1214610 What is fair and equitable in terms of distribution of assets when there are children involved, in case of a seperation is indeed a tricky subject. While an equal (50-50) distribution may indeed seem fair, law usually takes an holistic view in such cases. The courts will indeed make orders that are just and equitable in all the circumstances.

Like in the book, when a marriage ends, like after two years in this case, and children are involved, determining a fair distribution becomes a critical concern.The court has to consider the financial and non-financial contributions made by each party during the marriage. These contributions can include things like raising children, maintaining the home, and earning an income. The court will also consider the future needs of each party, such as their age, health, and earning capacity.

As for the book, the Australian laws as depicted in the book where majority of the wealth of the husband is to be handed over to the spouse may look unfair on the surface but the law has to take a dispassionate view of the situation in all cases and considering the future of the children and their rights, i do feel that the law is fair.
