Their evidence:  the findings of the Palast Investigations team, our sleuths and our statisticians are cited throughout as the solid factual back-up for their suit to stop the wrongful removal of tens of thousands of voters of color in that state.


(Crosscheck is that secret hit list of 7 million Americans crafted by Kris Kobach, Trump's "Elections Integrity" czar.  The list, targeting minority voters was discovered and uncovered by the Palast team.)

And speaking of busted:  two arrested for the Charlottesville beating.


We are thrilled to say that, based on the photos taken by our team’s brilliant and gutsy photographer, Zach D. Roberts, two of those who assaulted African-American school teacher De’Andre Harris, have been arrested.  Dan Borden, who beat Harris with a four-foot hunk of lumber, and Michael Ramos, who beat Harris with brass knuckles, have both been taken into custody.


Unfortunately, despite our pleas to the FBI, little has been done to track down the neo-Nazi who threatened Zach and Harris’ friends with a Glock 9mm semi-automatic.

Indivisible Chicago and the ACLU of Illinois have teamed up to call for an end the state's participation in Crosscheck, and have launched a campaign that has the support of State Rep. Will Guzzardi ( 39th District), State Rep. Greg Harris (13th District), among others.


However, Indivisible Chicago reports that the State Board of Elections has again declined to put Kris Kobach's racially-biased Crosscheck voter-purging program on the agenda for its September 18th meeting — continuing to cite that the Board "requires more information to get up-to-speed on this program."


It's absolutely WEIRD that the Illinois Board of Elections wants time to "get up to speed on Crosscheck" — when they’ve been IN THE PROGRAM for years. Shouldn’t they "get up to speed" before they send lists to Kris Kobach again?

Why is Virginia Using BOTH Crosscheck AND ERIC To Purge Voters?

There is no reason for Crosscheck in Virginia. There’s not been a single case of someone voting in Virginia and another state. Not one case. It’s a massive disenfranchisement to stop a crime which does not exist. That's why we don’t really want to improve the way Crosscheck operates, we want to put an end to the whole dishonest, Jim Crow operation.


That said, one of the problems with Crosscheck is that there’s no oversight with regards to how it’s implemented. In 2013, the year Virginia joined Crosscheck, the state removed 41,677 people from the voter rolls. When I interviewed him for my film, The Best Democracy Money Can Buy, Kris Kobach himself said the state had violated the federal law — criminally — by removing those voters.

But Virginia also had another purge, using ERIC, which is a non-partisan system for maintaining voters rolls created by a group of founding states in partnership with The Pew Charitable Trusts. Under the ERIC system, states are supposed to use every match, including the last four digits of your Social Security number, which Kobach collects for Crosscheck, but never uses.


ERIC is a much tighter system. It also uses change of address forms, and has a registration side, which states are also supposed to implement. So if someone gets a card because it looks like they’ve moved, they’ll also get a form to help them register in their new state. The ERIC system is supposed to create a net-positive registration because of measures such as this. (I haven’t actually seen it used that way, but it’s supposed to be net-positive.)


Virginia's in ERIC, and what scares me about Virginia is that tens of thousands of people were removed because of the ERIC review, which was basically, probably, legit people who had moved, etc. Then you had tens of thousands more removed by Crosscheck. Well, if they weren’t caught by ERIC, then it’s suspect that you’re then pulling voters from the rolls because of the Crosscheck list. Those are the people that likely have mismatched middle names, dates of birth, and Social Security numbers — meaning they’re false-positives and clearly not the same people.


So, if states — like Virginia — use both ERIC and Crosscheck, that’s really evil. Now you really know that you’re getting false matches — and purging people from the voter rolls because of them.


The ACLU has objected to using even ERIC, because it gets some false-positives. But compared to Crosscheck, it’s not even on the same planet. Crosscheck is absolutely meant — no question — to wipe out the minority vote. It is designed that way, it works that way, they know it, they continue it, and therefore Crosscheck is on its face a tool of Jim Crow. (In a lawsuit brought by the NAACP and League of Women Voters in Indiana, the legal arguments came down to the fact that Crosscheck is a racist program — see story.)


This is why we’re working with Dee Hunter of DC's Civili Rights Center to demand that Virginia’s Secretary of State, Terry McAuliffe — one of the last Democratic governors to insist on staying in Kobach's racist voter purging program — pull out of Crosscheck.

Kobach “Election Integrity” Commission Discuss Obviously Bogus Claims Of Voter Fraud in NHRepublicans Aren’t Fools, Misdirection is Intentional

Kris Kobach's so-called "Election Integrity" Commission had their first public meeting in New Hampshire on Tuesday. One of the topics they discussed was claims made by a bogus Koch-funded Heritage Foundation report that 1,100 people in New Hampshire voted illegally (which Kobach repeated in his similarly bogus September 7 Breitbart column). The "evidence" that they used to back this claim up was that some people used out of state DMV ID to vote. On yesterday's edition of the Thom Hartmann Program, Greg and Thom quickly debunk the Heritage Foundation and Kobach's assertion that illegal out of state voters changed the outcome of the 2016 New Hampshire Senate race.


