How does the premise of this book even work? The Supreme Court is subject to the Constitution. An amendment, once passed and approved by the states, becomes part of the Constitution. So how does the Court have any power to decide the "fate" of an amendment?

Instead, what the Court is doing is assessing the propriety of the procedure by which the amendment was enacted. That is precisely within their purview. Sorry, it took me so long to respond.
