In meetings throughout the fall of 1996, she learned that IIRIRA would mean deporting tens of thousands of people who otherwise would be allowed to stay in the country because they’d either lived here for a long time, had families who depended on them, or faced “undue hardship” in their native countries. The discretion once exercised by INS agents and immigration judges no longer applied.
