I don't think that is right. His parents are together, often talk, and have dinner together in book 1 several times. They are partnered and on the phone about Nick's wedding and attendance in book 2.
True, things have always been amicable, but clearly they do not live together and have not in some time.
But being "legally separated" and "living separately" are actually two significantly different things. Kwan doesn't write any evidence that they aren't still in mutual partnership/love with one another and just living in separate places, respecting each other's lifestyles.
