Where The Color of Law differs is not with their theory but with their facts. For those who, like the Court, believe that the Constitution requires a remedy for government-sponsored segregation, but that most segregation doesn’t fall into this category, I hope to show that Justice Roberts and his colleagues have their facts wrong. Most segregation does fall into the category of open and explicit government-sponsored segregation.
