The whole judicial process is animated by a combination of abstract reasoning, social observation and ethical value-judgement that seems to many people to introduce a higher morality into public decision-making.

We are making a personal moral judgement that some rights ought to be adopted by human communities because they are so fundamental to their values and so widely accepted as to be above legitimate political debate.
