue about that Val herself  has admitted to:


1.  She admitted to following my underage daughter on Twitter and Facebook in an attempt to pull her into the drama.


2.  She admitted to calling my local police several times in an attempt to get me violated (Of course she failed continuously).  She claimed my being on any social media site was illegal.  The police called me and said it was okay to be on Facebook, Twitter, etc and that I was doing nothing illegal.  They also told me to ignore her, as she has a bad reputation for rabble-rousing.


3.  She admitted to calling many cities in Michigan to get my book shows cancelled, of which only one did actually cancel me.  The others said I was fine being there.  By the way, it IS illegal in all 50 states to interfere with a person’s ability to make a living.  The shows that she attempted to have cancelled have agreed to testify against her in the event that I file a lawsuit (A real possibility).  Despite my conviction of 4th degree CSC (Misdemeanor), the people in Michigan love my books and treat me with the upmost respect.


4.  Val claims I RAPED a 13 yr-old girl when in fact my conviction was for touching a 15 yr-old girls COVERED breast (Of which I was also not guilty).  I was acquitted on ALL felony charges.  I am on the registry for a ridiculous charge.


5.  Val has admitted to making up bogus book reviews to try and hurt my sales on Amazon.  She has not read word one of the books.  It was just an attempt to de-fame my literary career.  She has again failed on all counts.


The woman is enamored, obsessed and overly interested in me and my life.  I say she’s just lonely.


My blog is averaging 4,000 hits per day, while she garners about 25 a day on hers.  Enough said.

Watch for me on TV!!

On April 23rd or April 29th, I will be flown out to Los Angeles for a taping of the TV show The Test.  The show is run by Dr. Phil’s son, Jay Mcgraw.  The most interesting part?  I get to face off with the person who hates my guts (For reasons I don’t know), The Valigator!  It will be interesting, informative and downright exciting!


They will also be featuring (or mentioning) my book, A Motion for Innocence…And Justice for All?, which documents the TRUTH about what happened to me back in 2006.  It will be so cool and feels like a big chance to really have good things to say and possibly help Valigator understand better that not all sex offenders are really sex offenders.


Keep an eye on my blog and I will give you updates about where and when the show will be aired.

Jodi Arias Trial- The Uncensored Pictures & Update 4-26-13

When I say uncensored, I mean NO bars blocking anything out.  If you’d like to see the pics, and I don’t know why you would…..the link is at the bottom of the post.  When you click on the video, the majority covers Travis’ death photos, but from 1:34:45 through 1:41:47 covers the nude photos of both Jodi and Travis.  If you must see them, then that’s your business.  I warn you!  The entire set of pics is graphic and disturbing.


Update 4-26-13:  Now I think I have  a good grip on what happened.  Jodi found out Travis was going to Mexico and wigged out.  She took pictures of him in the shower to make him vulnerable, and when he wasn’t looking, jumped on his back and started stabbing.  He struggled out of the shower trying to get her off, spreading blood and smears down the hall.  He finally did get her off him, but not before being stabbed many times in the back and the front.  He went to the sink and began spitting blood out of his mouth and nose when she came up behind him and slashed his throat.  He was falling and she caught him.  She dragged him down the hall and placed him at the entrance to the shower area, where he bled to death.  She then pulled out the gun and shot him.  The bullet casing landed on top of the blood.  She then dragged his dead body to the shower and shoved him in the best she could.  It was out-and-out murder.  I have tried to see the case from her side, but I just can’t.  She’s lying and she’s psychopathic.  I’m afraid turning her loose may risk another death(s).  The fact that I don’t care for the prosecutor doesn’t matter.  He’s doing his job, rather loudly!  Jodi was a sexual toy for Travis, but she liked it.  She liked his perverted nature and she liked it when he humiliated her, i.e. ejaculating on her face, anal sex, etc.   Sorry Jodi…..That’s the way I see it.  I’ll bet I’m right.
