THE KANSAS CITY MOB WAR – GARY JENKINS’S GANGLAND WIRE

Gangland Wire Documentary by Gary Jenkins

THE KANSAS CITY MOB WAR – GARY JENKINS’S GANGLAND WIRE

Gary Jenkins is the producer to the DVD Gangland Wire. Gangland Wire is the documentary of the events that led up to and about operations Strawman I and Strawman II. Gary Jenkins has an insider view of Strawman, not only because he is the producer to Gangland Wire; but because he was an officer in the Kansas City Police Intelligence Unit that was listening to the wire that was recording the Kansas City Mob. If you have never heard of these two operations I am sure that you have seen them on the Big Screen, most famously in the movie CASINO.

Vincent Borelli played by Joseph Rigano

Vincent Borelli played by Joseph Rigano

If you recall in the movie CASINO played the role of Vincent Borelli. Vincent was the Kansas City Boss in the movie. Vincent Borelli was based on real life mobster Nicholas Civella. Nick Civella was the Boss of the Kansas City Family and the Kansas City Family reported back to the Chicago Outfit.  His Underboss Artie Piscano was played by . Artie Piscano was based on real life mobster Carl “Tuffy” DeLuna. He was the Underboss to the Kansas City Family. Carl DeLuna was trusted across the country by all the different La Cosa Nostra Families. That is why he was responsible to make sure that each family got there cut of the Las Vegas Skim. In the movie CASINO, Artie Piscano was raided by the FBI and he dies from having a heart attack. Before he dies the FBI finds his notes and was able to bring down the Outfit. The real Carl was raided by the FBI but he did not die on the spot from a heart attack. The FBI did find his notes but they were encrypted. They had to figure out what the notes meant by matching it up to recordings of the gangsters and other evidence.

It all starts around 1971 in an old deteriorating industrial area in Kansas City. An entrepreneur named Marion Trozollo started to buy up all the abandoned building and renovating them for inexpensive spaces for art galleries, shops, eateries, and other family friendly locations. This development was driven by an art colony attracted by the cheap rent offered by Marion Trozollo. This part of town was called the River Quay (pronounced Key).

One potential issue with this renovation was that it’s approximation to another part of town. It was adjacent to the City Market. It was not the shops in the City Market competing with the shops in River Quay as being the problem. The problem was that the City Market was run by the Kansas City Mob and its boss Nick Civella. This thriving development of the River Quay would be too much temptation for the mob to not get a taste of the action.

The River Quay.

The River Quay.

A bar was opened up in the River Quay. It was called Poor Freddie’s and it was the second bar to open there. The tavern owner was a man named Freddie Bonadonna. Like Trozollo, Bonadonna could see the great business potential that the River Quay held. He was one of the first to take advantage of the vision being built by Marion Trozollo.

There was another man named Joe Canizaro. He was a developer from the New Orleans area. He has experience from building in the French Quarter of a mix of residential, artist shops, retail, and a bar scene. He was called upon by Marion Trozollo to help fulfill the vision of the River Quay.

In Kansas City there was a desire to build a conference center and a hotel in the downtown area. To fulfill the building of the conference center and hotel a block of seedy bars and strip clubs on 12th Street would have to be torn down. The city invested the money and they tore down these locations on 12th Street. In the demolishing of these businesses it displaced members of the Kansas City Mob who have been running this area up until the tear down. These mobsters needed a place to go to regain their traction in their illegal enterprises. They now had their eye on the River Quay.

Nicholas Civella

Nicholas Civella

A location that was a place for hipsters to hang out was converted into a porno theater called the Old Chelsea Too. This was very out of place compared to the rest of the thriving shops in the River Quay area. Freddie Bonadonna knew that this opening would jeopardize the River Quay development. He wanted to make sure that the area would be kept clean and maintain the family friendly vibe that was so essential to the growth and productivity of this area. This would put him at odds with the Kansas City Family who had always made their living by selling vice.

Other bars started popping up in the area. These bars, like the Old Chelsea Too, were out of place and did not belong in the River Quay. Freddie Bonadonna was desperate in maintaining the integrity of what he started. He would start to play a very dangerous game. He was going to help these mobsters on the surface but behind the scenes do everything that he could to ensure their failure. What makes Freddie Bonadonna think that he can get away with trying to play such a dangerous game? He has an in with the mob. His father was David Bonadonna. A Made guy with the Kansas City mob, working for a man named Willie Cammisano or “Willie the Rat” a Capo in the Civella Family. He earned the name of “Willie the Rat,” because he would stick murder victims in the sewer so that the rats could eat them. Freddie’s father’s connection was a way in to give the perception to the mob that he was sincere with his offer to help. As the old adage goes keep your friends close, but keep your enemies closer.

Carl

Carl “Tuffy” DeLuna

Joe Canizaro bought out Marion Trozollo for the River Quay development. Freddie Bonadonna met with Joe Canizaro. He told Canizaro that he was going to introduce him to some people that were interested in building in the River Quay. You are going to tell them that you back them and support them. Once they leave we are going to do everything that we can to resist them.

Joseph Cammisano was the brother to “Willie the Rat.” He wanted to bring some Go-Go Girls down to the River Quay, but he couldn’t. He could not get a liquor license from a west side councilman. This councilman was a friend to Freddie Bonadonna. Joseph Cammisano was the leader of the other Kansas City mobsters that had their businesses on 12th Street. These gangsters were looking to the leadership of the Civella Family to handle and take care of the politicians and leverage their muscle to gain entry to the River Quay.

With all of the growth of the River Quay parking was scarce. Freddie Bonadonna had been leasing empty lots in the area from the city. It was great foresight on his part and became very lucrative. The city leased these lots cheaply to Bonadonna because they had no use of them and did not see the value in them like Freddie did. Soon enough Freddie Bonadonna was making a couple of thousand dollars each weekend. The Cammisano brothers wanted a cut of this cash money. They started asserting pressure and it was not before long that David Bonadonna was passing messages to his son that he needs to start helping these people and give them their cut. Freddie pleaded to his father that he did not want to help the Cammisano brothers nor did he want them in the River Quay. The father decided to take up for his son.

William

William “Willie the Rat” Cammisano

David Bonadonna went to Willie Cammisano and told him that his son did not want to help him or his brother Joe. Willie told David that he has to help them. David then told Willie that he was not going to force his son to help them establish businesses in the River Quay or give them a cut of the parking lot money. Cammisano told Bonadonna that his son could get hurt. Bonadonna said that if anyone was going to try and hurt his son Freddie they would have to go through him first. This put the two gangsters at odds with each other and forced a sit down with Willie Cammisano, David Bonadonna, and Nick Civella. At the sit down Civella did not broker a deal or offer a judgment to his warring constituents. He told them either to figure it out, or do whatever you have to do. A position Civella would later regret.

On July 22nd, 1976 about 30 days after that meeting with Civella and Cammisano, David Bonadonna was found dead in the trunk of a Mustang with five bullets to the head. Sonny Bowen, a man with a contract on his life for unrelated reasons and Gary Parker, a business partner of Freddie Bonadonna start to plan retribution for the murder of David Bonadonna. Freddie Bonadonna goes into hiding and the 12th Street gangsters started building Las Vegas like bars in the River Quay.

Sonny Bowen went on the attack and shot a Civella soldier named John Amaro or “Johnny Green.” Bowen killed this man in his garage which was also in the same neighborhood of Nick Civella, Carl Civella (Nick Civella’s brother), and Tony Civella (Carl Civella’s son). Mike Rufalo a soldier and confidential informant to the FBI were speaking to Sonny Bowen. Sonny Bowen admitted to Rufalo that he killed “Johnny Green.” He was hoping by telling Rufalo that Rufalo would flip and help Sonny take on the Civella Family. On the day for the wake of John Amaro, Sonny Bowen’s vehicle was seen outside of a bar called Pat O’Brien’s in mid-town Kansas City. On February 22nd, 1977 Bowen was murdered and shot to death in front of everyone. The Civella Family has also believed that Gary Parker also had a role in the murder of John Amaro. Later on August 5th, 1977 Gary Parker died from injuries he received after bomb was placed and exploded underneath his car.

Sonny Bowen Grave

On March 27th, 1977 after everyone from the River Quay went home for the night there was a large explosion. It was Pat O’Brien’s and Judge Roy Bean taverns that have exploded. Where the taverns once stood a 20 foot hole now exists. This is the end of the River Quay. Nick Civella knows that keeping a low key is critical in staying off the radar of the Feds. Now there were multiple murders and a couple of buildings that were blown up and all for what? Parking lot money!

Nick Civella was battling cancer and was heading off to jail for a gambling conviction so he stepped back. His brother Carl “Cork” Civella was going to step in for his brother. His brother got the knick name “Cork” because of his temper. His temper would rise and it would pop off like a cork. Nick Civella and “Willie the Rat” Cammisano were not close, but “Cork” Civella and “Willie the Rat” saw things eye to eye. However there was an order to put on the backburner any murder or acts of violence due to the fact that this would become front page news.

Newspaper River Quay Bombings

Newspaper River Quay Bombings

Carl Spero a rival gangster was seeing the disarray of the Civella Family; and saw this as an opportunity to take revenge for the murder of his brother Nick who was a Teamster member. He and his other brothers Joe and Michael were trying to take over the Civella Family. They would do anything to taunt or disrupt the Family’s operation. Carl Spero had one of his guys robbed the Brandmeyer & Civella Meat Company. This was easily traced back to Spero. The Spero brothers were all shot at the Virginia Tavern. Michael Spero was killed, Carl Spero was fighting for his life but paralyzed, and Joseph Spero was hit but less seriously wounded. Carl Spero was found shot gunned in the back lying in the street. When the police arrived they asked “Carl do you know who did this?” He said “Yeah.” The police than asked “Are you going to tell us who did it?” Spero said “No.” Both Joseph and Carl would later be killed by bombs that they were making to exact their revenge.

With Kansas City going to hell in a hand basket at the hand of the Civella Family the feds are hearing that “Cork” Civella and Underboss “Tuffy” DeLuna were planning more murders. They were told that the planning would take place at a bar called The Villa Capri. The feds planted a wire in this location. When the feds started listening to what was being picked up by the wire, they heard a lot of disco music. What they don’t hear is anything about the Spero brothers, or anything related to the River Quay or any other murders. What they do hear is them talking about Las Vegas, Teamsters, and skimming.

