This casebook, which focuses primarily on domestic commercial arbitration, was written by a practicing attorney and adjunct law professor with over twenty-five years of practice experience. The book is organized around the three phases of getting the arbitration started, conducting the arbitration, and enforcing the arbitration award. At each phase, the book presents the leading cases, including the recent Supreme Court trilogy on class action waivers in arbitration cases, interpreting the Federal Arbitration Act. As additional features, the book includes a chapter that constructs an entire dispute and walks the student through the pre-hearing motion practice, the hearing itself, and the post-hearing confirmation battle, which provides further hands-on experience. The book also includes an overview of international commercial arbitration. Problems, class exercises, and Practice Pointers engage students and give them a window into real-world arbitration. A Teacher’s Manual will be provided, including additional classroom exercises and simulations.
