(Mr. Hausner, in the last of his articles in the Saturday Evening Post, unwittingly added new fuel to this argument: he said that the prosecution realized at once that Eichmann could not be defended by an Israeli lawyer, because there would be a conflict between “professional duties” and “national emotions.” Well, this conflict constituted the gist of all the objections to Jewish judges, and Mr. Hausner’s argument in their favor, that a judge may hate the crime and yet be fair to the criminal, applies to the defense counsel as well: the lawyer who defends a murderer does not defend murder.