Thom Hartmann: New Hampshire has got a bunch of good colleges... And to the best of my knowledge, if you go to college in New Hampshire...and you're there 9 months out of the year, you establish domicile. In other words, you can legally be part of New Hampshire and vote in New Hampshire, even though you're not legally a resident. That's the law in New Hampshire. You don't have to get a New Hampshire driver's license to vote. Why has that simple reality not sunk into these fools?


Greg Palast: Well, I hate to say it Thom, it's because they're not really fools. They're wise fools. They know exactly what they're doing, which is to create a hysteria that we need all kinds of rules...


It's worth noting that one of these suggested rules to combat the virtually nonexistent crime of voter fraud, put forth by panelist John Lott (the author of More Guns, Less Crime), was that voters be forced to undergo background checks similar to those that potential gun-owners are subjected to in some states. This, of course, is all really about creating yet more obstacles to prevent the poor, the elderly, students, and people of color — who all tend to lean blue — from exercising their right to vote.

Civil Rights Center Calls On Governor McAuliffe (D) To Withdraw Virginia From Racist GOP Voter Purging Program

After spearheading the launch of The Voting Rights Project in Virginia at an event on Saturday, September 9, DC's Civil Rights Center has called for the state to withdraw from Interstate Crosscheck.


In an open letter, submitted on September 12, 2016, the Executive Director of the Civil Rights Center, Dee Hunter, asked Virginia's Democratic Governor, Terry McAuliffe, to terminate the state's participation in the GOP's racially-biased-by-design voter purging program.


"Terry McAuliffe has called the Trump-Kobach vote fraud commission a machine of 'vote suppression'. Yet McAuliffe is one of the last Democratic governors to insist on staying in Kobach's racist Crosscheck program," says investigative reporter Greg Palast, who co-presented the September 9 Voting Rights Project event.


With campaigns launched in both Georgia and Virginia, the Voting Rights Project aims to restore real election integrity by getting rid of Interstate Crosscheck, which is currently being used in 28 mostly Republican-controlled states.


"Crosscheck is an unreliable and discriminatory," notes Hunter. "Virginia’s participation in Crosscheck is potentially resulting in hundreds of thousands of voters being illegally purged from Virginia and other state voter rolls."

Watch The Voting Rights Project Virginia Panel Feat. Palast — Plus Representatives From NAACP, VoteRiders, People Demanding Action & More

On Saturday, September 9, 2017 we took the Voting Rights Project to the First African Baptist Church in Richmond, Virginia. A screening of a brand new activist cut of The Best Democracy Money Can Buy was followed by a panel discussion. Moderated by Dee Hunter of the Civil Rights Center, it featured Palast, Kathleen Unger (VoteRiders), Andrea Miller (People Demanding Action), Brian Cannon (OneVirginia2021), Gus Semba (The Semba Foundation), and Greg Moore (NAACP).


The event had one main goal: To put pressure on the Governor of Virginia, Terry McAuliffe — a Democrat — to remove the state from Kris Kobach's stealth voter-purging system. Over a million voters have quietly been removed from voter rolls by Interstate Crosscheck, and most don’t even know.


We believe with enough pressure and education, that in Virginia we can win. We can stop Crosscheck. We put pressure on New York, they pulled out. Washington state pulled out. Oregon pulled out. And believe it or not, Florida pulled out. (Richard Scott was on the Crosscheck list, so Republican Governor Rick Scott got the education the right way!)


We can do it in Virginia. It might take litigation, it might take protest, it might take legislation — it’ll probably take all three. It’ll also take your heart and your time, but it must be done. We have to shine a light on Crosscheck.

Second Man Arrested In Connection With Charlottesville Neo-Nazi Attack

On Monday, August 27, police finally arrested the second of two assailants identified from Palast Investigative Fund photographer Zach D. Roberts' Charlottesville photos. Alex Michael Ramos, who surrendered himself to the Monroe County Sheriff’s Office in Georgia on Monday evening, has been charged with one count of malicious wounding. Fellow attacker, Dan Borden, faces a similar charge for the brutal assault of Black school teacher De'Andre Harris, which nearly cost him his life.

"While we’re happy that arrests are going forward... these two men were identified immediately by journalists who covered the rally. There have been no additional identifications of any of the other participants by law enforcement," said Harris' attorney, Lee Merritt, in an interview for Democracy Now!. "We just hope that people don’t settle with these two arrests and that law enforcement doesn’t think that the job is done with these arrests."


Note that the Justice Department has brought no charges for crossing state lines with intent to commit violence. (Maybe Jeff sessions thinks that the other attackers were "very fine people".)


"I’m also concerned in these arrests that they have been undercharged. Each were charged with one felony account of a malicious assaulting," said Merritt. "We’re talking about a group of white supremacists who attacked a young black male at a white supremacist rally while shouting racial slurs… if this doesn’t set the table for hate-based criminal charges, I don’t know what will.”