What the wire started to reveal was that Carl “Tuffy” DeLuna was receiving money that was being skimmed from Las Vegas Casinos that were controlled by the Chicago Outfit. Other crime families had interest in the Las Vegas skim as well. The learned that DeLuna was getting the cash from the casinos, taking the share for Kansas City and sending it back to Chicago, Milwaukee, and Cleveland. It was “Tuffy’s” job to get the money back to these Families. The feds were expecting to find out information on the mob in Kansas City and instead learn about what the Midwest mobsters were doing in Las Vegas for years. The Las Vegas skim by the La Cosa Nostra has been uncovered.

Gary Jenkins’s Gangland Wire has over two hours’ worth of mob history. Rarely do I get a book or a DVD that I learn something new about the Chicago Outfit, but that was not the case with this DVD. Jenkins’s tell the story of the River Quay and then spends another hour going over the actual wire taps that led to the Strawman Operations. These wire taps were incredible in the information that was uncovered. You hear Joe Agosto reporting back to Kansas City about “Genius.” That was Alan Glick the front man for the Chicago Outfit. His company the Argent Corporation owned the Outfit’s casinos, the Stardust, the Marina, the Hacienda, and the Fremont. He was only a Strawman (clean guy that was a front for the mob), hence the name of the operations that took down the mob in Las Vegas. You get insight to what the Kansas City Family thought about Frank “Lefty” Rosenthal and who may have placed a bomb in his car at Tony Roma’s in Las Vegas. Was it Tony Spilotro or the Chicago Outfit? Maybe not. Joey “The Clown” Lombardo calls Morris Shenker, an attorney and casino owner, and tells him that he will not make it to 73. Was Rosenthal a loyal tight lip odds maker running the Outfit’s casinos, or was he confidential informant? If you are mob historian always looking to learn more about mob history or you just enjoy all things mob, Gangland Wire flips the bill for everyone. Get Gangland Wire and get the insider’s view of taking down the Las Cosa Nostra’s hold on Las Vegas!

KNOWLEDGE CENTER

I have put together some of the articles that I have written that are prevalent for the upcoming election in MARCH!. This is the Republican Nominee election but probably more important than the general election. It is most likely the winner in March will win in November and become sheriff. If you review the articles in the Knowledge Center, you will read all kinds of unbelievable things as it relates to this election.

My mother and father, Ron and Kathy Scharff, 1969.

Freedom of Information Act Appeal to get the remainder of my father’s file. In my efforts to get to the bottom of my father’s murder and what the McHenry County Sheriff’s office has done to me and my family 33 years ago. I filed a FOIA Request (Freedom of Information Act Request) to get my father’s case file. Many documents were withheld from my request. It is my believe the documents are withheld to protect guilty individuals that are known to Sheriff Keith Nygren and Undersheriff Andrew Zinke that covered up who actually killed my father during the original investigation. Start on page 11 to read what sounds like a murder mystery thriller, but this is my true life. It is backed by FBI reports, witness statements, and newspaper articles.

Undersheriff Andrew Zinke and the Rita Corporation on RT 31Andrew Zinke for McHenry County Sheriff, Really??? This article is based on my own father’s murder investigation and Undersheriff Andrew Zinke. I talked about how he made his own milestones and failed to meet every single one. How it took me calling NBC News Chicago to get Andrew Zinke to return my phone call about my father’s murder investigation, as he was the lead investigator. I am fighting to get the remainder of my father’s case file. It is my believe that Undersheriff Andrew Zinke and the Sheriff Keith Nygren are hiding and protecting individuals that covered up the true killer of my father during the original investigation.

Undersheriff Andrew Zinke and the Rita Corporation on RT 31Andrew Zinke plus Rita Corporation equals ON THE TAKE Brian Goode and his RITA Corporation was a person of interest and focal point for the investigation of the distribution of 30 plus tons of marijuana. Undersheriff Andrew Zinke told Brian Goode of the investigation. Two days later, according to Koziol, (Sgt. Koziol was working on the investigation and filed a complaint against Zinke) Goode gave Zinke’s election campaign a $5,000 donation. The RITA Corporation address is the same address as Andrew Zinke’s campaign headquarters.

Deputy Zane SeiplerMcHenry County Deputy Zane Seipler under siege, Again!! Zane Seipler is a whistleblowing deputy that was fired by Keith Nygren after he exposed the sheriff’s office for racial profiling. Nygren was forced to hire Seipler back after he lost an arbitration ruling, a court hearing, an appellate court hearing, and a failed attempt to be heard by the Illinois State Supreme Court. After Seipler was hired back, Nygren fired him again. Zane Seipler is currently fighting to get his job back.

Deputy Scott Milliman in uniform.

Another McHenry County Deputy under siege, Scott Milliman Scott Milliman was a deputy and former right hand man to Sheriff Keith Nygren. He was fired by the sheriff for whistleblowing that the sheriff allegedly transacted in ticket fixing, bribery, general corruption, fraud in a SBA Loan, and in tapping Milliman himself to kill a McHenry County Judge and a Coroner’s Candidate. Scott Milliman is currently fighting to get his job back.

Gary Gauger, of Richmond, was wrongly convicted of murdering his parents in 1993 and sentenced to death. After years in prison his sentence was overturned and two gang members were later convicted of the murders. Gauger is released a book detailing the event called IN SPITE OF THE SYSTEM. (Ryan Rayburn photo)

How Gary Gauger got to DEATH ROW This is the real life, tragic story of Gary Gauger. He was falsely arrested and sent to Death Row by the McHenry County Sheriff’s Department for the double murder of his parents. Investigators from the sheriff’s department rigged a false confession so that they could convict him.

Undersheriff Andrew Zinke giving Cal Skinner the finger at the 4th of July Parade in Crystal Lake, IL.

McHenry County Ethics Commission, Ethical or NOT!?!? The McHenry County Ethics Commission conducted a hearing of a complaint filed by Cal Skinner that Undersheriff Andrew Zinke used a government computer for a very politically charged email. The hearing was ran over by Zinke’s attorneys Mark Gummerson and Rebecca Lee. The sign up sheet to speak at the hearing went missing but found in the possession of Rebecca Lee. The commission went into secret session, made its decision, and did so without explanation.

Pete Gonigam, publisher of the First Electric Newspaper.

First Electric Newspaper v.s. Sheriff Nygren and EEO Officer Donald Leist Pete Gonigam won a Public Access Bureau (Illinois States Attorney) appeal for the release of a 100 page report conducted by the McHenry County Sheriff’s office. The report exonerated Undersheriff Andrew Zinke after he told Brian Goode that he and his RITA Corporation was a the focal point of a drug investigation by the DEA.

Undersheriff Andrew Zinke giving Cal Skinner the finger at the 4th of July Parade in Crystal Lake, IL.

Zinke’s middle finger may cost Cal Skinner $5,000 After filing a valid ethics complaint against Undersheriff Andrew Zinke for using a government computer for his campaign, Cal Skinner was to face Zinke’s attorney Mark Gummerson. Gummerson was lobbying for a $5,000 fine against Skinner filing a valid complaint. An act of bulling and intimidation of a McHenry County citizen.

Local 150 International Union of Operating Engineers

Will McHenry County be Ripped Off by Special Interest in Sheriff Election? I question the interest and the contribution to Undersheriff Andrew Zinke’s campaign from the International Union of Operating Engineers, Local 150 election. I send a letter to the President-Business Manager of the union James M. Sweeney.

Undersheriff Andrew Zinke Shuts Down Cal Skinner’s Blog Site Undersheriff Andrew Zinke’s campaign was able to get Cal Skinner’s website, mchenrycountyblog.com shut down by falsely accusing him of stalking and linking to obscene material. Read here on how Zinke’s campaign resorts to breaking the law to silence a citizen’s voice.

Zinke-looking-right-eyes-at-cameraAndrew Zinke Fearful to Debate Bill Prim Lies to Get Out of It. Undersheriff Andrew Zinke is so fearful to debate Bill Prim for McHenry County Sheriff that he lies to get out of it. Zinke knows that he would be out matched, outwitted, and the truth of his corrupt character would be revealed to the citizens of McHenry County. Instead of enduring such damage to his campaign he lies to coward out of it.

Sheriff Keith Nygren

Is Sheriff Nygren and Undersheriff Zinke Intimidating and Tampering with Federal Witnesses? Is Sheriff Nygren and Undersheriff Zinke intimidating federal witnesses? Or are the deputies fighting back? Donald Leist, the sheriff’s in house lawyer sent a letter to 30 deputies and correctional officers to be interrogated prior to their depositions in a federal case. Would that work anywhere else in the US or just McHerny County?

A McHenry County Deputy is No Longer Under Siege

A McHenry County Deputy is No Longer Under Siege
Seipler-hold-up-loose-leaf-notebook-re-corruption

Former McHenry County Sheriff Deputy Zane Seipler holds up a binder that he says proves that Sheriff Keith Nygren is corrupt.

Last year I told you a story about former McHenry County Deputy Zane Seipler being under sieged by his former boss McHenry County Sheriff Keith Nygren. You can read the article here McHenry County Deputy Zane Seipler under siege, Again!! Without rehashing the article you have to go back to 2008. If you have not been following my father’s story I write to bring truth and shed light on the McHenry County Sheriff Office. They tried covering up that it was Larry Neumann that killed my father 33 years ago. He was a mob associate to the Chicago Outfit and the lead investigator, Sheriff George Hendle was connected to the Outfit . Today they try to keep hidden those that were involved at the sheriff’s office in this betrayal. I am not the only one that brings truth and light on MCSO.

In 2008 than Deputy Zane Seipler was fired from the McHenry County Sheriff’s Office. This happened after Deputy Seipler went to the FBI and charged that McHenry County Deputies were racially profiling Hispanics. He went to the FBI after his superiors at the MCSO did nothing with the information. A charge that was later backed by the Chicago Tribune when they did a study and found that according to the records at the McHenry County Sheriff’s office that Pedro Lopez is not Hispanic. Neither is Jose Salas. Or Pablo Toxqui-Zavala. The article Study suggests racial mislabeling skews McHenry County sheriff data revealed by going through tickets written by the sheriff’s office that Hispanics were labeled as being white. This all led to Seipler filing a wrongful termination suit against Nygren and the MCSO. That is when things get interesting real quick.

McHenry County Sheriff Keith Nygren and Deputy Scott Milliman during better times.

McHenry County Sheriff Keith Nygren and Deputy Scott Milliman during better times.

