(§§ 2064-2196 Will and Testament 1)
The volume explains will and testament interpretation, the content nullity of testaments of the deceased and the regulations concerning the appointment of an heir including provisional succession and reversionary inheritance, bequests and conditions. The emphasis of the revised edition is the documentation and recognition of the comprehensive supreme court jurisdiction on the interpretation of last wills and testaments and the detailed discussion of the significance of the reform of the law of obligations and in particular of the statue of limitations law for bequests. The standpoint developed in previous editions on the nullity of wills and testaments of the testator due to infringement against good morals is considered in-depth due to the much-discussed decision on inheritance contract marriage and descent clauses. To aid the understanding of the preferential legacies for provisional heirs, a completely new concept has been presented.
