Elian nervously took a seat, trying to 'keep his cool'.
"We are here to today to discuss the switching of custody over Amelia Rose Kendrick." He said. "That's me." Amelia whispered.
Elian smiled at her and then took Natalia's hand, holding his hand tightly.
"I'll call Amelia's current guardian Rebecca Lind to the stand please." Rebecca stood up and moved out to the aisle. She walked down it and sat beside the judge in the small boxed seat.
"Please state your relationship with Elian." He said."I'm his mother's sister." She said. "He is my nephew."
Elian chewed on his bottom lip as he watched her.
"And you have a child of your own?" He asked.She nodded. "My daughter Katherine is thirteen." She told him.
"And she knows that Amelia isn't her sister? I understand you got custody over her when she was young."
"Yes Katy knows that there are not siblings." She replies
Elian's eyes went to Katy and then Amelia and then back to his aunt, listening intently.
The judge nodded. "When you got custody, was Elian allowed to visit?" He asked.She asked. "Only if he was 100% sober. That motivated him to stop, I believe."
"And now, what are your thoughts?" He asked."He's been sober fully for about a year and a half now." She said. "I've never seen someone work as hard as he does when trying to get sober." She looked at Elian. "I'm so proud of him,"
Elian looked at his aunt and really, though he wouldn't admit it later, he teared up.
The judge nodded. "You extended his time with her to unsupervised weekends at his house, yes?"She nodded and handed him the papers saying she was able to do so.
Elian wiped a little at his eyes, trying to keep it discreet.
"I also knew that he wasn't alone with Amelia completely. He had his girlfriend now wife with him, whom I trust." Natalia smiledz
The judge nodded. "And you think he is capable of being a father full time?" Rebecca looked at Elian, smiling. "Of course I do."
"Thank you." He said. "You may go back to your seat." Rebecca nodded and went back to her seat.
"Now id like Natalia Markov to the stand please."
Natalia looked at Elian, squeezing his hand.
Natalia stood up and approached the bench. She sat down."Natalia, you're Elian's wife, yes?" The judge asked. She nodded.
"How long have you been together?" He asked.
"About a year now." She told him
Elian smiled at his aunt when he caught her gaze and then turned his gaze back to Natalia.
He nodded. "So you haven't been together for very long?"She bit her lip. "Not very long though." She said. "But i only needed a few months to realize how amazing of a father he Is".
Elian played with his hands, wondering if what all they were saying was true or not.
"Let's talk about you first," he said. "You struggled with addiction as well, correct?" Natalia nodded. "Briefly." She admitted.
Elian listened quietly but he had already known about that.
"What were your addictions?" He asked."Cocaine, ecstasy, and I had a minor sex addiction." She admitted.
The judge nodded, looking over her forms. "And how long have you been sober?"
"Three years." She told him
Elian blinked. He'd known she had addictions but he hadn't known any specifics until then. He hid his surprise quickly, though, just incase.
"And what is your current occupation?" He asked."I'm a lead performer in a show that I do downtown twice ever weekend. It's a acrobatic and magic show." She told him.
"Good income?" He asked.'
She nodded. "Yes but i recently just did my last show."
He pursed his lips. He looked at the Judge's face, wondering if that was going to be a problem.
"On Fourth street? Old theatre?" He asked/She looked at him and nodded. "Yes."
"Oh I've been to one of your shows then. Very well done."
"Thanks." She smiled al title
He checked the papers again. "You're not from this country." He stated.She nodded. "I was born in Moscow, Russia." She told him. She suddenly looked very nervous. Talking about her life previous and where she was from wasn't something she liked to do.
He glanced at Chelsea briefly and then sat on top of his hands.
"I don't catch much of an accent." He noted."I lost it over the years; but some words I say you can hear it:" she said, then blushed.
He nodded and looked through the papers. He frowned. "I don't see legal documentation that you're a legal citizen in this country."
Elian tensed, he'd completely forgotten about that.
Natalia went pale. "O-oh I'm not? I mean I had a really rough childhood and followed performing group here I..".
Elian gripped the chair and chewed on his bottom lip.
"I'm surprised you didn't have any run Ins with the law." He said. "You would have been deported then.""Look I was young I didn't know you couldn't enter and live in a country illegally," and sniffed
Elian chewed on his bottom lip because she was lying and he didn't know if it would work or not.
"Do you have any living relatives in the country?" He asked.She shook her head without hesitation. "No. And I don't know how that died; I was disowned."
He rubbed his eyes tensely and leaned forward on his knees.
He nodded, writing some things down. "Your marriage to Elian is legal, yes?" He pulled up the marriage certificate.She nodded. "Yes it is."
He nodded. "And yours expecting? How far along are you?" Natalia almost sighed with relief. "I'm about 11 weeks".
He nodded. "And this baby was planned?" She nodded. "We've been trying, yes."
The judge took his seat and that's when everyone else was allowed to sit.
