FDIC Director Suits: Lessons Learned: 2nd Edition

The American Association of Bank Directors has undertaken a review of the FDIC’s civil suits against directors of failed banks and savings institutions to find out what directors of open banks can learn from the one hundred and four suits (involving more than 793 directors and officers) filed from July 2010 through January 12, 2015. We undertook this study primarily to assist AABD members and others who currently serve as bank directors in avoiding the fate of those who have been sued. Studies on the causes of bank failures and what can be learned from them are plentiful for the failures of banks and savings and loan associations during the S&L crisis of the late 1980’s and early 1990’s, but not for the more recent failures. A bibliography of many of the earlier studies and a few more recent studies is provided in Appendix I.
