The Court asked if state abortion restrictions created an “undue burden” on women seeking the procedure prior to viability. It defined undue burden as a “substantial obstacle in the path of a woman seeking an abortion before the fetus attains viability.” The majority (which included a woman on the Supreme Court for the first time in history, Justice Sandra Day O’Connor) determined that all but the husband notification passed this new test.
