The Department of Justice a couple years ago helped to persuade the Supreme Court that prosecutors should be allowed to tell juries about the fact that a suspect who was not in custody tried to exercise the right to remain silent if the suspect did not tell the police explicitly why. So that means you should tell the police that you wish to exercise your privilege against self-incrimination, right? Wrong.
