Putea să fie altcumva: O istorie subiectivă a justiției după 1990

„Am devenit magistrat în anul 1990, astfel că, profesional vorbind, sunt de o vârstă cu sistemul de justiție postdecembrist, în care m-am format și pe care l-am influențat într-o anumită măsură. În anii mei de procuror mi-ar fi plăcut să citesc o istorie a justiției din regimul comunist din perspectiva amintirilor și carierei unui magistrat, însă așa ceva nu s-a scris. Nu am lucrat, deci, ca magistrat înainte de 1989, însă am făcut-o din plin după 1990 și, vrând să las o imagine a justiției vremurilor mele, a apărut ideea acestei cărți.

Este o istorie subiectivă a justiției din România de după căderea comunismului pentru că redă, în special, momentele cărora le-am fost protagonist sau martor, însă și pentru că nu încerc să obiectivez post factum lucrurile trăite. Evenimentele sunt prezentate așa cum le-am perceput eu în acele momente, cu emoțiile, temerile și deciziile proprii, dar și prin prisma modului cum au fost ele consemnate de presa vremii.

Cartea poate fi văzută și ca o istorie a maturizării corpului magistraților, dar și a deformării acestuia, pe alocuri. Oamenii politici nu au cum să lipsească din poveste, iar unii dintre ei s-ar putea să apară chiar mai bine conturați decât am intenționat.“ — Daniel Morar

Subiectiv este putin spus. Este o relatare a unor evenimente pe care poate unii dintre noi sunt prea tineri sa le cunoasca dar dupa lecturarea cartii Domnului Morar este bine sa nu ae opreasca daca vor sa afle si sa inteleaga mai bine contextele si realitatea. Nu pot sa nu remarc ca lipsesc evenimente si fapte ale D-lui Basescu dar si ale altora.

My first remark is that we are talking about a very long book - 658 pages. The accounts are extremely accurate, and I would be curious if the author kept some diary or even has such a good memory to bring to the reader the facts of 25-30 years ago with so much detail included. However, in my opinion, I would divide the book into two - the first part and the last 150 pages.
In the first part, we find a lot of accounts in a subjective note of some generally known events and sometimes marked by the author's notes. I found this part a little self-centred, but anyone who has done anything would have a similar approach.
The last part, the last 150 pages, are wow because they address elements of the life of Romanian society that we barely knew about. Very few had the strength to discuss - the influence of the secret services in daily life in the country, the role of the secret services in collecting information about citizens, Big Brother laws, activism in the magistrate system, etc. I also understood that it is very possible that many situations in which I was not too fond of the Constitutional Court are only manifestations of surface evaluations and that, most of the time, the laws are so poorly made that they cannot pass a check of constitutionality. Moreover, I needed to understand why I found a lot of formalism in the relations between institutions and too little creative substance to move society forward (the examples from the pandemic period are scary.
After reading this, I'm wondering what the hell we're doing.
