Americans could no longer count on their popularly elected legislatures to solve many of the problems of their lives. “For the varying exigencies of social life, for the complicated interests of an enterprising nation, the positive acts of the legislature can provide little.”48 This was a long way from the 1776 republican confidence in popular legislative law-making and represented a severe indictment of democracy.
