Today, Justice Ruth Bader Ginsburg, sanctified by many on the political left as the “Notorious RBG,” suggests that the United States Constitution, with its guarantees of negative rights, is actually inapposite to national flourishing. Were it up to her, she stated in 2012, she would base a new Egyptian constitution not on our Constitution, but on the “constitution of South Africa—that was a deliberate attempt to have a fundamental instrument of government that embraced basic human rights . . .”40 Those positive rights include the rights to housing, health care, food, and social security. None of these “rights” would have been familiar to the founders. They radically redefine the nature of rights—rights are merely goods to be provided by the government, rather than preexisting claims against the predations of government.