This led to depositions outlining not only racial profiling but all kinds of corruption at the McHenry County Sheriff’s Office. This even included allegation by former Deputy Scott Milliman. He was a former bagman to Sheriff Keith Nygren and was tapped by the Sheriff to kill Judge Conrad Floeter and former Coroner’s Candidate Dave Bachmann. This also led to Deputy Scott Milliman being terminated from the MCSO and his own wrongful termination suit. Here is my article on Scott Milliman and his wrongful termination case Another McHenry County Deputy under siege, Scott Milliman.

Seipler fought Nygren’s termination through arbitration and won. Nygren then took it to Circuit Court and the Circuit Court upheld the arbitrator’s decision. Nygren appealed to the Appellate Court and the appellate court upheld the previous two decisions. Nygren lost all three legal rounds, but his arrogance and his spending taxpayer dollars did not stop. He tried taking this to the Illinois Supreme Court. Luckily for taxpayers the court said that Nygren had already three decisions that he was wrong and a fourth would not be necessary. Nygren was forced to hire Seipler back only to fire him again months later. The wrongful termination case continued and even Nygren’s own lawyer expected that Nygren was going to be forced to hire him back again.

Posse_PateAs the case was moving through the system Seipler ran a blog where he would release documents that supported the wrongdoing and corruption of the MCSO. Judge Frederick Kapala order Seipler to stop posting these documents online and to the public. Rose Seipler, Zane’s wife, felt that her family was at risk of great harm or worse from Sheriff Keith Nygren and his Posse’ (Nygren actually has a group of deputies that call themselves “Nygren’s Posse’). Rose Seipler would continue to post these documents online feeling that the more the public was armed with the knowledge of the corruption of MCSO the safer her family would be. This caused a lot of problems with the Judge.

Judge Frederick Kapala

Judge Frederick Kapala

The Judge did not believe that Zane Seipler did not post these articles online. Two years later after the postings were made Judge Frederick Kapala thought that he had a way to get to the bottom of this. He asked in court for Rose Seipler to show the court how she posted these documents online. She could not remember how she posted these documents so the Judge stated that he felt that she and Zane had lied. I can tell you personally as an avid blogger that this was a bad litmus test for the truth. Even if Rose Seipler had remembered what she did, she still would have been extremely challenged by the software updates that occur on a monthly basis. I had one software update that took me 15 minutes to realize that nothing had changed, it was only a graphical interface update; and I am a blogger and do technical support for a living. Ultimately this resulted in a $240,000 judgment against Seipler to pay back to Nygren.

This tug of war had been going on for over six years with no end in sight. Sheriff Keith Nygren was not going to let Seipler get the best of him and the Regime; and Zane Seipler was not going to let Nygren get away with countless acts of corruption alleged by Seipler and others. This was taking a HUGE toll both financially and emotionally on Zane and his family.

There was a huge breakthrough on the impasse of this case in May and June of this year. It was agreed to allow Seipler to dismiss his case and in return Seipler’s work status was changed from terminated to resigned and the Seipler’s would not have to pay the $240,000 judgment to Nygren.

Sheriff Keith Nygren

McHenry County Sheriff Keith Nygren

While Sheriff Keith Nygren gloats that he is exonerated of wrongdoing and the Northwest Herald suggests Nygren for Sainthood, Zane Seipler is unhappy with this outcome. He believes that he and the community of McHenry County were denied truth and accountability. Seipler has over two crates worth of documents that he says proves the corruption that exists of Sheriff Keith Nygren and his Regime commanded Sheriff’s Office. I get it! It is understood that all the truths should be told of Sheriff Keith Nygren, of his Posse’, and the Regime.

But at the same time…Relax my brother you did good. You have done more than your fair share in doing what is right and standing up against the Regime. It is time for you to focus on you and your family. Now it is time to let others come forward and carry the torch. Find great solace that without your efforts that the corruption and the victimization by Sheriff Keith Nygren and the McHenry County Sheriff’s Office are known and are in the public conscious. You paved the way for Scott Milliman to be heard as his case moves through the system. You helped me prep the good people of McHenry County to hear my father’s story on how the Regime help cover up for the murderer of my father and how it is very likely that the Regime is covering up facts today. You helped by not allowing the pain of victims of McHenry County like Gary Gauger go in vain. You helped permeate the fabric of the community to foster change which the community paid back my knocking out Regime favorite for McHenry County Sheriff, Undersheriff Andrew Zinke and voting for Bill Prim. It took decades upon decades for the Regime to be built, so it would suffice to say that it will take time and effort to collapse it. You and your family survived and now you have the wind at your backs. Do not underestimate what you took on; it did not have to turn out so favorably this way. Thank you for the job that was well done.

Here is a press release from Zane Seipler in his own words about the dismissal.

Former McHenry County Deputy Zane Seipler

Former McHenry County Deputy Zane Seipler

Since very few “news” entities have asked for my side of the settlement story I have drafted this statement that the McHenry County Blog was willing to post. Earlier this month I entered into a settlement agreement that amounts to a Quid Pro Quo resolution to the Federal lawsuit I filed in 2008.

As many of you know a Federal Judge wrote an opinion that stated I gave perjurious testimony during an evidentiary hearing regarding the internet posting of evidence that highlighted McHenry County deputies and their involvement in incidents that many people would categorize as crimes.

I did not give perjurious testimony. The Judge heard evidence presented by both sides’ attorneys and under the “Preponderance of the Evidence” standard which is the prerequisite in this type of civil hearing, the Judge authored an opinion. The Preponderance of the Evidence standard is well below the threshold of “Beyond a Reasonable Doubt” which is used for criminal cases.

McHenry County, having unlimited resources, was able to hire a superior law firm to handle this case. I, unfortunately, was at a disadvantage from the beginning of this endeavor, as I have very little, if any resources, capable of competing in such an arena. Mistakes were made leading up to and during the evidentiary hearing that led the Judge to his conclusion.

The Judge was asked by the County’s attorney to authorize a criminal investigation into my statements. The Judge denied that request and instead levied a heavy fine. It was my deepest desire that a criminal investigation would have taken place because I would have been able to present all the evidence I have acquired over the years and entered it into evidence as part of my defense. I also would have been tried by a jury of my peers.

I did not have the resources to appeal the Judge’s ruling. The next step of the process was to argue why the case should continue to trial. The County’s attorney was going to ask that the case be dismissed until I could pay the fine.

If the Judge ruled in favor of the County the case would be dismissed or held in some state of judicial limbo until I could pay the fine.

Why did the County decide to settle?

The other possibility was that the Judge would send the case to trial and I would pay the fine later. The County’s attorneys did not want to take that chance that this case would go to trial and the evidence would be made public.

I did not want to chance another disastrous outcome as I did in the evidentiary hearing.

An arrangement was made that alleviated me of all financial responsibilities and the County made an arrangement that alleviated them of any guilt.

Quid Pro Quo.

Outgoing Sheriff Keith Nygren claims this Quid Pro Quo settlement agreement is some kind of victory and vindication to my allegations of racial profiling and officer misconduct. The fact of the matter is the County’s attorneys did not want this case going to trial because they would lose.

That is why the County and Keith Nygren made a deal with me that not only alleviated a $240,000 fine but vacated the ruling all together. The County also agreed to let me keep $26,000 in unemployment benefits. The County agreed to change my employment status from “terminated” to “resigned” and provide me with a letter of recommendation in accordance with County procedure.

Here are the costs of Outgoing Sheriff Nygren’s alleged victory over Zane Seipler.

$100,000 to the County in lawyer fees plus adjustment on insurance premiums.
Unknown hourly wages for all the deputies and commanders who were deposed.
Unknown travel expenses.
Total breakdown in the administrative system of deputy oppression.
National recognition of Nygren’s mismanaged administration by the Chicago Tribune.
The catalyst for a grass roots political uprising against a system of corruption that Outgoing Sheriff Keith Nygren was a fundamental part of creating.
$276,000 in back pay and unemployment payments.
$240,000 that will never find its way back to the taxpayers.
The catalyst for Deputy Scott Millman’s ongoing lawsuit that highlights criminal activities far worse than racial profiling.
Continuous scrutiny by the County Board and the community into Keith Nygren’s grandiose claims of success and accomplishment.

Outgoing Sheriff Nygren didn’t win anything. He was able to use taxpayer resources to thwart a civil trial that would have completely destroyed his legacy and the careers of a handful of his administrators.

There is no victory for Outgoing Sheriff Keith Nygren. His handpicked successor, Deputy Zinke lost the election. His political allies have jumped off the Nygren bandwagon and have rightly begun supporting a good man, Republican Candidate for Sheriff Bill Prim.

Before long Outgoing Sheriff Nygren will be a distant memory of a time in McHenry County when people were afraid to challenge a bully and stand up to Good Ole Boy politics.

I am proud that I had a hand in ushering Nygren and his regime out of power.

The commission went into secret session, made its decision, and did so without explanation.

Where We’ve Been, Where are We Going, and MOB CON 2014

Paul Scharff and candidate for McHenry County Sheriff Bill Prim at Walla Pa Looza Cancer benefit in July of 2013.

I am back from a much needed writing break to fill you in with updates on the Republican Primary for McHenry County Sheriff and Mob Con 2014. If you have been following me about my father’s story of his murder back in 1981 it started with Chicago Outfit and moved us to the McHenry County Sheriff election in 2014. Let’s start with a Big Congratulations to the citizens of McHenry County for a job well done.

I am very proud to say that I’m part of the community of McHenry County. We saw a problem and we acted on it because we all pulled together. We all helped Bill Prim beat Undersheriff Andrew Zinke in the Republican Primary for McHenry County Sheriff. It was a very tight race with an official win by Bill Prim by 97 votes. The Undersheriff had asked for a soft recount. A soft recount is when you select a partial recount of precincts by paying $10 per precinct. You are limited to the number of precincts and a full recount can only be ordered by a judge. The soft count changed I believe 4 votes and that was it. Andrew Zinke was voted out of the Republican Primary and will not have an opportunity to become sheriff in this election. We all should be proud and the citizens of McHenry County should be excited about the proposition for change in our county law enforcement.

Our efforts were noted by the Chicago Tribune. At one point in the article reporter Bob McCoppin focused on the impact of bloggers.

Lou Bianchi answered,

“Did bloggers have an effect? Of course they did.

“There’s no question that if (everyone) didn’t do their part, Bill would not have won.”

Prim’s comment:

“They certainly helped, because we had a difficult time with the mainstream media getting our message out.”

Prim-Trib-3-21-14

The bloggers were not mentioned by name but I am sure that I have them figured out and I will mention them here.

