That is good - love NYC :) Anyway everything that can be proven by experiment is more or less fact and not theory. Of course taking extremely general approach yes you can say that current knowledge is to some degree fact until new experiments or sources of information show otherwise, therefore Niel presents good approach always saying "at the current level" of knowledge it is safe to say that whatever in the Universe is as it appears to us through astrophysics equipment - for now.
Newtonian physics were proven by experimentation. Now, they are outdated. We got more sophisticated at what we could measure.
Neil has a tendency to pontificate as if what he is describing is the final end all. Lots of examples in the book.
