@Jim, I think the actual malice if I remember if often more or not a jury question. Also I believe that the July 11th post where they state that the only way to fight bullying is through bullying might be helpful to show that they intended to inflict harm. And of course, once if the identity of the site owner is revealed to be Vanity past communication would probably come into play. Note, it's been awhile since I took Torts though and I haven't really focused on it since I took it because of my other courses, so I'm not 100% sure.

I have not seen the July 11th post you mentioned, but it sounds important. Does anyone have a screen cap of that?
So, the individual bits of physical evidence may at some point add up to an actionable case, with (perhaps) some additional discovery to establish site owner and some other points.
I know you don't want to make any firm statements or conclusions about that, and I don't think we need them at this point. I just like to have the sense that we are on a productive track.
And I want the potential of legal action to be clear to anyone who is reading this. Particularly to someone who might be up most of the night putting the posts together, possibly while also working a day job. Someone who might just make a critical mistake in a post - or maybe has already done so. Someone who has shown a need for further editing of her/his work in the past.
I don't think we are there yet in our understanding of all this, by any means. But I do get the sense that the pieces - at least some of them - are starting to fall into place. I hope you agree.;)

I still have a year of school left though and months of studying for the Bar before I can actually practice though, so this by no means is good solid legal advice. It's just advice from a second year soon to be third year student who finds this sort of thing fascinating. I did screen cap that page. So a commenter is one of the site creators. And the comment is all about the justified response of that site to 'bullying'.

Also very interesting that the website seems to voice support for the Story Siren in relation to her being caught plagiarising. Apparently calling for a boycott of a blogger who got caught stealing is tantamount to bullying. I must be a massive bully then because I advocated a boycott and also contacted several publishers to ask why they provided a thief with ARCs.

And in all honesty our blog isn't THAT big to call a boycott for the most popular YA blogger. We didn't support her and said as much. Their argument is invalid.

They want to take a stand against something, but not as themselves. So...if you claim to be brave enough to want to incite change, than perhaps you should be brave enough to do it honestly. And I don't understand how authors can be victims by a person not liking their book. Just. Really.
Furthermore, if I were an author I would trust my audience to find my book by virtue of my work. There is no way to please everyone, so why would I want to wade through so many people?! If I were to be published I would consider that a win. The rest will follow in its own time.

It is an underground movement that is growing exponentially every day as more and more people find us. More people have been harmed by the GR bullies than we ever knew. We knew there were a lot who had had terrible experiences (or witnessed them) and left the site, but we had no idea how many.

It bothers me that book reviewing has gotten so personal and it seems to have been forgotten that reviewers are consumers.As a consumer, I can go out and buy a pair of jeans from The Gap. The Gap has made a promise that these jeans will stand up to normal wear and that they will make my ass look great. If I get them home and the jeans fall apart or fail to live up to expectations I have a reasonable chance of returning them to the store and getting my money back. If not, I can take to twitter, facebook, my blog or I can go old school and telephone everyone that I know in order to tell them that The Gap sells shoddy merchandise and they shouldn't shop there. Some will listen - most will ignore me. That is how consumerism works.
I also have the right to boycott a store if I disagree with the way they deal with customers, their salespeople, their merchandising, the personal politics of the CEO - pretty much anything that bothers me. Again, I can chose any medium I like in order to spread my message to those who might listen.
I do not have the luxury of returning a book because it failed to live up to its promised level of entertainment. BUT I still have the right to tell everyone I know that it sucked and that they shouldn't waste their hard earned cash on a piece of tripe.
I also have a right to boycott an author if I do not like the way they speak to readers/reviewers, their personal politics, a history of plagiarism or if they once said they prefer cats to dogs - ludicrous, but it is a free country and I am entitled to form an opinion based on any information that I like. Again, I can spread this message in whatever way I wish.
The CEO of The Gap doesn't respond to me with nasty messages or use his considerable resources to seek out my personal information and broadcast it to the world. Instead, he simply tries to ensure that the next pair of jeans is of better quality.
I think it would be very interesting to see their reactions if we offered them the chance to interview someone from the band of ruthless rampaging bullies. Just a thought I had in my insomnia-produced stupor. It would be fun to poke holes in their fallacies.