Cal Skinner of the MchenryCountyBlog.com, Gus Philpott of the WoodstockAdvocate.com, Pete Gonigam of the FirstElectricNewspaper.com, and Zane Seipler’s website zinke4sheriff.com (he was not a supporter of Zinke, the name got his website higher in the search results when searching “Zinke” that is why he did it). Not only did I want to mention them but I want to thank them for their passion and steadfast devotion to the truth. We should be able to depend on the Northwest Herald for what these men do but you can’t. The Northwest Herald is more about serving its agenda than the duty of being the paper of the people. Another thing that is important to note is that all of us worked independently of each other. Other than Cal Skinner, I did not even know of Gus Philpott, Zane Seipler, or Pete Gonigam. I knew of Cal because he wrote an article about my father’s case in 2008 or 2009. If anything appeared coordinated by us, it was purely coincidence. Our message was consistent because the citizens of McHenry County were being hijacked by corruption.

During the month of March which was the election primary, my website McHenryCounty1981.com had a lot of traffic and pages turned. The numbers for March were 7,582 unique visitors, and 21,408 visits; but the most impressive number was the number of pages that were looked at. The previous record number was 84,314 pages turned in a month that was real close to the high for unique visits and total visits. The number of pages was 120,469 for the month of March. I was blown away and could see the articles that I have written about Undersheriff Andrew Zinke by far were the most read articles on my site. Another uptick was the membership of the Murder In McHenry facebook group which broke 1,000 members in March to its current membership of 1,041 members.

What’s next? We still have the general election for McHenry County Sheriff in November. This is the race that will elect the next sheriff. The former Des Plaines Police Commander Bill Prim will face Woodstock attorney Jim Harrison. Harrison first had to obtain over 6,000 signatures to get in the election and more to beat any voter challenges by Prim. He offended a lot of people getting his signatures. He had volunteers collecting signatures outside of cemeteries on Memorial Day after the public had attended Memorial Day Services. Many had felt this was offensive and disrespectful to fallen veterans and those in attendance of the service. Harrison addressed the issue with a written statement that was not exactly apologetic to those that were offended. You can read the statement here at the mchenrycountyblog.com.

Harrison will have a few challenges running against Prim. Running as an Independent in McHenry County will be huge in this Republican dominated county. He will also have to overcome hurdles working for former McHenry County States Attorney Gary Pack. Gary Pack was the McHenry County States Attorney during the false conviction of Gary Gauger for the double murder of his parents that sent him to Illinois’s Death Row. You can read my article How Gary Gauger got to DEATH ROW here. Don’t take off your packs yet McHenry County; it would be silly to do all of this hard work to blow it in the end. We must take Bill Prim all the way to seat of McHenry County Sheriff.

Do you want to go to Vegas? Let’s go and join me in Las Vegas on September on the 28th and 29th for MOB CON 2014. MOB CON 2013 was the very first MOB CON and the very first event of its kind. It was a huge success with the panelists, the vendors, and all those that attended. This year is expected to be even Bigger and Better with more guests scheduled this year than last year. I am so excited that I am one of the guest speakers this year. Some of the guest speakers this year will be Frank Cullotta, Dennis Arnoldy, and Dennis (Denny) Griffin. All of these men were instrumental is getting Larry Neumann named as the killer of my father Ron Scharff and his employee Patricia Freeman. There will be more guests, prize giveaways, and much, much more so get your tickets and go! Join me and rub elbows with the mobsters who ran Las Vegas and live to tell about it. Click here if you got the guts to go to this Live Two Day Event.

Hi I am Dave Bachmann and Sheriff Keith Nygren wants me DEAD

Dave Bachmann is a former McHenry County Coroner Candidate that unsuccessfully ran for coroner in 2008. Allegedly Sheriff Keith Nygren wanted Dave Bachmann dead, and asked former Deputy Scott Milliman to kill him. I will explain how Bachmann was added to Nygren’s hit list along with now deceased McHenry County Judge Conrad Floeter (Judge Floter died of natural causes) in just a minute.

Due to the Primary Election this Tuesday my article this week is a couple of days early. It is do or die time for the citizens of McHenry County. You are being asked to participate in the most important election that McHenry County has seen in decades. The McHenry County Sheriff’s Republican Primary is being held Tuesday March 18th, 2014. If you typically stand on the sidelines and only vote in the general election, you will be making a big mistake. The Republican Primary is expected to elect the next Sheriff of McHenry County and the general election will be more of a formality of actually electing the next sheriff. The election comes down to Undersheriff Andrew Zinke and former Des Plaines Police Commander Bill Prim.  I have spent a lot of time this past year pulling information together so that you all can make an informed decision on the election Tuesday. I am hoping that you raise the bar for what is demanded from our law enforcement in McHenry County and to change the face and attitude of the McHenry County Sheriff’s office to reflect more closely to its citizens.  Now it is up to you to decide our fate, so please make it count.

Dave Bachmann is a long time McHenry County resident. He moved out to Crystal Lake in 1969 with his mother, father, two sisters and one brother. His father was the former Chief Financial Officer for the Black Dot Group, which owned Graftec Press. Dave Bachmann pursued a career in the Funeral Industry. As a young man he got his start at Salerno and Son’s Funeral Home. If you recognize this name it is because you have heard of this funeral home from me. This is where my father was laid to wake and Bachmann was there. In 1987 Dave Bachmann built his own funeral home in Crystal Lake and called it Bachmann Funeral Home. He has given back to his community by serving as the President of the Crystal Lake Kiwanis from 1989 to 1990. In 2008 Dave Bachmann embarked on a campaign to become coroner for McHenry County. His platform was to provide better oversight and more outreach to the citizens of McHenry County in the matter of death.

Former Deputy Greg Pyle. Arrested for ten counts of predatory criminal sexual assault on a child

What Bachmann may be better known for his website that over the years appears, and disappears, and re-appears again called Dirty Keith vs Dirty Harry or http://dirtykeithvsdirtyharry3.blogspot.com/.  As of this writing this website is currently up. The main character of his website is Sheriff Keith Nygren. On the website Dave Bachmann revealed that he was working for the Department of Justice while he was in Mexico. He put his investigative skills to work on his website. He went over some of the transaction between Sheriff Keith Nygren, Jose Rivera, and Home State Bank. In his blog he alleged banking improprieties, and even catching Sheriff Keith Nygren in claiming two Homestead exemptions in Illinois and Florida. He wrote about deputies that are in Sheriff Keith Nygren’s “Posse” (Posse is a reference used by Nygren and his inner circle). He wrote about a deputy who was exposing himself to his neighbor. He even warned everyone about Deputy Greg Pyle. He noticed warning signs in the conduct and behavior of this deputy. He was correct. Deputy Pyle is now inmate Pyle in the Boone County jail in Rockford. He was arrested for ten counts of predatory criminal sexual assault on a child (under age 13 and a family member), he was an Internet Crimes Against Children Task Force Member. This in itself did not earn Bachmann making Nygren’s hit list.

The“McHenry County Combine” according to Bachmann of Al Jourdan, Sheriff Keith Nygren, and now deceased Phil Pagano

The“McHenry County Combine” according to Bachmann of Al Jourdan, Sheriff Keith Nygren, and now deceased Phil Pagano

Bachmann wrote about things that he believed were sanctioned or negligent by Sheriff Nygren for not taking action. In an article he talks about an illegal horse track in Union, IL. He suggests that the Sheriff Nygren provided security to the illegal races. He also talked about who he believes is calling the shots. He refers to the power brokers as the “McHenry County Combine.” It is in the same reference that I use when referring to the “Regime.” Bachmann believes that it is well connected McHenry County politician Al Jourdan, his good friend Phil Pagano and Sheriff Keith Nygren are the power brokers. Phil Pagano was a Metra executive who committed suicide after being charged with embezzling money from Metro. There certainly some bizarre circumstances leading up to Pagano’s demise. He also goes into the history of certain businesses in Crystal Lake. He suggested that old Martinetti’s hotel and restaurant in Crystal Lake operated as a brothel. After the building was torn down illegal card games would appear at John Evans Inn/formerly known as Czecho Lodge and the games were frequented by then Crystal Lake Police Chief Keith Nygren. Another story pertains to former deputy Scott Milliman who wore a wire for the FBI for a couple of years. He has uncovered and exposed so many things. One story stands out to me about when Milliman came across is children being abused in McHenry County.

Phil Pagano lays dead on the tracks after an apparent suicide.

Phil Pagano lays dead on the tracks after an apparent suicide.

Bachmann tells how Deputy Scott Milliman was on duty one night and some kids were reported to be stealing food from a convenience store because they have not eaten in days. In this story it was reported that they were living in a basement under dungeon like conditions allegedly strapped down by their wrist and ankles to concrete blocks. Milliman took the kids to a hospital in McHenry County and the doctor checking the children confirmed that they were being abused. Milliman then started to do some paper work to get the kids out of the hands of their foster care but when he told Sheriff Keith Nygren, he responded to Milliman, “If you report this, I will squash you like a F@#%ing grape!” There are many stories like these that alleges some of the worse evil that occurs in McHenry County. This is why Bachmann believes why the sheriff put a hit out on him. Bachmann even wrote about this event on his website. There is so much more! You need to check out the website right now as you never know when Dave Bachmann will take it back down. Here is a link to the site Dirty Keith vs Dirty Harry.

McHenry County Sheriff Keith Nygren and Deputy Scott Milliman during better times.

The stories seem outrageous and would seem that they could not happen in our sleepy little community of McHenry County, but they are consistent to what we know to be true. Many of the stories told are actually going to be heard in Federal Court during the wrongful termination case of Scott Milliman, you can read more in my article Another McHenry County Deputy under siege, Scott Milliman. Like many of us, Dave Bachmann had some personal insight to what goes on at the McHenry County Sheriff’s office and McHenry County government. He was outraged and was compelled to tell the citizens of McHenry County. He tells these stories at a great cost. His has endured threats, moved him and his family out of McHenry County, and has exasperated his already serious health condition. Bachmann has gained nothing by telling what he believes to be the truth. Match them up to what you know that is true and in the public domain. As disturbing as it all is, it is all very consistent with what we all know.

Dave Bachmann wanted to reach out to everyone and give the citizens of McHenry County a message to support Bill Prim for Sheriff of McHenry County. Here is the message that Dave Bachmann forwarded to me along with the video.

Folks, as you know we are facing the most vital election in recent memory as it relates to our county Sheriffs Department.

