The Poor Doctor , published in serial form from January to May 1861 in the illustrated journal The Paris Evenings was a plagiarism of a historical novel by Louis Jousserandot , a Republican lawyer. The trial took place in January 1863. Both complainants were sent back to back and both paid the costs. But the defeat was much side Jousserandot, former Republican outlaw who had little chance of winning against the rich and famous Xavier Montépin, who was adored by the readers and politically close to the imperial power.
Girls Plaster , published in 1855, also won in scandal and Montépin sentenced to three months imprisonment and fined 500 francs in 1856.
