sleeping with fear matches my description but I would like to know if there's hypnotism involved.

In the end, Hypnotism is explained in the courtroom to the judge and the lead character walks free.

The Skull Ring by Scott Nicholson? Hypnosis is used early on by a therapist to help the heroine remember. I don't know if it plays a critical role at the end.