Although I am presently very ill, (I am sorry for my appearance in this video) I believe we should all do what we can to get our message out.

If you see fit, would you please sent this message out to as many as possible. Feel free to use it any way you see fit.

Your Friend in all things good, in Justice!

Dave Bachmann

Zinke felt Threatened by a 78 Year Old Woman and His Campaign Manager may be an Internet Troll

Undersheriff Andrew Zinke and the Rita Corporation on RT 31

Undersheriff Andrew Zinke and the Rita Corporation on RT 31

Undersheriff Andrew Zinke got himself in trouble again. While being served a subpoena in January of this year, Zinke now has to go in front of a Federal Judge to explain his behavior. He was served a Summons on March 7th and is being sued by the processor server of the subpoena.  If that was not enough, some new information came from McHenry County States Attorney Lou Bianchi about a case that he brought forward. On his own dime, Bianchi is suing an internet troll that was calling themselves “Fukoku Kyohei” for slander. I also have been a target of “Fukoku Kyohei” and so has McHenry County Sheriff candidate Bill Prim. Bianchi traced the IP address of “Fukoku Kyohei” to Oak Star Property Management. The officers of Oak Start Property Management are Robert and Tamara DeModica. Tamara also happens to be Undersheriff Andrew Zinke’s campaign manager.

In the summons it states that on January 13th, 2014 a process server went to Undersheriff Andrew Zinke’s house to serve him a subpoena for a deposition. The process server is a 78 year old woman with a bad hip named Sondra Matterness. The summons states that Zinke was aware of the case and the subpoena but refused to accept the envelope with the subpoena inside of it. Ms. Matterness offered the Undersheriff the option to hand him the subpoena or it to be tossed at his feet. Zinke optioned the latter so Ms. Matterness through the envelope at his feet. Zinke opened up the envelope and became very angry. The court paper’s state “Zinke in an indignant rage raced into the street in his stocking feet and approached Plaintiff’s automobile positioning himself in front of Plaintiff’s Vehicle.” It says that he is in stockings outside in the snow were it is -3 degrees outside. While he is in front of Ms. Matterness’s vehicle he is noting her license plate and did not move for a couple of minutes preventing Ms. Matterness from leaving. It states that he finally leaves and struts back into his home. This all was written in the court papers for this federal case.

Undersheriff Andrew Zinke giving the finger at the Crystal Lake 4th of July parade.

We all can see that this behavior is uncalled for by anyone. We are talking about a 78 year old woman with a bad hip, why would anyone think that it is ok to take our bad day out on her. However this behavior is much more unbecoming of a law enforcement officer, especially for the second highest ranking officer in the county. While I was in the US Marines, I conducted myself in the manner that I wanted my Marines to conduct themselves. As their leader they would look to me as an example. From the example set by Andrew Zinke it is ok to freak out at the process server, even if it is a 78 year old lady with a bad hip. I am loathing the behavior of a uniformed person treating an elderly person in such a way.

As bad as Andrew Zinke’s behavior was, that is not why he is being sued in Federal Court. He is being sued in Federal Court because of what he did with the license plate that he noted on Ms. Matterness’s vehicle. Either Zinke himself or Zinke caused that license plate to be run against the LEADS database. LEADS stands for the Law Enforcement Agencies Database System. To run a license plate through LEADS for personal reasons or not in conjunction with a law enforcement cause is a felony. That is what he is being sued for. This is one of those stories that took on a life of its own, so the Northwest Herald had to take notice. The Northwest Herald asked the Undersheriff for his side of the story in an article.

This is what he had to say: Zinke on Monday defended his use of LEADS and tells a different version of events from Hanlon’s. He said he got a knock at his door at night from a “scary-looking lady dressed in all black” who said nothing, waved papers in his face and threw them at his feet. He said he followed her to her car continuing to ask who she is and got her license plate,

“You show up at my house in the dark, at night, in a quasi-threatening way and wave an envelope at me and don’t say anything?” Zinke said. “Yeah, I’m going to see who you are. I do that for a living. I’m in law enforcement, my wife’s in law enforcement, I’ve got two young children at home, yeah, I’m going to find out.”

WOW!! Hello “man-child” and good bye self-respect. Are you buying this story? No, me either. In his defense the only other thing that he could say was “I did it.” We all have been too far down the road together to think that Zinke would take accountability for his action. I am the first one to admit the humor in all of this, except what Ms. Matterness endured. A uniformed man stating that he is threatened by a 78 year old woman and describes her as scary-looking lady dressed in black that shows up at my door in quasi-threatening way waving an envelope. Are you serious; you carry a gun!! Paper covers rock but paper does not cover gun. Commenter “rdtrinitycoll1” thought the NWH’s headline should have read SHERIFF’S CANDIDATE FRIGHTENED BY 78 YEAR OLD FEMALE NINJA ARMED WITH SHEETS OF PAPER! This is extremely funny, hilarious even; are you ready, here is the punch line. This man can become sheriff! Not so funny now is it? Make sure that does not happen and VOTE. Early Voting all this week. I will post the locations at the bottom of this article.

Tamara DeModica, is Andrew Zinke's campaign manager and believed to be anonymous poster Fukoku Kyohei

Tamara DeModica, is Andrew Zinke’s campaign manager and believed to be internet troll Fukoku Kyohei

Let’s discuss the next Zinke disaster of the past week, “Fukoku Kyohei.” “Fukoku Kyohei” was a pseudo name used by an anonymous internet troll on the mchenrycountyblog.com. They would make references and attack McHenry County States Attorney Lou Bianchi and McHenry County Sheriff’s candidate Bill Prim. The poster was stating that they were corrupt and said that they have given special favors to people. These rants went on for months and even myself and my co-author, Keith Bettinger has even been attacked. Stating that our book was fictitious but never stating what was fictitious about it. Lou Bianchi had enough and brought forward a lawsuit against “Fukoku Kyohei.” In a statement Bianchi said that his attorneys have subpoenaed the records and IP addresses for Fukoku.

Bianchi’s attorneys traced the IP and devices to Oak Star Property Management. Oak Star is owned by Robert DeModica and Tamara DeModica is listed as an administrative contact. Tamara currently serves on the Committee to Elect Andrew Zinke; was paid by his campaign at least $7,450 (total paid to her personally and to her firm TEC Communications Consulting) in 2013 for campaign communications; and is listed multiple times on Zinke’s election website and in Zinke’s press releases as a contact person for the campaign.

If this turns out to be correct, and my guess that it most likely is, what does this say about Zinke and his supporters? On her LinkedIn page, Tamara states that currently she is the president of TEC Communications Consulting. The core competencies listed are Public Relations, Marketing Communications, Copywriter, Graphic Design, and Political Consulting. For the life of me, I cannot understand how a person that suggests that they are a professional PR person deploys a political strategy of being an anonymous internet troll posting in the comment section on a blog. Was this a service pitched to Zinke? Did Tamara receive in part $7,450.00 for this troll campaign, assuming that she is “Fukoku Kyohei”? However when you put Andrew Zinke and

Tamara DeModica together they are peas in a pod. They view themselves as entitled and above the fray of you and I. We have to assume that Andrew Zinke supports the behavior of his committeeperson Tamara DeModica. We have not heard from Zinke that he has fired her or disapproves in her troll activities or anything in anyway about the subject.

The only reason that you would conduct yourself or your campaign in such a manner is because you have doubt. You have doubt in your skills to market, you have doubt in your skills as a professional, and you have doubt in your candidate. In a sense you are hearing right from the horse’s mouth on this one. Take it from Andrew Zinke and Tamara DeModica. They doubt Undersheriff Zinke’s abilities to lead and become a good sheriff so you should to. Vote for Bill Prim for McHenry County Sheriff. You can vote RIGHT NOW, TODAY!! Go to your perspective precinct location for early voting, ask for a Republican ballot, and cast your vote for Bill Prim.

Nothing Wrong at the Sheriff’s Office according to Zinke

Bill Prim and Andrew Zinke at MCC for the League of Women Voters forum

Bill Prim and Andrew Zinke at MCC for the League of Women Voters forum

If you watched the debate or the League of Women Voter’s forum, there is Nothing Wrong at the Sheriff’s office according to Undersheriff Andrew Zinke. We were lucky to even have had this debate. As you may recall there was a lot of dodging of the debate going on by Undersheriff Andrew Zinke. He dropped out of the Patriots United debate because there were two others and third would be unnecessary, so he claimed. The only problem was at that time there were no other debates scheduled. You can read more about the specifics Andrew Zinke Fearful to Debate Bill Prim Lies to Get Out of It.

The opening statement for the debate was made by Bill Prim. He attacked Zinke on a few issues. He attacked Zinke on the sheriff’s office losing three million a year on the ICE (Immigration and Customs Enforcement) Program, Zinke tipping off Brian Goode about a DEA investigation concerning his RITA Corporation, Zinke’s attacks on McHenry County States Attorney Louis Bianchi, fighting in court to not release a report that exonerates any wrongdoings by Zinke in the RITA fiasco, and all the cases brought forward by the sheriff’s office designed to punish those that don’t toe the line. Prim opened by saying “I believe it is our absolute obligation to make sure that we are fiscally prudent and a good steward of the taxes that come into the county.”

Bill Prim

“Since I announced my candidacy about a year and a half ago I’ve expressed my visions I think clearly and accurately and I think they have been fairly well disseminated.  So instead of telling you what I will do when I’m elected Sheriff I’m going to tell you what I won’t do.

•             I won’t tip off a business owner who is a large campaign donor when there is an illegal shipment of narcotics coming into their business.

•             I won’t create a division between other elected officials by publicly berating them in the press.

•             I won’t have the person that’s responsible for conducting internal investigations out passing my nominating petitions.

•             I won’t create a roadblock for the dissemination of information that’s requested through the freedom of information.

•             I won’t squander the taxpayer’s dollars or the courts time or employee time from the states attorneys’ office and the sheriff’s office trying to defend those positions as well.”

