These faith-healing exemptions are new; most date only to the mid-1970s.29 American common law (law made in the courts through precedent in the absence of explicit legislation or statutes) rejected the attempts to claim religion as a defense for killing one’s child.30 Religions are taking advantage of these exemptions.
