Moaning Myrtle wasn't used as a horcrux and Riddle didn't actually kill her. Just as Wormtail really killed Cedric and not Voldemort. (That's why I didn't include her on my list.)
I believe Riddle is responsible for Myrtle's death, just as much as anyone who uses a wand or instrument to kill. The basilisk only kills Myrtle because Riddle commands it to, so by that account I believe it's murder.