Andrew Zinke denied that there was any truth in Prim’s opening statement by replying “Then, there’s the truth.  I’ll ignore most of the bogus information you’ve heard earlier.” Unfortunately in politics you don’t have to substantiate anything you say, otherwise Undersheriff Andrew Zinke should have to state what was incorrect in Prim’s statement. However, McHenry County is losing three million a year housing ICE inmates (Immigration and Customs Enforcement); you can read an analysis done by the McHenryClountyBlog.com. Undersheriff Andrew Zinke did tip off Brian Goode about a DEA investigation concerning his RITA Corporation; you can read my article Andrew Zinke plus Rita Corporation equals ON THE TAKE. The rift between the sheriff’s office and states attorney’s office is infamous. One of the reasons is because of Zinke’s comments to the press about Bianchi; here is article from the Daily Herald as one example. It is also true that sheriff’s office is fighting like hell to not release a report that Sheriff Nygren says exonerates Zinke for any wrongdoing in the RITA fiasco, you can read my article Sheriff Opts for Belligerence to Thwart FEN’s Attempt to Secure Undersheriff Andrew Zinke Report. The sheriff’s office spends a lot of time and money on punishing deputies in court; you can read my article McHenry County Deputy Zane Seipler under siege, Again!! and Another McHenry County Deputy under siege, Scott Milliman.

The moderator of the debate asked the candidates about the ICE program. They asked “Do you favor extending the present contract with immigration beyond its current length, taking into account that expenses exceed reimbursements? “If you do not, how would you handle the loss of jobs and the use of that space?” Zinke was up first and responded, “First, do I favor the extension of the contract with ICE? Absolutely, if it’s cost effective, but that’s not up to me. That’s not up to the Sheriff. That’s up to the County Board…” Since it is not cost effective, it is difficult to tell if the Undersheriff would continue the program or not. What was clear though is that Undersheriff Andrew Zinke does not believe that the sheriff is responsible for the sheriff’s budget. There are only two ways to interpret this statement. Either Undersheriff Andrew Zinke offers no leadership in making a proposals or recommendations about the sheriff’s budget to the McHenry County Board, or he is taking no responsibility in losing three million a year. McHenry County citizens have been given a perception by the McHenry County Sheriff that the jail build out was a good thing for the county. Here is a link to a Chicago Tribune article where Sheriff Nygren PROPOSES to the board about the sheriff’s budget and the jail build out.  Sheriff Nygren in a Chicago Tribune article for his 2010 campaign stated that “This bed rental program will generate revenue to the county for many years to come and represents a significant dividend to the tax payers.”

Those were the major issues that were brought up, along with morale of the deputies. Bill Prim recognizes that morale of the deputies is at what maybe an all-time low. Undersheriff Andrew Zinke denies that there is a morale problem. Zinke stated that this was only a couple of disgruntled employees that were having the morale problem. In short, it was another denial. If we were to take Undersheriff Andrew Zinke at his word, there are no problems or no issues with the McHenry County Sheriff’s office. I guess he has mastered Sheriff Keith Nygren’s typical response of nothing to see here. So what do the citizens think?

I would guess that most citizens were hoping to understand better what has been going on with ICE, the RITA Corporation fiasco, transparency at the sheriff’s office, and overall affairs and morale of the department. I believe that the citizens of McHenry County are still hoping for understanding on those topics. According to Zinke there is nothing wrong and nothing to see. Those that support Undersheriff Andrew Zinke were up in arms with Bill Prim. It was nothing that was said or was in the content of the debate. The bone that they had to pick with Prim was his choice of footwear.  Bill Prim wore boots the evening of the debate. I have found a sample comment from the mchenrycountyblog.com from an anonymous poster calling them self Teacher155. I will copy and paste the whole comment including the misspellings.

Almost forgot, Cal. Regarding boots, does anyone know if Ronald Reagan ever wore old, ratty (but comfortable) cowboy boots to a televised debate? Reagan actually owned a ranch & rode horses. Or, how about George W. Bush who is a Texas rancher & businessman. Did G.W. wear old, ratty boots to his debates? Mitt Romney? John McCain? Anyone? Dress for success? Anyone. How many would show up for a business interview to be CEO of a 400 person company wearing those boots? But, we are sadly no longer in an era of our Sunday Best. Jeans aplenty on Sunday at FUM in CL. FWIW. I thought Mr. Primm had a very nice & appropriate business suit. Certainly, the boots say nothing about the job that Mr. Primm will do as Sheriff. But, they were still some ugly boots that detracted from his appearance and effectiveness. Several times while he was speaking, I was distracted and drawn to Mr. Primm’s nervous twitching cowboy boots bouncing around under the table. In fairness, the forum hosts should have provided a table curtain.

My guess is that this user is not really a teacher, so this should not reflect on the teachers from District 155. The Regime Supporters often morph themselves into a “concerned” or “educated” citizen but they typically are from the inner circle. If you look at Teacher155’s comments prior to this on the RITA fiasco, it does put everything into context about this anonymous poster. The RITA fiasco is when Undersheriff Andrew Zinke told Brian Goode that the DEA has been investigating tons of marijuana that has been shipping to his company the RITA Corporations. After the tip Zinke received $5,000 from Brian Goode to his campaign for sheriff. The address that Andrew Zinke uses for his campaign headquarters is the same address that the feds were watching for the receiving of the tons of marijuana. The sheriff exonerated Zinke of any wrongdoing in a 100 page report but he is fighting in court to keep it hidden. Here is Teacher155’s take on the RITA fiasco.

Years ago, a school resource police officer told me “To a cop there are 2 kinds of people in the world, Cops and Suspects.” While I liked the police officer, I was appalled by his sincere belief. Today, an “Us vs. Them” mentality exists within many of our police departments. All Citizens are Suspects? From what I have read and heard about Rita case, the business owner was identified by the Sheriff’s Dept, in consultation with the Feds, as a witness who may assist the criminal investigation. Then, the business owner was told that he was a possible witness who could aid the investigation. And, business owner voluntarily gave information.Whether Mr. Primm or Mr. Zinke, we do not need a Sheriff who thinks all Citizens are Suspects. I hope that anonymous is not suggesting that Mr. Primm will treat decent, all good & hard working citizens, like the Rita owner, as suspects.Lastly, it seems the only person who exposed the federal investigation was the police officer who publicly complained about this to the court and newspaper, not Mr. Zinke.

WOW, right? You know who else has stated this as fact? No one ever! Not even Undersheriff Andrew Zinke has come up with anything like this. However Teacher155’s response is far superior of a spin than Zinke’s first position of denying that he said anything to Goode. It is even better than his second position of I Told Brian Goode but I Did Not Break the Law. As you can see Zinke Supporters like Andrew Zinke himself, do not bind themselves to speaking or acting with integrity.

That is why it is time to VOTE ZINKE OUT and VOTE PRIM IN!!! You do not have to wait to March 18th to vote. YOU CAN VOTE NOW!!. I grabbed this information from Cal Skinner’s website the mchenrycountyblog.com:

Sweeney.

My First Radio Show, LAS VEGAS AND THE MOB with Host Denny Griffin

Ron Chepesiuk

Ron Chepesiuk

I have come a long way since my first radio show interview in November of 2008. Since December of last year until now I have done Ron Chepesiuk’s Crime Beat, Burl Barer’s Outlaw Radio, and Ricky Guns Wise Guy Talk Radio. I enjoy doing these radio shows. Each host has their own slant on my father’s story which drums up different questions that they ask me. It always keeps things fresh and interesting. They are also very important in giving me a platform to tell my father’s story and keep my father’s story in the public eye. I have had the opportunity to do as many as 15 shows.

Burl Barer

Burl Barer

Doing radio shows today were much different than when I first began doing them in 2008. Back then I was doing it while we were trying to have Larry Neumann named as the killer of my father and Pat. I would not say that I was uncomfortable because I wasn’t.  I was very mindful that the radio show helps in keeping pressure on McHenry County Sheriff’s office to name Larry as the killer. I could have easily said something wrong that could have derailed that goal or mission, and that is where the pressure would come from. At that time I was not just speaking for myself, I was speaking for Scharff and Freeman family members. I was very careful in how I replied back to the questions asked. I could not just speak my mind. It could have a negative impact or it could have represented a view that not all family members shared. This is a contrast to me today. I speak my mind for the most part because I am only

representing myself. We were successful in naming Larry Neumann as the killer of my father, Ron Scharff and his employee, Patricia Freeman, so I do not feel the immense pressure of trying not to fail when being interviewed. I am much more relaxed doing these shows now a day. However my first show is one of my favorites. It was a one in a lifetime chance to have everyone on the show that we had that day. It was my first indoctrination in using a public platform to speak about my father’s case, and it was a really positive experience.

It was November of 2008. At this time I have my interview with Carol Marin of NBC News 5 Chicago scheduled.  We had an exclusive with NBC 5, meaning that we could not tell the story to anyone until

Carol Marin NBC 5 News Chicago

this interviewed aired first. However, with the sheriff’s office taking over two months in trying to figure out what statement that they wanted to make, NBC 5 allowed us to do Denny Griffin’s radio show. Denny is the co-author of the book CULLOTTA, which is autobiography of Frank Cullotta, a Chicago Outfit associate that turned government witness. He is who I reached out to after Jim Hager called me and told me that Larry Neumann was the killer of my father. He read it in Frank’s book after his daughter Holly sent him the book and after she had read it.

Denny’s radio show at the time was called Las Vegas and the Mob. I remember being really excited about doing this show. This was also going to be the first time that I have spoken to Frank Cullotta and Dennis Arnoldy. Dennis was Frank’s FBI Debriefer when he turned government witness. He led the team of law enforcement that captured the Hole in the Wall Gang when they tried to rob

Bertha’s Gifts and Home Furnishings on the 4th of July, 1981. This is not only my favorite show because it was my first but because of everyone that was on it. We had Denny and me, and we also had Frank Cullotta, Dennis Arnoldy, Holly Hager, and Jim Hager. Jim Hager is no longer with this and that gives me all that much more reason to cherish the show even more. Denny Griffin was the host and the co-author of Frank Cullotta’s book that on page 130 told me who killed my father. Frank Cullotta was the mobster who turned government witness and told McHenry County back in 1982 that it was Larry Neumann that killed my father. Dennis Arnoldy was a Special Agent with the FBI that in 1982 who also told McHenry County that Larry Neumann killed my father. Holly Hager is the daughter of Jim and my former babysitter. She was the one that researched Larry Neumann after talking to her dad, and found the book CULLOTTA with it saying that Larry Neumann killed my dad and Pat. Jim Hager was my dad’s best friend and he told McHenry County that Larry Neumann may have killed my father back in 1981.

