التنظيم القانوني لتحضير الدعوى، دراسة لنظام قاضي التحضير وهيئة التحضير أمام المحاكم الاقتصادية

يذكر المؤلف في مُقدِّمته:" فى سعي المُشرِّع الحثيث للحد من ظاهرة البطء في التقاضي فقد أقر العمل بنظام قاضي التحضير بالمحاكم ليحد من هذا الأزمة، ولكن تردد المُشرِّع بين إقرار هذا النظام أو تعديله أو إلغائه، والمتابع لتطور قانون المُرافعات المدنية والتجارية يجد أن الأمر قد استغرق ما يزيد عن مائة عام للعمل في ظل هذا النظام وتعديله أو إلغائه".

تناول المؤلف في الفصل الاول "ماضي" قاضي التحضير الذي طُبِق في مصر حقبة طويلة لا تقل عن مائة عام، مع استعراض الأسباب التي أدت إلى تبني المُشرِّع هذا النظام أو التردد في الإبقاء عليه أو تعديله أو إلغائه خلال تلك المدة الطويلة

وتناول في الفصل الثاني: "حاضر" نظام قاضي التحضير المتمثل في هيئة تحضير الدعوى أمام المحاكم الاقتصادية المنشأة بالقانون رقم 120 لسنة 2008؛ وإيضاح وجهات النظر المؤيدة والمعارضة لعودة العمل بهذا النظام مرة أخرى في الوقت الراهن.

يتناول المؤلف العمل بنظام قاضي التحضير في مصر وتطبيقاته وأهميته وتبني الحلول التشريعية الحديثة لنظام التحضير في المحاكم الاقتصادية المطبقة في مصر منذ 2008.

يحتوى المؤلف على فهرسة ببيولوغرافية، بالاضافة الى عدة ملاحق بدءاً من قانون المرافعات الأهلي الصادر في 13 نوفمبر 1883، وتعديلات قانون المرافعات المدنية والتجارية المتتابعة حتى الان.

Associate Professor of Civil and Commercial Procedure Law at the Faculty of Law, University of Al Buraimi, Oman, since September 2026, on secondment from my permanent position as Associate Professor and Head of the Department of Civil and Commercial Procedure Law at the Faculty of Law, Tanta University, Egypt.

I bring 20+ years of academic experience and 40+ publications spanning civil procedure, comparative law, and dispute resolution.

I hold a Ph.D. in Law from Tanta University (2015), following a Bachelor's degree earned first in class with Honors. My work bridges doctrinal Egyptian procedural law with comparative legal analysis across China, the United States, and the European Union. My peer-reviewed publications are indexed and documented on Web of Science. I am currently developing new research toward publication on emerging topics including AI copyright ownership, predictive justice in civil litigation, and the procedural protection of digital assets.
