The book will set out the rules of property law in a structured framework, looking at how the different approaches of the common law and of equity combine to produce the modern law of property. It will also consider those arguments which do not easily fall clearly within the usual framework, whether because they have not been litigated to give answers to the questions raised, or because they appear to belong to some other aspect of law such as customary rights. The book is introductory in the sense that no prior knowledge is assumed but does not shy away from the complexities and inconsistencies of modern property law, or from its arbitrariness as a social construct.