CULLOTTAI called into the radio show so I was unfamiliar with any protocols and I had no idea what to expect. Well I did expect one thing. That when I called in that everyone else would be on the phone too, but it was only Denny and I. Denny said not to worry, but that went in one ear and right out the other. I was very worried. I just told everyone to listen to the show. My friends have heard me run my mouth before; they were more interested in hearing from everyone else. Not to mention that this was my first event if you will in kicking off my campaign to name Larry Neumann as the killer of my father. This is not working out the way that I hoped, but I had to relax and focus. It looks like it is only going to be me and Denny on this one.

The show starts and Denny kicks in. I cannot tell if he is being a good host providing background information or if he was stalling. Either case I am thinking that he is doing a good job. He introduces me and my tone is serious. I am as serious as a heart attack. I am also talking slower than I normally would and using a subdued voice. I am more excitable when I am talking or telling stories but not that day. I did not want to screw up anything and wanted to be ready if Denny asks me a question. Denny explains to the audience that Frank Cullotta use to work for Tony Spilotro in Las Vegas. After he provides everyone with an explanation of who Frank is, it is almost six or seven minutes into the show.

Then he introduces Frank. Whew…. I felt some relieve. I knew that everyone wanted to hear from Frank and here he is. Frank and I have never spoken directly to each other before this. Frank says Hi to me and I reply back in tone that was closer to my everyday voice, I was excited that I just said Hello to Frank Cullotta. Denny starts to interview Frank and shortly thereafter he was telling us how he thought that he talked Larry Neumann out of killing my father. Nothing was to shocking but I knew that I need to disconnect myself from my feeling or attachments to my father. I did not ever want to be caught off guard being emotional about my father while I was publically talking about him. After 15 minutes I hear Denny introduce Dennis Arnoldy. I was like alright, here we go, but Denny had problems bringing him online. Then Denny mentions that he has a call from the 815 area code. I know this to be a McHenry number…it was Holly. My babysitter is now on the line. Denny asks Holly how she came across the book CULLOTTA and she tells her story. Denny introduces Dennis Arnoldy again and they are connected. He greeted everyone and I see that this show is really coming together. It was hard to imagine with all this information that McHenry County never picked up Larry Neumann. It told me that things were really wrong with my father’s case.

Front page of Chicago Sun Times Article

Holly Hager on the front page of Chicago Sun Times Article

I am not able to take in all this information and still pay attention but I knew that we were killing it. We were telling this incredible story with people that had first-hand knowledge of what it is that they were talking about. Everyone was here except Jim Hager. I knew that this show was flowing but where is Jim. Dennis Arnoldy than mentions a newspaper article that was written in Las Vegas at the time. This article was critical in me connecting McHenry County Sheriff George Hendle to the Chicago Outfit. I would not see this article or even understand it until almost four years later after he mentions it on this show.

Holly started talking and she alludes to my thinking and interrupts herself. “My dad is supposed to be calling… I just tracked him down 20 minutes ago; he said that he would go home and call.” Denny says that we have another caller. “Hello you are the line,” says Denny to the caller. The caller responds with “HELL-O.” Holly and I both say on the air, that’s Jim! Now everyone is on the line. Holly is telling stories on how she was affected by the murders and how the sheriff’s department found out about Larry Neumann was the killer. Denny starting asking Jim questions about how he knew Larry Neumann. He also asked Jim about Larry’s ex-wife Debbie.

Dennis Aroldy and Paul Scharff at the Clark County Library, Las Vegas, NV. January, 2011

Dennis Aroldy and Paul Scharff at the Clark County Library, Las Vegas, NV. January, 2011

Jim recalled the night that my dad threw her out of the bar. This is the reason why my father was killed. Denny asks Jim if Debbie was a regular at the bar and if she had a reputation as a troublemaker. “Oh yeah, she had a big mouth.” This drew in laughter from Frank as he agreed. What started happening was Jim and Frank started to go back and forth about Larry.

Frank Cullotta and Jim Hager had never met each other or even knew each other existed until this day. Not exactly true because Jim did read his book; but never have spoken to each other until this radio show. You would never have known that while you listened. They were talking about Debbie and going back and forth. They also talked about the night that my father threw Debbie out of the bar. Jim would talk about what he witnessed and Frank would talk about the telephone call that Larry received from Debbie that same night at his restaurant the Upper Crust.

Jim Hager

Jim Hager

Jim started telling the audience how Larry Neumann enjoyed hurting and killing people. He shared a story of when he lent some keys to the gate of Petersen Sand and Gravel to a black woman. This was a gravel pit that Jim worked at and the woman was living in one of the farm houses on the property. The woman lived there with her young son. She stopped at my father’s bar to ask and get the keys from Jim. A half hour later Jim wondered out loud where is this woman at. The gravel pit was only a couple of minutes down the road. Larry sparked up with a racial slur and said let’s get this bitch. Larry, Jim, my father, and a fourth person hopped into my father’s station wagon and drove to the gravel pit. At the gate were the woman and her young son. Larry was going to kill her and her son right there on the spot. Jim was desperately trying to talk him out of it. It took a while but Larry allowed them to live. It was a real incredible story hearing it from Jim because he was there and right in the middle of it.

There were other stories that were told about Larry. Based on Holly’s research and review of court records, Larry was very smart. This was also confirmed by Frank Cullotta. Holly’s sister Heidi called in and they both talked about being called into the sheriff’s office to talk to Andrew Zinke. We all talked about how Larry did not have to hurt or kill people because he was well to do with a trust fund left by his father. Frank talked about being on the “Goon Squad,” with Larry in the prison hospital. Frank Cullotta and Dennis Arnoldy offered to help me in any way that they can. It was a wildly interesting show but judge for yourself. Listen to Las Vegas and the Mob with Denny Griffin, Frank Cullotta, Dennis Arnoldy, Holly Hager, Jim Hager, and myself Paul Scharff.

Sheriff Opts for Belligerence to Thwart FEN’s Attempt to Secure Undersheriff Andrew Zinke Report

Undersheriff Andrew Zinke and the Rita Corporation on RT 31

Undersheriff Andrew Zinke and the Rita Corporation on RT 31

This is a story that has been going on for over a year now. It is a comment on what Sheriff Keith Nygren feels about inviting transparency for the public into his sheriff’s department. Keith will have none of that and we all should be good with his explanation of nothing to see here, just move along. It is also a comment of bucking systems, wasting time, and wasting tax dollars; something that the Sheriff has done many times in the past.

In October of 2012, the former McHenry County Sheriff’s Department Narcotics Chief John Koziol asked for a Special Prosecutor to investigate Undersheriff Andrew Zinke. Koziol wanted Zinke investigated for tipping off Brian Goode that the DEA was investigating tons of marijuana drug shipments to his RITA Corporation in Crystal Lake. Brian Goode had provided a $5,000 contribution to Andrew Zinke’s campaign for McHenry County Sheriff after he was given the tip. The same address for the RITA Corporation that was being investigated is the same address that Undersheriff Andrew Zinke gives as his campaign headquarters. Koziol was denied the Special Prosecutor. Sheriff Keith Nygren had told the Northwest Herald that “There hasn’t been any violation of any departmental rule or regulation.”

Deputy John Koziol

Deputy John Koziol

In January of 2013, Pete Gonigam of the First Electric Newspaper or FEN filed a FOIA Request (Freedom of Information Act) for a report that summarized the investigation of Andrew Zinke of any wrongdoing when he tipped off his friend Brian Goode. Gonigam was denied this request by the McHenry County Sheriff’s office, so he had to file an appeal. Pete Gonigam filed his appeal with the Public Access Bureau or PAB, in the Illinois Attorney General’s office. The PAB reviewed the appeal and ordered the sheriff’s office to release it. Sheriff Keith Nygren refused to follow the instructions that he was given by the PAB to release the report. FEN continued to email and call the McHenry County Sheriff’s office for the report for about 30 days before filing suit.

On June 18th, 2013 FEN filed a lawsuit to compel the sheriff’s office to comply with the PAB Ruling. “This isn’t about who should be the next Sheriff,” said FEN Publisher Pete Gonigam in an article on his website.  “It’s not a reporter’s job to care about that.  This is about whether the Sheriff right now can ignore the law.” This is where the dysfunction, belligerence, and loss of McHenry county citizen’s tax dollar at the hand of the McHenry County Sheriff’s office begins.
On July 10th, 2013 the case started and so did the games. Sheriff Keith Nygren, Equal Employment Opportunity Officer Donald Leist started requesting that Judge Thomas Meyer to appoint a Special Assistant State’s Attorney to defend them and the sheriff’s office. Claiming that the States Attorney’s Office (which is the sheriff’s attorney in such matters) will not defend him with zeal because of States Attorney, Lou Bianchi, is supporting Bill Prim in the McHenry County Sheriff election.
On July 19th, 2013 everyone appeared in court to only have everyone come back on August 20th. We still do not know who is defending the sheriff. Another hearing is now scheduled for August 20th.

Sheriff Keith Nygren

Sheriff Keith Nygren

Early August the McHenry County State’s Attorney, Lou Bianchi responds to the jockeying in the courtroom for Special Assistant State’s Attorney to defend the sheriff. Bianchi said he was defending them the way a State’s Attorney should and said their request for another lawyer was based on “speculation and suspicion.” Bianchi stated that this all does not make a difference since Bill Prim and Andrew Zinke are not named in the case. He said Nygren and Leist are claiming Bianchi won’t “zealously represent” them, “without pleading or proving any facts.”
On August 20th, 2013 Donald Leist the Equal Employment Opportunity Officer, continued to argue that Bianchi won’t defend Sheriff Keith Nygren in this case. However in his argument Leist almost suggests that the report that exonerates Zinke of any wrong doing is actually harmful to his campaign for sheriff. He states to Judge Thomas Meyer ”You would be giving the internal investigation of Andy Zinke to (Lou Bianchi) who’s in the political committee of Bill Prim.” FEN’s attorney Mary Gardner asks the Assistant State’s Attorneys Norm Vinton who is defending the sheriff’s office how big is the report?  He replies that he does not know, because he has not seen the report. Sheriff Keith Nygren and Equal Employment Opportunity Officer Donald Leist are so protective over this document that they have not even allowed the people defending them to look at it. The judge decides that it is McHenry County State’s Attorney, Lou Bianchi that will defend the interest of McHenry County. They will meet the following Tuesday to see if that will still work for everyone.

