I would assume that you wouldn't even pursue it unless you felt that there was a commonality of work styles and creativity. As for payment, I am sure that is something that could be set up by an agent or legal advisor. But, I understand the concern.
That would make it easier to work together, yes. Absolutely attorneys would need to be involved early on in the process.
