I know this is two years old but I'm answering anyways. A dystopia is defined as the opposite of a utopian or a society where the citizens are oppressed. It doesn't have to be futuristic and some modern day counties such as Egypt can be defined as dystopian. The main country in this doesn't really fit that category though since only Malfettos are oppressed. It's probably shelved as dystopia because Legend was dystopian.

I mean it kind of is, it has corrupt leaders, I guess. But it's not futuristic.
