Guardianships and the Elderly: The Perfect Crime

Imagine a system of justice in this country that strips its citizens of their Constitutional rights, voids their existing legal documents, gives others the right to spend their money and sell their assets, isolates them, and has the ability to limit the time they can spend with their loved ones. The book begins by looking at the history of guardianship―from ancient times till today. It then provides a clear overview of how this system is set up to work―from the triggers that set it off to the different groups of people that make up the the judges, the guardians, and all their associates. The book goes on to detail the responsibilities given to these players and describes how easily they can manipulate the system to their own advantage. It also presents an accurate picture of just how difficult it is to free a family member from the system. There are things loved ones can do to fight the system, to be sure, but many obstacles and pitfalls await them in the battle. This book is meant to prepare the reader for these eventualities and includes a comprehensive glossary, a helpful resource section, and a number of documents that may prove useful in the pursuit of real justice.

While the press has exposed some of the most heinous crimes committed by guardians, for the most part, those who know how to work the system continue to plunder their victims’ estates. Guardianships and the Elderly is designed to explain the guardianship process clearly and make the reader aware of the common violations carried out by court insiders and their affiliates. Florida author Sam Sugar, MD not only practices Internal Medicine to heal the ill, but he also has committed his passion for improving the evils of guardianship of the elderly as founder and president of Americans Against Probate Guardianship – a powerful organization designed to expose the corruption of our guardianship systems. He earned his MD from the Abraham Lincoln College of Medicine at the University of Illinois, Chicago and is certified by the American Board of Internal Medicine and is a fellow of the American College of Physicians. He has served as director for managed care at Evanston/Northwestern Healthcare and has been on the faculty for Northwestern University’s Feinberg School of Medicine and the Chicago Medical School.

This book is one of the most significant and important volumes that address a problem about which too few are aware – the crimes of the care of the elderly placed by courts in the realm of guardianship. Dr. Sugar not only exposes the truths of this tragic situation we have created but also takes us through the process of guardianship assignment and the corruption that seethes at the expense of the elderly and their resources.

In a significant chapter - The People in the Guardianship Industry – he states, ‘The guardianship industry is populated by a dizzying array of individuals and organizations. Each one is likely to be totally foreign to a ward and her family, yet they all have a hand in the way a loved one is treated and dealt with in guardianship. The sheer number of unfamiliar people in this system can be overwhelming. To both ward and family member, it is like suddenly entering an entirely new, bizarre universe in which she has no familiarity or control. Understanding who the inhabitants of this universe are and what they do, therefore, can prepare those affected by guardianship to deal with their possible consequences or even manage their outcomes.’

The only way to alter an existing condition and correct it is to understand the intricacies of that malfunctioning, criminal system. This is what Dr. Sugar offers in this disturbing by very important book.

This book is a must read for anyone with older parents--especially if they are at risk for manipulation by siblings or even 'well intentioned' community members. The tools available to help elders age well and be cared for can be used to harm them and their families.
