Eichmann in Jerusalem: A Report on the Banality of Evil

(The defense could have quoted in support of Eichmann’s thesis the testimony of one of the best-known experts on constitutional law in the Third Reich, Theodor Maunz, currently Minister of Education and Culture in Bavaria, who stated in 1943 [in Gestalt und Recht der Polizei]: “The command of the Führer ... is the absolute center of the present legal order.”) Those who today told Eichmann that he could have acted differently simply did not know, or had forgotten, how things had been. He did not want to be one of those who now pretended that “they had always been against it,” whereas in fact they had been very eager to do what they were told to do. However, times change, and he, like Professor Maunz, had “arrived at different insights.”