McHenry County States Attorney Lou Bianchi

On August 28th, 2013 the case continues and so does the jockeying to specify a lawyer for Nygren and Leist. Judge Thomas Meyer asks for each side to provide a list of three attorneys to pick to represent Sheriff Keith Nygren and Equal Employment Opportunity Officer Donald Leist and to avoid having to name a Special Assistant State’s Attorney. Bianchi had his list ready and Donald Leist asks the judge for 30 days to create his. The judge denies him and tells him to have the list by the following Friday. Judge Thomas Meyer tells Leist to provide the report and an index to the report for his in-chambers examination. Leist scratches out the order for this requirement but FEN’s attorney Mary Gardner pencils it back in as the judge was clear that he wanted the report and the index. The next hearing is scheduled in September.
On September 20th, 2013 there is another hearing. At this point the list of attorney’s requested by both sides to represent the Sheriff Nygren and EEO Donald Leist is compiled. No one the list wants to represent Nygren or Leist in this case. Judge Thomas Meyer decides that he will continue to look for an attorney. He schedules a hearing for the following Thursday.

First Assistant of the State’s Attorney’s Office Norm Vinton

First Assistant of the State’s Attorney’s Office Norm Vinton

On October 1st, 2013 it has been decided that it would be attempted to have The Appellate Defender represent Nygren and Leist since no other attorneys would. The only problem potentially is that the role of The Appellate Defender is to defend criminals that are indigent in criminal cases. Nygren and Leist are not poor and this is a civil suit. However Leist finds the representation acceptable for himself and Sheriff Nygren. Another hearing is scheduled to see if this idea to have The Appellate Defender defend Leist and Nygren will work.
On October 4th, 2013 the idea is to have The Appellate Defender defend Sheriff Keith Nygren and Equal Employment Opportunity Officer Donald Leist did not work out. Judge Thomas Meyer stated that this would make nine attorneys that would not defend Nygren and Leist. The judge will now consider attorneys in the private practice. Judge Thomas Meyer stated, “I don’t want this to go on another month.” The judge asks McHenry County Chief Deputy State’s Attorney Norm Vinton to figure out what State statues require the County to pay a private attorney. Since now it looks like the tax payers are going to have to flip this bill. Vinton voices concern for the States Attorney Office about the cost involved in this case.
On October 11th, 2013 Pete Gonigam of the First Electric Newspaper drops Sheriff Keith Nygren and Equal Employment Opportunity Officer Donald Leist from the case. This was to thwart continual delays by Donald Leist to find an attorney other than Lou Bianchi’s office to defend him and the sheriff. When FEN’s attorney Mary Gardner dropped Leist and Nygren from the case, Leist responded. He states to the judge, “You can’t divorce the person from the Office,” and complained, “I don’t believe the Sheriff’s Office has had an opportunity for a full and fair hearing.” Meyer said this was the third time he’s had to rule there’s no inherent conflict between the State’s Attorney’s Office and the Sheriff’s Office. He set a hearing date of October 29th to see if Donald Leist may change his mind by then.

Equal Employment Opportunity Officer Donald Leist

Equal Employment Opportunity Officer Donald Leist

On October 29th, 2013 Donald Leist was still griping that the McHenry County States Attorney’s office would not properly defend the McHenry County Sheriff’s office in hiding this report that exonerates Zinke. Judge Thomas Meyer disagreed and said that he has no reason to think that Lou Bianchi’s office would not defend the sheriff’s office. Leist then volunteered himself to defend the sheriff’s office. Assistant State’s Attorney Brandy Quance objected and states that statutes make Bianchi’s office the legal counsel for the sheriff. However the judge ruled that Leist could also represent the sheriff’s office. Finally the attorney thing is all hashed out and the judge asked Leist to provide the report and index to the sheriff’s attorneys. Donald Leist objected and stated that no one should be able to see the report or the index, because it may be leaked. “They can’t represent the Sheriff if they don’t have access to it,” said Judge Thomas Meyer. “Like it or not, they’re your attorneys.” The bickering went on for almost an hour and the judge decided to hear more arguments on Thursday.
On November 1, 2013 the plan that Donald Leist will be co-counsel in this case had fallen through. Judge Thomas Meyer said that he would only allow one lawyer to make argument in this case. The judge also told First Assistant State’s Attorney Norm Vinton that he could file a motion to remove Leist from the case. On a side note that same day, the Northwest Herald had a copy of the 100 page report. Things that make you go hummm….. Nygren and Leist are the only ones with copies of this report. How did the NWH get a copy, hummm……? If they leaked it, why would they trust a newspaper when they don’t even trust their own attorneys? The accusation that the NWH is in the pocket of the sheriff’s office had been made before. An unsigned editorial said the report contains “nothing” but also said it contains “enough smoke for Zinke’s political opponents to wave around.”
On November 7th, 2013 Judge Thomas Meyer made it clear that Leist could stand at the bench and listen, not arguing and filing more motions. Donald Leist started to argue again to appoint special counsel to defend the Sheriff’s Office but the judge ignored him. “You are the attorney,” Meyer told Assistant State’s Attorney Brandy Quance.  “You will make the decisions because you are in charge of the case.” FEN Attorney Mary Gardner asked again for the index. The judge told Assistant State’s Attorney Brandy Quance that she had to November 19th to hand over the index or argue why she shouldn’t.
On November 15th, 2013 The McHenry County State’s Attorney and sheriff’s office moved to withhold the index from everyone except the lawyers. In the motion filed it said that “dissemination in any fashion could be extremely detrimental to the Sheriff’s Office’s operations and, specifically, any undercover drug operations.” I personally find this statement funny. Do you think Andrew Zinke was concerned about compromising drug operations when he told Brian Goode that they were tracking shipments of marijuana in the tons to his RITA Corporation? Yeah, they were so concerned about compromising drug operations that they are the ones that most likely gave it to the Northwest Herald.

Judge Thomas Meyer

Judge Thomas Meyer

On November 19th, 2013 Judge Thomas Meyer had issued a gag order. All the attorneys had a copy of the index to what we now to be a 100 page report exonerating Zinke for tipping off Brian Goode that the DEA was looking at his RITA Corporation for receiving shipments of marijuana in the tons. The best indicator of what is in the Index of the report is through a quote from Pete Gonigam. He said, “It’s pretty obvious from the index what the Sheriff doesn’t want anyone to see; but if I say any more than, ‘It looks like what I thought might be there’, or, ‘It’s item two on the list,’ the judge will find me in contempt of court and great will be his wrath.” Another hearing is scheduled.
On December 12th, the judge considered FEN’s motion the previous Tuesday to turn over the report. Judge Thomas Meyer said that he could not consider the motion until January 29th of the following year. Donald Leist complained to Judge Meyer that FEN attorney Mary Gardner did not file correctly a list of uncontested facts required by local court rules. Meyer cut Leist off and told him that attorney’s unfamiliar with McHenry County Courtrooms, make that mistake putting it in the bodies of their motions instead. Mary Gardner stated that is what she did and complained to the judge that Leist’s representation was limited to observing and should not be arguing in this case.
On January 10th, 2014 there is another hearing. This was to discuss FEN’s motion to immediately release the 100 page Zinke Drug Report to FEN as requested by FEN, and then seconded by the Illinois Attorney General’s PAB office. They debated the list of uncontested facts but a list was decided and accepted. The sheriff’s attorneys requested 45 days to file a motion. FEN’s attorney Mary Gardner complained that this should have already been filed and the judge agreed. However Judge Thomas Meyer allowed them seven days to do so.
On January 17th, 2014 Sheriff Keith Nygren filed an affidavit that said he “reviewed each and every page” of an investigation of Undersheriff Andy Zinke a year ago, “and carefully and thoughtfully considered each and every fact, allegation, defense and inference,” before he “adjudicated” charges against Zinke were “unsubstantiated.” This was filed in part to address FEN’s motion to immediately release the report.
On January 29th, 2014 Judge Thomas Meyer suggested that he was probably going to allow the sheriff’s office to keep the 100 page report a secret. The judge was troubled that a key document was not commented on by the Illinois Attorney General’s PAB office. The judge would like to see if the PAB had the document when they ruled. The problem now is all this court jockeying has gone on so long that the attorney that reviewed the original FOIA Appeal no longer works at that office. Another hearing is set for the upcoming Wednesday.

Pete Gonigam, publisher of the First Electric Newspaper.

Pete Gonigam, publisher of the First Electric Newspaper.

On February 5th, 2014 Judge Thomas Meyer ruled that the report was over the “adjudication” of Undersheriff Andrew Zinke and therefore withheld from the public’s eye, railroading the Illinois Attorney General’s findings. However, he ordered the release of material in the report that is already in the public, and the judge said that this case is not closed thanks to the Northwest Herald. They had an editorial review of the report citing it contained “smoke for Zinke’s political opponents to wave around.” FEN attorney Mary Gardner has argued that means the report’s already been released so now the Sheriff can’t withhold it. Another hearing is scheduled for Friday.
On February 14th, 2014 Judge Thomas Meyer refused to stop FEN from pursuing the 100 page report that exonerates Undersheriff Andrew Zinke. The report was leaked to the Northwest Herald and at the time only the sheriff’s office had this report. If the sheriff’s office released it to the NWH then it is public domain and FEN should get the copy that they requested. The sheriff’s attorney, Assistant State’s Attorney Brandy Quance told the judge that she was going to appeal the partial release order and wanted Meyer to halt the whole case until a verdict was given at the appellate. FEN’s attorney Mary Gardner argued that there was a need to find out what was leaked to the NWH. The judge asked sheriff’s attorney Brandy Quance why he should halt the whole case. A long silence was her reply. While the judge was temporarily in chambers, sheriff’s attorney, Equal Employment Opportunity Officer Donald Leist said to FEN’s attorney Mary Gardner “You’re the one trying to influence the election. You and your client.” The bailiff said to Leist after threatening to throw him out, “You can’t bait people here, Mr. Leist.” Another hearing is scheduled five days prior to the Republican Primary election for sheriff on March 13th. The Saga Continues……

So what do you think? Put yourself in Pete Gonigam shoes, what if this were you? You were denied a reasonable request. You then seek a higher authority to appeal too. They agree with you and offer a verdict in your favor. You would expect that would be the end of it right? How much do you think it costs every time to have your lawyer appear in court? How much do you think that it costs to have your lawyer prepare for each appearance in court? If you feel that Mr. Gonigam’s isn’t getting the run around and it is perfectly ok to have 21 plus hearings after a higher government entity has made a verdict, vote for Undersheriff Andrew Zinke in the Republican Primary for sheriff on March 18th. With him you are guaranteed a continuance of belligerency. If you are appalled by the plight of Mr. Gonigam then vote Bill Prim instead. He stands for integrity and transparency. I will let you all know what happens when this thing finally ends.
