A legal system which merely establishes principles and lays down general lines of procedure entrusts to the judge the creation of the living law under the maxim praetor viva vox juris civilis.*6 Such a state of affairs is intolerable to the technician, who dreads above all else the arbitrary, the personal, and the fortuitous.
